14private educational program, as defined in s. 115.001 (3g), and has satisfactorily
15completed a course in driver education in public schools approved by the department
16of public instruction, or in technical colleges approved by the technical college system
17board, or in nonpublic and private schools or tribal schools, as defined in s. 115.001
18(15m), that meet the minimum standards set by the department of public
19instruction, or has satisfactorily completed a substantially equivalent course in
20driver training approved by the department and given by a school licensed by the
21department under s. 343.61, or has satisfactorily completed a substantially
22equivalent course in driver education or training approved by another state and has
23attained the age of 16, except as provided in s. 343.07 (1g). The department shall not
24issue a license to any person under the age of 18 authorizing the operation of “Class
25M" vehicles unless the person has successfully completed a basic rider course

1approved by the Wisconsin department of transportation motorcycle safety program.
2The department may, by rule, exempt certain persons from the basic rider course
3requirement of this paragraph. Applicants for a license under s. 343.08 or 343.135
4are exempt from the driver education, basic rider or driver training course
5requirement. The secretary shall prescribe rules for licensing of schools and
6instructors to qualify under this paragraph. The driver education course shall be
7made available to every eligible student in the state. Except as provided under s.
8343.16 (1) (bm) and, (c), and (cm) and (2) (cm) to (e), no operator's license may be
9issued unless a driver's examination has been administered by the department.
AB68-ASA2,394 10Section 394. 343.16 (1) (a) of the statutes is amended to read:
AB68-ASA2,349,2211 343.16 (1) (a) General. Except as provided in par. (cm) and when examination
12by a 3rd-party tester is permitted under pars. (b) to (c), the department shall
13examine every applicant for an operator's license, including applicants for license
14renewal as provided in sub. (3), and every applicant for authorization to operate a
15vehicle class or type for which the applicant does not hold currently valid
16authorization, other than an instruction permit. Except as provided in par. (cm) and
17sub. (2) (cm) and (e), the examinations of applicants for licenses authorizing
18operation of “Class A", “Class B", “Class C", “ Class D" or “Class M" vehicles shall
19include both a knowledge test and an actual demonstration in the form of a driving
20skills test of the applicant's ability to exercise ordinary and reasonable control in the
21operation of a representative vehicle. The department shall not administer a driving
22skills test to a person applying for authorization to operate “Class M" vehicles who
23has failed 2 previous such skills tests unless the person has successfully completed
24a rider course approved by the department. The department may, by rule, exempt
25certain persons from the rider course requirement of this paragraph. The

1department may not require a person who is applying for authorization to operate
2“Class M" vehicles and who has successfully completed a rider course approved by
3the Wisconsin department of transportation motorcycle safety program to hold an
4instruction permit under s. 343.07 (4) prior to the department's issuance of a license
5authorizing the operation of “Class M" vehicles. The department may not require a
6person applying for authorization to operate “Class M" vehicles who holds an
7instruction permit under s. 343.07 (4) to hold it for a minimum period of time before
8administering a driving skills test. The driving skills of applicants for endorsements
9authorizing the operation of commercial motor vehicles equipped with air brakes, the
10transportation of passengers in commercial motor vehicles or the operation of school
11buses, as provided in s. 343.04 (2) (b), (bm), (d) or (e), shall also be tested by an actual
12demonstration of driving skills. The department may endorse an applicant's
13commercial driver license for transporting hazardous materials requiring
14placarding or any quantity of a material listed as a select agent or toxin under 42 CFR
1573
, subject to s. 343.125, or for the operation of tank vehicles or vehicles towing
16double or triple trailers, as described in s. 343.04 (2) (a), (c) or (f), based on successful
17completion of a knowledge test. In administering the knowledge test, the
18department shall attempt to accommodate any special needs of the applicant. Except
19as may be required by the department for an “H" or “S" endorsement, the knowledge
20test is not intended to be a test for literacy or English language proficiency. This
21paragraph does not prohibit the department from requiring an applicant to correctly
22read and understand highway signs.
AB68-ASA2,395 23Section 395. 343.16 (1) (cm) of the statutes is created to read:

2driving skills test of an individual applying for an operator's license if all of the
3following apply:

10standards set by the department of public instruction, or has satisfactorily completed
11a substantially equivalent course in driver training approved by the department and

13completed a substantially equivalent course in driver education or training approved
14by another state.
AB68-ASA2,350,1615 4. A driving instructor who provided training to the applicant consents to a
16waiver of the driving skills test.
AB68-ASA2,350,1817 5. The applicant has held an instruction permit issued under s. 343.07 for not
18less than 6 months.
AB68-ASA2,350,2119 6. The applicant has not committed a moving violation, specified by the
20department by rule, resulting in a conviction during the 6-month period
21immediately preceding application.
AB68-ASA2,350,2322 7. An adult sponsor who has signed for the applicant under s. 343.15 (1)
23consents to a waiver of the driving skills test.
AB68-ASA2,350,2424 8. The applicant pays the fee under s. 343.21 (2) (am).

19department. An applicant for or recipient of a credential who changes his or her

21shall notify the department of such change within 30 days of the change in writing
22or in accordance with other notification procedures approved by the department.
AB68-ASA2,352,2423 (b) Electronic communications under this subsection may not be substituted
24for the service of any process, notice, or demand under sub. (2).

1(c) Notwithstanding par. (a), an applicant for or recipient of a credential who

AB68-ASA2,407 15Section 407. 563.16 of the statutes is amended to read:
AB68-ASA2,354,2 16563.16 Amendment of license to conduct bingo. Upon application by a
17licensed organization, a license may be amended, if the subject matter of the
18amendment properly and lawfully could have been included in the original license.
19An application for an amendment to a license shall be filed and processed in the same
20manner as an original application. An application for the amendment of a license
21shall be accompanied by a $3 fee. If any application for amendment seeks approval
22of additional bingo occasions or designates a new member responsible for the proper
23utilization of gross receipts, the appropriate fee under s. 563.13 (4) also shall be paid.
24If the department approves an application for an amendment to a license, a copy of
25the amendment shall be sent to the applicant who shall attach it to the original

1license. All moneys received under this section shall be credited to the appropriation
2account under s. 20.505 (8) (jm) (jn).

11the application. A raffle license shall be valid for 12 months and may be renewed as
12provided in s. 563.98 (1g). The department shall issue the license within 30 days
13after the filing of a complete application if the applicant qualifies under s. 563.907
14and has not exceeded the limits of s. 563.91. The department shall notify the
15applicant within 15 days after it is filed if the raffle license application is incomplete
16or the application shall be considered complete. A complete license application that
17is not denied within 30 days after its filing shall be considered approved. All moneys
18received by the department under this subsection shall be credited to the
19appropriation account under s. 20.505 (8) (j) (jn).

14the county, but the county is eligible to receive reimbursement from the state for not
15more than 90 percent of the costs incurred in providing those services. The
16department shall determine the level of services for which a county may be
17reimbursed. The county board shall file a claim for reimbursement with the
18department. The department shall reimburse counties under this subsection from
19the appropriations under s. 20.455 (5) (f), (k) , and (kp) and, on a semiannual basis,
20from the appropriation under s. 20.455 (5) (g).
AB68-ASA2,9101 21Section 9101. Nonstatutory provisions; Administration.
AB68-ASA2,355,2222 (1) Position transfer to department of transportation.
AB68-ASA2,356,223 (a) Employee transfer. On the effective date of this paragraph, 1.0 FTE position
24classified as staff development program specialist—senior in the department of

1administration and the incumbent employee holding that position is transferred to
2the department of transportation.
AB68-ASA2,356,73 (b) Employee status. An employee transferred under par. (a ) has all the rights
4and the same status under ch. 230 in the department of transportation that the
5employee enjoyed in the department of administration before the transfer.
6Notwithstanding s. 230.28 (4), no employee transferred under par. (a) who has
7attained permanent status in class is required to serve a probationary period.
AB68-ASA2,356,158 (2) Department of workforce development clearing account deficit. The
9department of administration shall identify amounts from general purpose revenue
10appropriations to executive branch state agencies in fiscal year 2021-22 that can be
11used to reconcile the unresolved clearing account deficit reported by the department
12of workforce development at the close of the 2019-20 fiscal year. The department of
13workforce development and the department of administration shall submit a request
14under s. 13.101 (4) to transfer the amounts so identified in this subsection to the
15appropriation under s. 20.445 (1) (a) no later than March 1, 2022.
AB68-ASA2,356,1916 (3) Assistant district attorneys; pay progression. Notwithstanding s. 230.12
17(10) (c), any pay progression adjustment for assistant district attorneys made during
18the 2021-23 fiscal biennium shall be made in the first pay period that occurs after
19January 1, 2022 and January 1, 2023.
AB68-ASA2,356,2320 (4) Assistant state public defenders; pay progression. Notwithstanding s.
21230.12 (11) (c), any pay progression adjustment for assistant state public defenders
22made during the 2021-23 fiscal biennium shall be made in the first pay period that
23occurs after January 1, 2022 and January 1, 2023.
AB68-ASA2,356,2524 (5) Supplemental pay plans for correctional officers and correctional
25sergeants during the 2021-23 fiscal biennium.

1(a) The administrator of the division of personnel management in the
2department of administration shall include in the compensation plan under s. 230.12
3for the 2021-23 fiscal biennium supplemental pay of $5 per hour worked for
4correctional officers and correctional sergeants at any adult correctional institution
5with a vacancy rate among correctional officers and correctional sergeants of more
6than 40 percent, as determined by the administrator of the division of personnel
7management in the department of administration. If a correctional institution that
8has provided supplemental pay under this paragraph has a vacancy rate among
9correctional officers and correctional sergeants of 40 percent or less, as determined
10by the administrator of the division of personnel management in the department of
11administration, for 6 consecutive months, the provision of supplemental pay under
12this paragraph shall be suspended. If the vacancy rate among correctional officers
13and correctional sergeants at a correctional institution that has suspended
14supplemental pay under this paragraph increases to more than 40 percent, as
15determined by the administrator of the division of personnel management in the
16department of administration, supplemental pay under this paragraph shall be
17reinstated.
AB68-ASA2,357,2418 (b) If, on the effective date of this paragraph, the compensation plan under s.
19230.12 has been adopted for the 2021-23 biennium and the compensation plan does
20not include the supplemental pay required under par. (a ), by no later than 30 days
21after the effective date of this paragraph, the administrator of the division of
22personnel management in the department of administration shall propose an
23amendment under s. 230.12 (3) (c) to include the supplemental pay required under
24par. (a) in the compensation plan for the 2021-23 biennium.

1Section 9102. Nonstatutory provisions; Agriculture, Trade and
2Consumer Protection.
AB68-ASA2,358,83 (1) Submission of plan. The department of agriculture, trade and consumer
4protection and the Wisconsin Economic Development Corporation shall jointly
5submit to the cochairpersons of the joint committee on finance a proposal for
6allocating $5,000,000 over 5 years to pursue an increase in dairy, meat, poultry, fish,
7crop, and other agricultural product exports by 25 percent over their 2021 levels by
82026.
AB68-ASA2,358,149 (2) Hemp program report. The department of agriculture, trade and consumer
10protection shall study options for resolving the deficit in the hemp program under
11s. 94.55, including modifying fees, relinquishing operations to the U.S. department
12of agriculture, and restructuring program operations. No later than March 30, 2022,
13the department shall report to the cochairpersons of the joint committee on finance
14the department's recommendations for resolving the hemp program deficit.

AB68-ASA2,379,74 (3) Loans. During the 2021-23 fiscal biennium, the building commission may
5make loans from general fund supported borrowing or the building trust fund to state
6agencies, as defined in s. 20.001 (1), for projects that are to be utilized for programs
7not funded by general purpose revenue and that are authorized in sub. (1).
