RE: Petition for Authorization to Repeal Rules Related to the Rental Unit Energy Efficiency Program

Dear Senator Nass and Representative Ballweg:

I am petitioning for authorization to repeal sections SPS 302.35, 305.67, and chapter SPS 367, and amend SPS 302.52 (2) of the administrative code relating to the rental unit energy efficiency program. A copy of the proposed rule is attached.

The agency lacks the authority to administer the rules under sections SPS 302.35, 302.52 (2), 305.67, and chapter SPS 367 due to the repeal of ss. 101.19 (1g) (i) and 101.122, 2016 Stats., as affected by 2017 Wisconsin Act 59, effective January 1, 2018. Repealing chapter SPS 367 and the related provisions of the administrative code is required to comply with the requirements of 2017 Wisconsin Act 59.

Therefore, the Department is requesting authorization to repeal these rules by utilizing the expedited process under s. 227.26 (4), Stats.
