SB70-AA1,152e 23Section 152e. 441.06 (3) of the statutes is amended to read:

15or attempt to practice professional nursing, nor use the title, letters, or anything else
16to indicate that he or she is a registered or professional nurse unless he or she is
17licensed under this section. Except as provided in ss. 257.03 and 440.077, no person
18not so licensed may use in connection with his or her nursing employment or vocation
19any title or anything else to indicate that he or she is a trained, certified or graduate
20nurse. This subsection does not apply to any registered nurse who holds a multistate
21license, as defined in s. 441.51 (2) (h), issued by a jurisdiction, other than this state,
22that has adopted the nurse licensure compact under s. 441.51.
SB70-AA1,824 23Section 824. 441.06 (7) of the statutes is renumbered 441.09 (7) and amended
24to read:

1441.09 (7) Civil liability. No person certified licensed as an advanced practice

SB70-AA1,826 7Section 826. 441.09 of the statutes is created to read:

9(1)
License. (a) An applicant who satisfies all of the following requirements may
10apply to the board for initial licensure by the board as an advanced practice
11registered nurse:
SB70-AA1,374,1212 1. The applicant satisfies one of the following criteria:
SB70-AA1,374,1413 a. The applicant holds a valid license to practice as a registered nurse issued
14under s. 441.06 (1), (1c), or (1m).
SB70-AA1,374,1615 b. The applicant applies concurrently for a license under s. 441.06 (1), (1c), or
16(1m) with the application for a license under this paragraph.
SB70-AA1,374,1917 c. The applicant is a registered nurse who holds a multistate license, as defined
18in s. 441.51 (2) (h), issued by a jurisdiction, other than this state, that has adopted
19the nurse licensure compact.
SB70-AA1,374,2120 2. The applicant provides evidence satisfactory to the board that he or she
21satisfies one of the following criteria:
SB70-AA1,375,222 a. The applicant has completed a graduate-level or postgraduate-level
23education program that is approved by the board and that prepares the applicant for
24the practice of advanced practice registered nursing in one of the 4 recognized roles,

1and the applicant holds a current certification by a national certifying body approved
2by the board.
SB70-AA1,375,63 b. On January 1, 2023, the applicant was licensed as a registered nurse in this
4state and was practicing in a recognized role, and the applicant satisfies additional
5criteria established by the board by rule under sub. (6) (a) 3. relating to practice,
6education, or certification.
SB70-AA1,375,77 3. The applicant pays the fee specified under s. 440.05 (1).
SB70-AA1,375,98 4. The applicant provides to the board evidence of any malpractice liability
9insurance coverage required under sub. (5).
SB70-AA1,375,1110 5. If the applicant is applying to receive a certified nurse-midwife specialty
11designation under par. (b) 1., the applicant does all of the following:
SB70-AA1,375,1312 a. Provides evidence satisfactory to the board that the applicant is currently
13certified by the American Midwifery Certification Board or its successor.
SB70-AA1,375,1414 b. Files with the board any plan required under sub. (3m) (i).
SB70-AA1,375,1615 6. The applicant does not have an arrest or conviction record, subject to ss.
16111.321, 111.322, and 111.335.
SB70-AA1,375,1917 7. The applicant meets any other criteria established by the board by rule under
18sub. (6) (a) 3. relating to the education, training, or experience required for each
19recognized role.
SB70-AA1,375,2520 (b) 1. a. Subject to s. 441.07 (1g), the board shall grant an advanced practice
21registered nurse license to an applicant the board determines meets the
22requirements under par. (a). The board shall also grant a person who is granted a
23license under this subd. 1. a. one or more specialty designations corresponding to the
24recognized roles for which the board determines that the person qualifies based on
25the person's qualifications under par. (a).

1b. The board shall grant an advanced practice registered nurse license to each

SB70-AA1,376,1312 2. Each specialty designation granted under subd. 1. shall appear on the
13person's advanced practice registered nurse license.
SB70-AA1,376,1614 3. The board may not grant an advanced practice registered nurse license to
15a person applying concurrently for a license under s. 441.06 (1), (1c), or (1m), unless
16the board also grants the person the license under s. 441.06 (1), (1c), or (1m).
SB70-AA1,376,1817 4. The board may place specific limitations on a person licensed as an advanced
18practice registered nurse as a condition of licensure.
SB70-AA1,376,2119 5. If all of the following apply to a person, a notation indicating that the person
20may not issue prescription orders shall appear on the person's advanced practice
21registered nurse license:
SB70-AA1,376,2422 a. The person is granted an advanced practice registered nurse license under
23subd. 1. a. and satisfies only par. (a) 2. b. but not par. (a) 2. a., or the person is granted
24an advanced practice registered nurse license under subd. 1. c.

1b. On January 1, 2023, the person did not hold a certificate under s. 441.16 (2),
22021 stats.
SB70-AA1,377,163 (c) On or before the applicable renewal date determined by the department
4under s. 440.08 (2), an advanced practice registered nurse shall submit to the board
5on a form furnished by the board a statement giving his or her name and residence,
6the nursing workforce survey and fee required under s. 441.01 (7), evidence of having
7satisfied the continuing education requirements under sub. (4), evidence of any
8malpractice liability insurance coverage required under sub. (5), any plan required
9under sub. (3m) (i), current evidence that the person satisfies each of the
10requirements under par. (a) 1., 2., 5. a., and 7. that apply with respect to the person,
11and any other information that the board requires by rule, with the applicable
12renewal fee determined by the department under s. 440.03 (9) (a). The board shall
13grant to a person who satisfies the requirements under this paragraph the renewal
14of his or her advanced practice registered nurse license and specialty designations
15granted under par. (b) 1. and shall, if the person holds a license under s. 441.06 (1),
16(1c), or (1m), also grant the renewal of that license.
SB70-AA1,377,20 17(2) Prescribing authority. (a) Except as provided in par. (b), an advanced
18practice registered nurse may issue prescription orders, subject to the rules
19promulgated under sub. (6) (a) 1. and 4., and may provide expedited partner therapy
20in the manner described in s. 441.092.
SB70-AA1,377,2421 (b) An advanced practice registered nurse may not issue prescription orders if
22a notation under sub. (1) (b) 4. indicating that the advanced practice registered nurse
23may not issue prescription orders appears on the advanced practice registered
24nurse's license.

1(3) License required; use of titles. (a) 1. The holder of a license issued under
2this section is an “advanced practice registered nurse," may append to his or her
3name the title “A.P.R.N.," and is authorized to practice advanced practice registered
4nursing.
SB70-AA1,378,75 2. Notwithstanding s. 448.03 (3m), the holder of a specialty designation for a
6recognized role granted under sub. (1) (b) 1. may append to his or her name the title
7and an abbreviation described under par. (b) 2. corresponding to that recognized role.
SB70-AA1,378,128 (b) 1. Except as provided in sub. (3m) (h) and s. 257.03, no person may practice
9or attempt to practice advanced practice registered nursing, nor use the title
10“advanced practice registered nurse," the title “A.P.R.N.," or anything else to indicate
11that he or she is an advanced practice registered nurse unless he or she is licensed
12under this section.
SB70-AA1,378,1313 2. Except as provided in s. 257.03, no person may do any of the following:
SB70-AA1,378,1614 a. Use the title “certified nurse-midwife,” the title “C.N.M.,” or anything else
15to indicate that he or she is a certified nurse-midwife unless he or she has been
16granted a certified nurse-midwife specialty designation under sub. (1) (b) 1.
SB70-AA1,378,2017 b. Use the title “certified registered nurse anesthetist,” the title “C.R.N.A.,” or
18anything else to indicate that he or she is a certified registered nurse anesthetist
19unless he or she has been granted a certified registered nurse anesthetist specialty
20designation under sub. (1) (b) 1.
SB70-AA1,378,2321 c. Use the title “clinical nurse specialist,” the title “C.N.S.,” or anything else to
22indicate that he or she is a clinical nurse specialist unless he or she has been granted
23a clinical nurse specialist specialty designation under sub. (1) (b) 1.

1d. Use the title “nurse practitioner,” the title “N.P.,” or anything else to indicate
2that he or she is a nurse practitioner unless he or she has been granted a nurse
3practitioner specialty designation under sub. (1) (b) 1.
SB70-AA1,379,7 4(3m) Practice requirements and limitations. (a) 1. An advanced practice
5registered nurse licensed under this section may, except as provided in subd. 2. and
6par. (b), practice advanced practice registered nursing only in collaboration with a
7physician or dentist.
SB70-AA1,379,98 2. Subdivision 1. does not apply to an advanced practice registered nurse with
9a certified nurse-midwife specialty designation.
SB70-AA1,379,1510 (b) An advanced practice registered nurse to whom par. (a) 1. applies may,
11except as provided in pars. (d) 1. and (f), practice advanced practice registered
12nursing in a recognized role without being supervised by or collaborating with, and
13independent of, a physician or dentist if the board verifies, upon application of the
14advanced practice registered nurse, that the advanced practice registered nurse
15satisfies all of the following:
SB70-AA1,379,2216 1. The advanced practice registered nurse has, except as provided in subd. 3.,
17completed 3,840 hours of professional nursing in a clinical setting. Clinical hours
18completed as a requirement of a nursing program offered by a qualifying school of
19nursing described under s. 441.06 (1) (c) may be used to satisfy the requirement
20under this subdivision. Hours completed to satisfy a requirement of an education
21program described in sub. (1) (a) 2. a. may not be used to satisfy the requirement
22under this subdivision.
SB70-AA1,379,2523 2. At least 24 months have elapsed since the advanced practice registered nurse
24first began completing the clinical hours required by a nursing program described
25under subd. 1.
SB70-AA1,380,9
13. The advanced practice registered nurse has completed 3,840 clinical hours
2of advanced practice registered nursing practice in that recognized role while
3working with a physician or dentist who was immediately available for consultation
4and accepted responsibility for the actions of the advanced practice registered nurse
5during those 3,840 hours of practice. The advanced practice registered nurse may
6substitute additional hours of advanced practice registered nursing working with a
7physician or dentist described in this subdivision to count toward the requirement
8under subd. 1. Each such additional hour shall count toward one hour of the
9requirement under subd. 1.
SB70-AA1,380,1210 4. At least 24 months have elapsed since the advanced practice registered nurse
11first began practicing advanced practice registered nursing in that recognized role
12as described in subd. 3.
SB70-AA1,380,1613 (c) For purposes of par. (b) 3., hours of advanced practice registered nursing
14practice may include the lawful practice of advanced practice registered nursing
15outside this state or the lawful practice of advanced practice registered nursing in
16this state prior to the effective date of this paragraph .... [LRB inserts date].
SB70-AA1,380,2217 (d) 1. An advanced practice registered nurse may provide pain management
18services only while working in a collaborative relationship with a physician who,
19through education, training, and experience, specializes in pain management.
20Except as provided in subd. 2., this subdivision applies regardless of whether the
21advanced practice registered nurse has qualified for independent practice under par.
22(b).
SB70-AA1,381,223 2. Except as provided in par. (f), subd. 1. does not apply to an advanced practice
24registered nurse who is providing pain management services in a hospital, as defined

1in s. 50.33 (2), or a clinic associated with a hospital, and who has qualified for
2independent practice under par. (b).
SB70-AA1,381,83 (e) For purposes of pars. (a) 1. and (d) 1., a collaborative relationship is a process
4in which an advanced practice registered nurse is working with a physician or
5dentist, in each other's presence when necessary, to deliver health care services
6within the scope of the advanced practice registered nurse's training, education, and
7experience. The advanced practice registered nurse shall document such a
8collaborative relationship.
SB70-AA1,381,129 (f) Nothing in this section prohibits an entity employing or with a relationship
10with an advanced practice registered nurse from establishing additional
11requirements for an advanced practice registered nurse as a condition of
12employment or relationship.
SB70-AA1,381,1813 (g) An advanced practice registered nurse shall adhere to professional
14standards when managing situations that are beyond the advanced practice
15registered nurse's expertise. If a particular patient's needs are beyond the advanced
16practice registered nurse's expertise, the advanced practice registered nurse shall,
17as warranted by the patient's needs, consult or collaborate with or refer the patient
18to at least one of the following:
SB70-AA1,381,1919 1. A physician licensed under ch. 448.
SB70-AA1,381,2220 2. Another health care provider for whom the advanced practice registered
21nurse has reasonable evidence of having a scope of practice that includes the
22authorization to address the patient's needs.
SB70-AA1,382,423 (h) An advanced practice registered nurse licensed under this section may
24delegate a task or order to another clinically trained health care worker if the task
25or order is within the scope of the advanced practice registered nurse's practice, the

1advanced practice registered nurse is competent to perform the task or issue the
2order, and the advanced practice registered nurse has reasonable evidence that the
3health care worker is minimally competent to perform the task or issue the order
4under the circumstances.
SB70-AA1,382,145 (i) An advanced practice registered nurse with a certified nurse-midwife
6specialty designation may not offer to deliver babies outside of a hospital setting
7unless the advanced practice registered nurse files with the board, and the board
8approves, a proactive plan for ensuring appropriate care or care transitions
9conforming with professional standards for patients with higher acuity or emergency
10care needs that exceed the advanced practice registered nurse's scope of practice. An
11advanced practice registered nurse who offers to deliver babies outside of a hospital
12setting shall file a plan under this paragraph when applying for an initial license
13under this section or a renewal of a license under this section, shall keep the plan
14current with the board, and shall follow the plan.
SB70-AA1,382,19 15(4) Continuing education. Every advanced practice registered nurse shall
16submit to the board evidence of having completed at least 16 contact hours per
17biennium in clinical pharmacology or therapeutics relevant to the advanced practice
18registered nurse's area of practice. The board may promulgate rules regarding the
19continuing education requirements under this subsection.
SB70-AA1,383,2 20(5) Malpractice liability insurance. No person may practice advanced
21practice registered nursing unless he or she at all times has in effect malpractice
22liability insurance coverage in the minimum amounts specified under s. 655.23 (4).
23An advanced practice registered nurse shall submit evidence of that coverage to the
24board when applying for an initial license under this section or a renewal of a license

1under this section. An advanced practice registered nurse shall also submit such
2evidence to the board upon request of the board.
SB70-AA1,383,4 3(6) Rules. (a) The board shall promulgate rules necessary to administer this
4section, including rules for all of the following:
SB70-AA1,383,95 1. Further defining the scope of practice of an advanced practice registered
6nurse, practice of a certified nurse-midwife, practice of a certified registered nurse
7anesthetist, practice of a nurse practitioner, and practice of a clinical nurse specialist
8and defining the scope of practice within which an advanced practice registered
9nurse may issue prescription orders under sub. (2).
SB70-AA1,383,1110 2. Determining acceptable national certification for purposes of sub. (1) (a) 2.

SB70-AA1,383,1512 3. Establishing the appropriate education, training, or experience
13requirements that a registered nurse must satisfy in order to be an advanced practice

17prescribed by an advanced practice registered nurse under sub. (2).

SB70-AA1,383,2423 (am) Notwithstanding par. (a), the board may promulgate rules to implement
24sub. (3m) (b).

1(b) The board may not promulgate rules that expand the scope of practice of an
2advanced practice registered nurse beyond the practices within advanced practice
3registered nursing.
SB70-AA1,827 4Section 827. 441.092 of the statutes is created to read:
SB70-AA1,384,5 5441.092 Expedited partner therapy. (1) In this section:
SB70-AA1,384,66 (b) “Antimicrobial drug" has the meaning given in s. 448.035 (1) (b).
SB70-AA1,384,77 (c) “Expedited partner therapy" has the meaning given in s. 448.035 (1) (c).
SB70-AA1,384,19 8(2) Notwithstanding the requirements of s. 448.9785, an advanced practice
9registered nurse who may issue prescription orders under s. 441.09 (2) may provide
10expedited partner therapy if a patient is diagnosed as infected with a chlamydial
11infection, gonorrhea, or trichomoniasis and the patient has had sexual contact with
12a sexual partner during which the chlamydial infection, gonorrhea, or
13trichomoniasis may have been transmitted to or from the sexual partner. The
14advanced practice registered nurse shall attempt to obtain the name of the patient's
15sexual partner. A prescription order for an antimicrobial drug prepared under this
16subsection shall include the name and address of the patient's sexual partner, if
17known. If the advanced practice registered nurse is unable to obtain the name of the
18patient's sexual partner, the prescription order shall include, in ordinary, bold-faced
19capital letters, the words, “expedited partner therapy" or the letters “EPT."
SB70-AA1,384,23 20(3) The advanced practice registered nurse shall provide the patient with a
21copy of the information sheet prepared by the department of health services under
22s. 46.03 (44) and shall request that the patient give the information sheet to the
23person with whom the patient had sexual contact.
SB70-AA1,385,3 24(4) (a) Except as provided in par. (b), an advanced practice registered nurse is
25immune from civil liability for injury to or the death of a person who takes any

1antimicrobial drug if the antimicrobial drug is prescribed, dispensed, or furnished
2under this section and if expedited partner therapy is provided as specified under
3this section.
