SB70-AA1,376,2422 a. The person is granted an advanced practice registered nurse license under
23subd. 1. a. and satisfies only par. (a) 2. b. but not par. (a) 2. a., or the person is granted
24an advanced practice registered nurse license under subd. 1. c.
SB70-AA1,377,2
1b. On January 1, 2023, the person did not hold a certificate under s. 441.16 (2),
22021 stats.
SB70-AA1,377,163 (c) On or before the applicable renewal date determined by the department
4under s. 440.08 (2), an advanced practice registered nurse shall submit to the board
5on a form furnished by the board a statement giving his or her name and residence,
6the nursing workforce survey and fee required under s. 441.01 (7), evidence of having
7satisfied the continuing education requirements under sub. (4), evidence of any
8malpractice liability insurance coverage required under sub. (5), any plan required
9under sub. (3m) (i), current evidence that the person satisfies each of the
10requirements under par. (a) 1., 2., 5. a., and 7. that apply with respect to the person,
11and any other information that the board requires by rule, with the applicable
12renewal fee determined by the department under s. 440.03 (9) (a). The board shall
13grant to a person who satisfies the requirements under this paragraph the renewal
14of his or her advanced practice registered nurse license and specialty designations
15granted under par. (b) 1. and shall, if the person holds a license under s. 441.06 (1),
16(1c), or (1m), also grant the renewal of that license.
SB70-AA1,377,20 17(2) Prescribing authority. (a) Except as provided in par. (b), an advanced
18practice registered nurse may issue prescription orders, subject to the rules
19promulgated under sub. (6) (a) 1. and 4., and may provide expedited partner therapy
20in the manner described in s. 441.092.
SB70-AA1,377,2421 (b) An advanced practice registered nurse may not issue prescription orders if
22a notation under sub. (1) (b) 4. indicating that the advanced practice registered nurse
23may not issue prescription orders appears on the advanced practice registered
24nurse's license.

1(3) License required; use of titles. (a) 1. The holder of a license issued under
2this section is an “advanced practice registered nurse," may append to his or her
3name the title “A.P.R.N.," and is authorized to practice advanced practice registered
4nursing.
SB70-AA1,378,75 2. Notwithstanding s. 448.03 (3m), the holder of a specialty designation for a
6recognized role granted under sub. (1) (b) 1. may append to his or her name the title
7and an abbreviation described under par. (b) 2. corresponding to that recognized role.

SB70-AA1,379,7 4(3m) Practice requirements and limitations. (a) 1. An advanced practice
5registered nurse licensed under this section may, except as provided in subd. 2. and
6par. (b), practice advanced practice registered nursing only in collaboration with a
7physician or dentist.
SB70-AA1,379,98 2. Subdivision 1. does not apply to an advanced practice registered nurse with
9a certified nurse-midwife specialty designation.
SB70-AA1,379,1510 (b) An advanced practice registered nurse to whom par. (a) 1. applies may,
11except as provided in pars. (d) 1. and (f), practice advanced practice registered
12nursing in a recognized role without being supervised by or collaborating with, and
13independent of, a physician or dentist if the board verifies, upon application of the
14advanced practice registered nurse, that the advanced practice registered nurse
15satisfies all of the following:
SB70-AA1,379,2216 1. The advanced practice registered nurse has, except as provided in subd. 3.,
17completed 3,840 hours of professional nursing in a clinical setting. Clinical hours
18completed as a requirement of a nursing program offered by a qualifying school of
19nursing described under s. 441.06 (1) (c) may be used to satisfy the requirement
20under this subdivision. Hours completed to satisfy a requirement of an education
21program described in sub. (1) (a) 2. a. may not be used to satisfy the requirement
22under this subdivision.
SB70-AA1,379,2523 2. At least 24 months have elapsed since the advanced practice registered nurse
24first began completing the clinical hours required by a nursing program described
25under subd. 1.
SB70-AA1,380,9
13. The advanced practice registered nurse has completed 3,840 clinical hours
2of advanced practice registered nursing practice in that recognized role while
3working with a physician or dentist who was immediately available for consultation
4and accepted responsibility for the actions of the advanced practice registered nurse
5during those 3,840 hours of practice. The advanced practice registered nurse may
6substitute additional hours of advanced practice registered nursing working with a
7physician or dentist described in this subdivision to count toward the requirement
8under subd. 1. Each such additional hour shall count toward one hour of the
9requirement under subd. 1.
SB70-AA1,380,1210 4. At least 24 months have elapsed since the advanced practice registered nurse
11first began practicing advanced practice registered nursing in that recognized role
12as described in subd. 3.
SB70-AA1,380,1613 (c) For purposes of par. (b) 3., hours of advanced practice registered nursing
14practice may include the lawful practice of advanced practice registered nursing
15outside this state or the lawful practice of advanced practice registered nursing in
16this state prior to the effective date of this paragraph .... [LRB inserts date].
SB70-AA1,380,2217 (d) 1. An advanced practice registered nurse may provide pain management
18services only while working in a collaborative relationship with a physician who,
19through education, training, and experience, specializes in pain management.
20Except as provided in subd. 2., this subdivision applies regardless of whether the
21advanced practice registered nurse has qualified for independent practice under par.
22(b).
SB70-AA1,381,223 2. Except as provided in par. (f), subd. 1. does not apply to an advanced practice
24registered nurse who is providing pain management services in a hospital, as defined

1in s. 50.33 (2), or a clinic associated with a hospital, and who has qualified for
2independent practice under par. (b).
SB70-AA1,381,83 (e) For purposes of pars. (a) 1. and (d) 1., a collaborative relationship is a process
4in which an advanced practice registered nurse is working with a physician or
5dentist, in each other's presence when necessary, to deliver health care services
6within the scope of the advanced practice registered nurse's training, education, and
7experience. The advanced practice registered nurse shall document such a
8collaborative relationship.
SB70-AA1,381,129 (f) Nothing in this section prohibits an entity employing or with a relationship
10with an advanced practice registered nurse from establishing additional
11requirements for an advanced practice registered nurse as a condition of
12employment or relationship.
SB70-AA1,381,1813 (g) An advanced practice registered nurse shall adhere to professional
14standards when managing situations that are beyond the advanced practice
15registered nurse's expertise. If a particular patient's needs are beyond the advanced
16practice registered nurse's expertise, the advanced practice registered nurse shall,
17as warranted by the patient's needs, consult or collaborate with or refer the patient
18to at least one of the following:
SB70-AA1,381,1919 1. A physician licensed under ch. 448.
SB70-AA1,381,2220 2. Another health care provider for whom the advanced practice registered
21nurse has reasonable evidence of having a scope of practice that includes the
22authorization to address the patient's needs.
SB70-AA1,382,423 (h) An advanced practice registered nurse licensed under this section may
24delegate a task or order to another clinically trained health care worker if the task
25or order is within the scope of the advanced practice registered nurse's practice, the

1advanced practice registered nurse is competent to perform the task or issue the
2order, and the advanced practice registered nurse has reasonable evidence that the
3health care worker is minimally competent to perform the task or issue the order
4under the circumstances.
SB70-AA1,382,145 (i) An advanced practice registered nurse with a certified nurse-midwife
6specialty designation may not offer to deliver babies outside of a hospital setting
7unless the advanced practice registered nurse files with the board, and the board
8approves, a proactive plan for ensuring appropriate care or care transitions
9conforming with professional standards for patients with higher acuity or emergency
10care needs that exceed the advanced practice registered nurse's scope of practice. An
11advanced practice registered nurse who offers to deliver babies outside of a hospital
12setting shall file a plan under this paragraph when applying for an initial license
13under this section or a renewal of a license under this section, shall keep the plan
14current with the board, and shall follow the plan.
SB70-AA1,382,19 15(4) Continuing education. Every advanced practice registered nurse shall
16submit to the board evidence of having completed at least 16 contact hours per
17biennium in clinical pharmacology or therapeutics relevant to the advanced practice
18registered nurse's area of practice. The board may promulgate rules regarding the
19continuing education requirements under this subsection.
SB70-AA1,383,2 20(5) Malpractice liability insurance. No person may practice advanced
21practice registered nursing unless he or she at all times has in effect malpractice
22liability insurance coverage in the minimum amounts specified under s. 655.23 (4).
23An advanced practice registered nurse shall submit evidence of that coverage to the
24board when applying for an initial license under this section or a renewal of a license

1under this section. An advanced practice registered nurse shall also submit such
2evidence to the board upon request of the board.
SB70-AA1,383,4 3(6) Rules. (a) The board shall promulgate rules necessary to administer this
4section, including rules for all of the following:
SB70-AA1,383,95 1. Further defining the scope of practice of an advanced practice registered
6nurse, practice of a certified nurse-midwife, practice of a certified registered nurse
7anesthetist, practice of a nurse practitioner, and practice of a clinical nurse specialist
8and defining the scope of practice within which an advanced practice registered
9nurse may issue prescription orders under sub. (2).
SB70-AA1,383,1110 2. Determining acceptable national certification for purposes of sub. (1) (a) 2.
11a.
SB70-AA1,383,1512 3. Establishing the appropriate education, training, or experience
13requirements that a registered nurse must satisfy in order to be an advanced practice
14registered nurse and to obtain each specialty designation corresponding to the
15recognized roles.
SB70-AA1,383,1716 4. Specifying the classes of drugs, individual drugs, or devices that may not be
17prescribed by an advanced practice registered nurse under sub. (2).
SB70-AA1,383,1818 5. Specifying the conditions to be met for registered nurses to do the following:
SB70-AA1,383,1919 a. Administer a drug prescribed by an advanced practice registered nurse.
SB70-AA1,383,2020 b. Administer a drug at the direction of an advanced practice registered nurse.
SB70-AA1,383,2221 7. Establishing standards of professional conduct for advanced practice
22registered nurses generally and for practicing in each recognized role.
SB70-AA1,383,2423 (am) Notwithstanding par. (a), the board may promulgate rules to implement
24sub. (3m) (b).
SB70-AA1,384,3
1(b) The board may not promulgate rules that expand the scope of practice of an
2advanced practice registered nurse beyond the practices within advanced practice
3registered nursing.
SB70-AA1,827 4Section 827. 441.092 of the statutes is created to read:
SB70-AA1,384,5 5441.092 Expedited partner therapy. (1) In this section:
SB70-AA1,384,66 (b) “Antimicrobial drug" has the meaning given in s. 448.035 (1) (b).
SB70-AA1,384,77 (c) “Expedited partner therapy" has the meaning given in s. 448.035 (1) (c).
SB70-AA1,384,19 8(2) Notwithstanding the requirements of s. 448.9785, an advanced practice
9registered nurse who may issue prescription orders under s. 441.09 (2) may provide
10expedited partner therapy if a patient is diagnosed as infected with a chlamydial
11infection, gonorrhea, or trichomoniasis and the patient has had sexual contact with
12a sexual partner during which the chlamydial infection, gonorrhea, or
13trichomoniasis may have been transmitted to or from the sexual partner. The
14advanced practice registered nurse shall attempt to obtain the name of the patient's
15sexual partner. A prescription order for an antimicrobial drug prepared under this
16subsection shall include the name and address of the patient's sexual partner, if
17known. If the advanced practice registered nurse is unable to obtain the name of the
18patient's sexual partner, the prescription order shall include, in ordinary, bold-faced
19capital letters, the words, “expedited partner therapy" or the letters “EPT."
SB70-AA1,384,23 20(3) The advanced practice registered nurse shall provide the patient with a
21copy of the information sheet prepared by the department of health services under
22s. 46.03 (44) and shall request that the patient give the information sheet to the
23person with whom the patient had sexual contact.
SB70-AA1,385,3 24(4) (a) Except as provided in par. (b), an advanced practice registered nurse is
25immune from civil liability for injury to or the death of a person who takes any

1antimicrobial drug if the antimicrobial drug is prescribed, dispensed, or furnished
2under this section and if expedited partner therapy is provided as specified under
3this section.
SB70-AA1,385,74 (b) The immunity under par. (a) does not extend to the donation, distribution,
5furnishing, or dispensing of an antimicrobial drug by an advanced practice
6registered nurse whose act or omission involves reckless, wanton, or intentional
7misconduct.
SB70-AA1,828 8Section 828. 441.10 (6) of the statutes is amended to read:
SB70-AA1,385,179 441.10 (6) On or before the applicable renewal date specified determined by the
10department
under s. 440.08 (2) (a), a licensed practical nurse practicing for
11compensation shall submit to the board, on forms furnished by the department, an
12application for license renewal, together with a statement giving name, residence,
13nature and extent of practice as a licensed practical nurse during the prior year and
14prior unreported years, the nursing workforce survey and fee required under s.
15441.01 (7),
and other facts bearing upon current competency that the board requires,
16accompanied by the applicable license renewal fee determined by the department
17under s. 440.03 (9) (a).
SB70-AA1,829 18Section 829. 441.10 (7) of the statutes is amended to read:
SB70-AA1,386,619 441.10 (7) No license is required for practical nursing, but, except as provided
20in s. 257.03, no person without a license may hold himself or herself out as a licensed
21practical nurse or licensed attendant, use the title or letters “Trained Practical
22Nurse" or “T.P.N.", “Licensed Practical Nurse" or “L.P.N.", “ Licensed Attendant" or
23“L.A.", “Trained Attendant" or “T.A.", or otherwise seek to indicate that he or she is
24a licensed practical nurse or licensed attendant. No licensed practical nurse or
25licensed attendant may use the title, or otherwise seek to act as a registered, licensed,

1graduate or professional nurse. Anyone violating this subsection shall be subject to
2the penalties prescribed by s. 441.13. The board shall grant without examination a
3license as a licensed practical nurse to any person who was on July 1, 1949, a licensed
4attendant.
This subsection does not apply to any licensed practical nurse who holds
5a multistate license, as defined in s. 441.51 (2) (h), issued by a jurisdiction, other than
6this state, that has adopted the nurse licensure compact under s. 441.51.
SB70-AA1,830 7Section 830. 441.11 (title) of the statutes is repealed.
SB70-AA1,831 8Section 831. 441.11 (1) of the statutes is repealed.
SB70-AA1,832 9Section 832. 441.11 (2) of the statutes is renumbered 441.09 (5m) and
10amended to read:
SB70-AA1,386,1611 441.09 (5m) Licensure exemption. The provisions of s. 448.04 (1) (g) 448.03

SB70-AA1,833 17Section 833. 441.11 (3) of the statutes is repealed.
SB70-AA1,834 18Section 834 . 441.15 of the statutes, as affected by 2023 Wisconsin Act .... (this
19act), is repealed.
SB70-AA1,164e 20Section 164e. 441.15 (3) (b) of the statutes is amended to read:
SB70-AA1,387,821 441.15 (3) (b) On or before the applicable renewal date specified determined
22by the department
under s. 440.08 (2) (a), a person issued a license under par. (a) and
23practicing nurse-midwifery shall submit to the board on furnished forms a
24statement giving his or her name, residence, and other information that the board
25requires by rule, with the applicable renewal fee determined by the department

1under s. 440.03 (9) (a). If applicable, the person shall also submit evidence
2satisfactory to the board that he or she has in effect the malpractice liability
3insurance required under the rules promulgated under sub. (5) (bm). The board shall
4grant to a person who pays the fee determined by the department under s. 440.03 (9)
5(a) for renewal of a license to practice nurse-midwifery and who satisfies the
6requirements of this paragraph the renewal of his or her license to practice
7nurse-midwifery and the renewal of his or her license to practice as a registered
8nurse.
SB70-AA1,835 9Section 835. 441.16 of the statutes is repealed.
SB70-AA1,836 10Section 836. 441.18 (2) (a) (intro.) of the statutes is amended to read:
SB70-AA1,387,1211 441.18 (2) (a) (intro.) An advanced practice registered nurse certified to who

issue prescription orders under s. 441.16 441.09 (2) may do any of the following:
SB70-AA1,837 13Section 837. 441.18 (2) (b) of the statutes is amended to read:
SB70-AA1,387,2014 441.18 (2) (b) An advanced practice registered nurse who prescribes or delivers
15an opioid antagonist under par. (a) 1. shall ensure that the person to whom the opioid
16antagonist is prescribed has or has the capacity to provide the knowledge and
17training necessary to safely administer the opioid antagonist to an individual
18undergoing an opioid-related overdose and that the person demonstrates the
19capacity to ensure that any individual to whom the person further delivers the opioid
20antagonist has or receives that knowledge and training.
SB70-AA1,838 21Section 838. 441.18 (3) of the statutes is amended to read:
SB70-AA1,388,222 441.18 (3) An advanced practice registered nurse who, acting in good faith,
23prescribes or delivers an opioid antagonist in accordance with sub. (2), or who, acting
24in good faith, otherwise lawfully prescribes or dispenses an opioid antagonist, shall
25be immune from criminal or civil liability and may not be subject to professional

1discipline under s. 441.07 for any outcomes resulting from prescribing, delivering,
2or dispensing the opioid antagonist.
SB70-AA1,839 3Section 839. 441.19 of the statutes is repealed.
SB70-AA1,840 4Section 840. 442.083 (1) of the statutes is amended to read:
SB70-AA1,388,115 442.083 (1) The renewal dates for licenses issued under this chapter are
6specified
shall be as determined by the department under s. 440.08 (2) (a), and the
7renewal fees for such licenses are determined by the department under s. 440.03 (9)
8(a). The department may not renew a license issued to a firm unless, at the time of
9renewal, the firm satisfies the requirements under s. 442.08 (2) and demonstrates,
10to the satisfaction of the department, that the firm has complied with the
11requirements under s. 442.087.
SB70-AA1,841 12Section 841. 442.083 (2) (a) of the statutes is amended to read:
SB70-AA1,388,1813 442.083 (2) (a) The examining board shall promulgate rules establishing
14continuing education requirements for renewal of licenses granted to individuals
15licensed under this chapter. The rules promulgated under this paragraph may not
16require an individual to complete more than 80 continuing education credits during
17the
per 2-year period immediately preceding the renewal date specified under s.
18440.08 (2) (a)

SB70-AA1,842 19Section 842. 443.015 (1e) of the statutes is amended to read:
SB70-AA1,388,2520 443.015 (1e) The rules promulgated under sub. (1) by the registered interior
21designer section of the examining board shall require a Wisconsin registered interior
22designer to complete at least 15 hours of continuing education during the per 2-year
23period immediately preceding the renewal date specified under s. 440.08 (2) (a). At
24least 10 of the 15 hours shall be in subjects related to the practice of interior design
25that safeguard the public's health, safety, and welfare.

1Section 843. 443.07 (6) of the statutes is amended to read:

SB70-AA1,845 10Section 845. 443.10 (2) (e) of the statutes is amended to read:
SB70-AA1,389,1511 443.10 (2) (e) The renewal date dates for certificates of registration for
12architects, landscape architects, professional engineers, and Wisconsin registered
13interior designers is specified shall be as determined by the department under s.
14440.08 (2) (a), and the fee for renewal of such certificates is determined by the
15department under s. 440.03 (9) (a).
SB70-AA1,846 16Section 846. 443.10 (5) of the statutes is amended to read:
SB70-AA1,389,2117 443.10 (5) Fees; renewals. The professional land surveyor section shall grant
18a license to engage in the practice of professional land surveying to any applicant who
19has met the applicable requirements of this chapter. The renewal date for the license
20is specified shall be as determined by the department under s. 440.08 (2) (a), and the
21renewal fee for the license is determined by the department under s. 440.03 (9) (a).
SB70-AA1,847 22Section 847. 445.06 (1) of the statutes is amended to read:
