NR 506.01NR 506.01Purpose. The purpose of this chapter is to help ensure that efficient, nuisance-free and environmentally acceptable solid waste management procedures are practiced in Wisconsin and to outline the requirements regarding operational criteria for solid waste landfills and surface impoundments. This chapter is adopted under ch. 289, Stats., and s. 227.11, Stats.

NR 506.02NR 506.02Applicability.
NR 506.02(1)(a)(a) Except as provided in par. (b) and except as otherwise provided, this chapter governs all solid waste disposal facilities as defined under s. 289.01 (35), Stats., including all CCR landfills and expansions.
NR 506.02(1)(b)(b) This chapter does not govern any of the following:
NR 506.02(1)(b)1.1. Hazardous waste facilities as defined under s. 291.01 (8), Stats., and regulated under chs. NR 660 to 679.
NR 506.02(1)(b)2.2. Metallic mining operations for nonferrous minerals as defined under s. 293.01 (9), Stats., and regulated under ch. NR 182.
NR 506.02(1)(b)3.3. Metallic mining operations for ferrous minerals as defined under s. 295.41 (26), Stats., including mining wastes and mining waste sites as defined under s. 295.41 (30) and (31), Stats., and regulated under subch. III of ch. 295, Stats.
NR 506.02(2)(2)This chapter does not apply to the design, construction or operation of industrial wastewater facilities, sewerage systems and waterworks treating liquid wastes approved under s. 281.41, Stats., or permitted under ch. 283, Stats., nor to facilities used solely for the disposal of liquid municipal or industrial wastewater facilities, sewerage systems and waterworks treating liquid wastes approved under s. 281.41, Stats., or permitted under ch. 283, Stats., except for facilities used for the disposal of solid waste.

NR 506.03NR 506.03Definitions. The terms in this chapter are defined in s. NR 500.03.

NR 506.04NR 506.04Open burning. The department may approve burning of brush, grubbed material and other similar material in accordance with air management, solid waste management and all other applicable regulations.

NR 506.05NR 506.05Daily cover requirements.
NR 506.05(1)(1)Municipal solid waste. All solid waste disposed in a municipal solid waste landfill shall be compacted and completely covered at the end of each operating day with a compacted layer of at least 6 inches of soil. Alternate daily cover materials may be approved or mandated by the department as required in s. NR 506.055. If clay soil is used for daily cover purposes, it shall be scarified or removed prior to placement of the next lift of solid waste.
NR 506.05(2)(2)Industrial and commercial waste. Unless otherwise specified by the department, high volume industrial waste is not subject to daily cover requirements, unless disposed of in a municipal solid waste landfill. All other industrial waste and commercial waste shall be compacted and completely covered at the end of each operating day with a compacted layer of at least 6 inches of soil or other material approved in writing by the department. The department may grant an exemption in writing for less frequent covering. In granting such exemptions, the department shall consider the characteristics of the solid waste, the leaching potential of the solid waste and the potential for nuisance conditions if other than daily covering is utilized.

NR 506.055NR 506.055Alternate daily cover.
NR 506.055(1)(1)Facilities seeking approval. An owner or operator of a solid waste landfill seeking approval from the department to use an alternate daily cover material shall submit the following information:
NR 506.055(1)(a)(a) Type of material to be used, including its chemical and physical properties as required in s. NR 506.09. A discussion of the material’s successful use at other solid waste landfills in controlling vectors, windblown material and odors may be required.
NR 506.055(1)(b)(b) Method and rate of application.
NR 506.055(1)(c)(c) Conditions when alternate daily cover cannot be used, including but not limited to weather conditions, equipment breakdown, ability to obtain a sufficient quantity of alternate daily cover, maximum time alternate daily cover can be exposed, and a discussion of back-up cover materials for use when alternate cover cannot be used.
NR 506.055(1)(d)(d) Discussion of how the alternate cover material will be stored on-site prior to its use, including measures to be taken to prevent transportation of contaminants to groundwater and surface water, and prevention of windblown nuisances.
