Ch. NR 422 NoteNote: Corrections made under s. 13.93 (2m) (b) 7., Stats., Register, December, 1996, No. 492.
NR 422.01NR 422.01Applicability; purpose.
NR 422.01(1)(1)Applicability. This chapter applies to all surface coating and printing process air contaminant sources and to their owners and operators. This chapter also applies to the handling and use of cutback asphalts for application to surfaces traversed by motor vehicles, bicycles or pedestrians and to all persons responsible for such handling and use.
NR 422.01(2)(2)Purpose. This chapter is adopted under ss. 285.11, 285.13 and 285.17, Stats., to categorize organic compound emissions from surface coating, printing and asphalt surfacing operations into separate organic compound air contaminant source categories and to establish emission limitations or other requirements for these categories of sources in order to protect air quality.
NR 422.01(3)(3)For a source located in an area that was ever designated nonattainment for ozone that had VOC emissions exceeding the applicability emission thresholds and became subject to the requirements of this chapter, the requirements of this chapter remain applicable notwithstanding any subsequent decrease in VOC emissions to a level below the applicability emission thresholds.
NR 422.01(4)(4)The department may exempt a source from the requirements of this chapter if the source has an approved federally enforceable permit or state implementation plan revision that permanently restricts maximum theoretical emissions to below the applicability emission thresholds listed under this chapter and meets all applicable federal VOC RACT exemption requirements.
NR 422.01 NoteNote: “Maximum theoretical emissions” referred to in this chapter is defined under s. NR 419.02 (11).
NR 422.01 HistoryHistory: Cr. Register, September, 1986, No. 369, eff. 10-1-86; am. Register, February, 1990, No. 410, eff. 3-1-90; CR 20-088: cr. (3), (4) Register May 2022 No. 797, eff. 6-1-22.
NR 422.02NR 422.02Definitions. Except when another definition is specifically made applicable, the definitions contained in chs. NR 400, 419, and 421 apply to the terms used in this chapter. In addition, except when another definition is specifically made applicable, in this chapter:
NR 422.02(1d)(1d)“Acrylonitrile-butadiene-styrene welding” or “ABS welding” means any process to weld acrylonitrile-butadiene-styrene pipe.
NR 422.02(1h)(1h)“Adhesion primer” means a coating that is applied to a polyolefin part to promote the adhesion of a subsequent coating and that is clearly identified as an adhesion primer or adhesion promoter on its accompanying material safety data sheet.
NR 422.02(1m)(1m)“Adhesion promoter” means a coating designed to facilitate the bonding of a primer or topcoat on surfaces such as trim moldings, door locks and door sills, where sanding is impractical, and on plastic parts and the edges of sanded areas.
NR 422.02(2)(2)“Adhesive” means any substance that is used to bond one surface to another surface by attachment.
NR 422.02(3)(3)“Adhesive primer” means a coating that is applied directly to a substrate in order to seal the substrate and to provide a bonding surface for an adhesive prior to the application of the adhesive.
NR 422.02(3g)(3g)“Aerosol adhesive” means an adhesive or adhesive primer packaged as an aerosol product in which the spray mechanism is permanently housed in a non-refillable can designed for handheld application without the need for ancillary hoses or spray equipment.
NR 422.02(3r)(3r)“Air assisted airless spray” means a spray coating method that combines compressed air with hydraulic pressure to atomize the coating material into finer droplets than is achieved with pure airless spray. Lower hydraulic pressure is used than with airless spray.
NR 422.02(4)(4)“Air dried coating” means coatings which are dried by the use of air or forced warm air. Forced warm air includes processes whereby the coated object is heated above ambient temperature up to a maximum of 90°C (194°F) to decrease drying time.
NR 422.02(4g)(4g)“Airless spray” means a spray coating method in which the coating is atomized by forcing it through a small opening at high pressure and in which the coating liquid is not mixed with air before exiting from the nozzle.
NR 422.02(4r)(4r)“Antifoulant coating” means any coating applied to the underwater portion of a pleasure craft to prevent or reduce the attachment of biological organisms and that is registered with EPA as a pesticide under the Federal Insecticide, Fungicide, and Rodenticide Act.
NR 422.02(5)(5)“Anti-glare safety coating” means a low gloss coating formulated to eliminate glare for safety purposes on interior surfaces of a vehicle, as specified under the U.S. department of transportation standard for reflecting surfaces in 49 CFR 571.107, as in effect on October 1, 1994.
