29.024(5)(b)(b) Forms. The department shall prepare, procure the printing of, and supply all necessary forms for applications and approvals issued under this chapter and related applications for approvals.
29.024(5)(e)(e) Identification numbers. The department may issue customer identification numbers as part of its statewide automated system for issuing approvals.
29.024(5)(f)(f) Anatomical gift. The form for an application for a hunting, fishing, or trapping license shall include all of the following:
29.024(5)(f)1.1. A question as to whether the applicant wishes to include his or her name as a donor of an anatomical gift in the record of potential donors maintained by the department of transportation and, if so, a space where the applicant must provide his or her middle initial.
29.024(5)(f)2.2. A statement that an affirmative response to the question under subd. 1. authorizes an anatomical gift under s. 157.06, but that an applicant may also comply with sub. (12).
29.024(5)(f)3.3. A method by which the applicant may elect to receive a donor card that is separate from any license.
29.024(5)(f)4.4. A statement that the applicant is not required to respond to the question under subd. 1. in order to obtain a license.
29.024(5)(f)5.5. A statement that the purpose of maintaining the record of potential donors is to facilitate the determination of whether a person is a potential donor in the event of his or her death.
29.024(5)(f)6.6. A statement that the applicant must be a resident who is at least 15 years of age or an emancipated minor to include his or her name as a donor of an anatomical gift in the record of potential donors maintained by the department of transportation.
29.024(6)(6)Issuance of approvals by department and by agents.
29.024(6)(a)(a) In issuing approvals under this section, the department may do any of the following for each type of approval:
29.024(6)(a)1.1. Directly issue the approvals.
29.024(6)(a)2.2. Appoint, as an agent of the department, the clerk of one or more counties to issue the approvals.
29.024(6)(a)3.3. Appoint persons who are not employees of the department to issue the approvals as agents of the department.
29.024(6)(a)4.4. Contract with persons who are not employees of the department to operate a statewide automated system for issuing approvals.
29.024(6)(ag)(ag) Under a contract issued under par. (a) 4., the department may deduct a portion of each fee collected for a license issued pursuant to the statewide automated system and a portion of each reprint fee or issuing fee collected for a reprint issued pursuant to the statewide automated system. The department shall credit all of the amounts deducted to the appropriation account under s. 20.370 (9) (hv).
29.024(6)(b)(b) The clerk of each county appointed under par. (a) 2. may accept the appointment.
29.024(6)(c)1.1. The department shall promulgate rules for each type of approval under this chapter that specify which persons under par. (a) shall issue that type of approval except as provided under subd. 2.
29.024(6)(c)2.2. Persons appointed under par. (a) 2. and 3., as well as the department, shall issue temporary disabled person fishing licenses under s. 29.193 (3m).
29.024(6)(d)(d) The department may promulgate rules regulating the activities of persons appointed under par. (a) 2., 3., and 4.
29.024(7)(7)Duplicates. If any license, permit, certificate, or card is lost, the person to whom the license, permit, certificate, or card was issued may apply to the department for a duplicate by submitting an affidavit proving loss. The department may accept information in a form other than an affidavit. The department shall make an inquiry and investigation as it considers necessary. If the department is satisfied that the loss has been proven, the department may issue a duplicate license, permit, certificate, or card to the applicant. Tags issued with a license, permit, certificate, or card are parts of the license, permit, certificate, or card and loss of any part is considered to be loss of the entire license, permit, certificate, or card. Upon applying for a duplicate license, permit, certificate, or card, the original is no longer valid and the applicant shall surrender all parts of the original remaining in his or her possession to the department. No person may possess any original license, permit, certificate, or card for which a duplicate has been issued. No duplicate stamp may be issued and, if a stamp is lost, the person to whom it was issued is required to apply for and pay the regular fee in order to receive a new stamp.
29.024(8)(8)Record of approvals issued. The department shall keep a complete record of all approvals issued.
29.024(9)(9)Tags. The department shall provide all tags required under this chapter and shall specify their form and numbering.
29.024(10)(10)Stamps; artwork. The department may design and produce waterfowl hunting stamps, pheasant hunting stamps, wild turkey hunting stamps, inland waters trout stamps and Great Lakes trout and salmon stamps. The department may select artwork for stamps through a contest or otherwise may acquire original artwork for stamps.
29.024(11)(11)Automatic reissuance of approvals. The department may develop a system under which, when a person purchases an approval, the person may opt to automatically purchase the same approval for subsequent years. The department may contract with a 3rd party to store customer information in order to carry out this system.
29.024(12)(12)Donor information.
29.024(12)(a)(a) Department to transmit information. If a resident applicant answers the question regarding anatomical gifts in an application under sub. (5) (f) 1. in the affirmative, the department shall transmit to the department of transportation that authorization along with any other information about the applicant that the department of health services determines to be necessary under s. 157.06 (20).
29.024(12)(b)(b) Record of gift.
29.024(12)(b)1.1. If an applicant has indicated in an application under sub. (5) (f) that he or she wishes to include his or her name as a donor of an anatomical gift, the department shall include on the applicant’s hunting, fishing, or trapping license, so that it is clearly visible if printed, a space for the applicant to indicate that he or she wishes to be a donor of an anatomical gift. The anatomical gift described on the printed license shall be signed by the applicant. This printed and signed document shall serve as a record of gift under s. 157.06 (2) (t).
29.024(12)(b)2.2. A part of the reverse side of each conservation card under s. 23.47 (2) shall be printed to serve as a record of gift under s. 157.06 (2) (t), with space for the card holder to indicate that he or she wishes to be a donor of an anatomical gift. The anatomical gift described on the conservation card shall be signed by the holder of the conservation card.
29.024(12)(b)3.3. The department shall produce a separate, pocket-sized donor card to be issued to each applicant who requests one under sub. (5) (f) 3. The document shall include a space for the applicant to fill in his or her name and indicate that he or she wishes to be a donor of an anatomical gift. The anatomical gift described on the donor card shall be signed by the applicant. This document shall serve as a record of gift under s. 157.06 (2) (t).
29.024(12)(b)4.4. Persons authorizing gifts of their body parts remain subject to s. 157.06.

29.0329.03Wildlife violator compact.
29.03(1)(1)Article I — Findings, declaration of policy, and purpose.
29.03(1)(a)(a) The participating states find all of the following:
29.03(1)(a)1.1. Wildlife resources are managed by the respective states for the benefit of all residents and visitors.
29.03(1)(a)2.2. The protection of wildlife resources of a state is materially affected by the degree of compliance with state laws, regulations, ordinances, resolutions, and administrative rules relating to the management of those resources.
29.03(1)(a)3.3. The preservation, protection, management, and restoration of wildlife resources contribute immeasurably to the aesthetic, recreational, and economic aspects of those natural resources.
29.03(1)(a)4.4. Wildlife resources are valuable without regard to political boundaries; therefore, every person should be required to comply with wildlife resource preservation, protection, management, and restoration laws, regulations, ordinances, resolutions, and administrative rules of the participating states as a condition precedent to the continuance or issuance of any approval to hunt, fish, trap, or possess wildlife.
29.03(1)(a)5.5. Violation of wildlife resource laws interferes with the management of wildlife resources and may endanger the safety of persons and property.
29.03(1)(a)6.6. The mobility of many violators necessitates the maintenance of channels of communication among the various states.
29.03(1)(a)7.7. Usually, if a person is cited for a wildlife violation in a state other than the person’s home state, one or more of the following occur:
29.03(1)(a)7.a.a. The violator is required to post collateral or a bond to secure appearance for a trial at a later date.
29.03(1)(a)7.b.b. The violator is taken into custody until the collateral or bond is posted.
29.03(1)(a)7.c.c. The violator is taken directly to court for an immediate appearance.
29.03(1)(a)8.8. The purpose of the enforcement practices described in subd. 7. is to ensure compliance with the terms of a wildlife citation by the violator who, if permitted to continue on his or her way after receiving the citation, could return to his or her home state and disregard the terms of the citation.
29.03(1)(a)9.9. Usually, a person receiving a wildlife citation in his or her home state is permitted to accept the citation from the officer at the scene of the violation and immediately continue on his or her way after agreeing or being instructed to comply with the terms of the citation.
29.03(1)(a)10.10. The enforcement practices described in subd. 7. may cause unnecessary inconvenience and hardship for the violator who is unable at the time to post collateral, furnish a bond, stand trial, or pay a penalty, and thus is compelled to remain in custody until some alternative arrangement is made.
29.03(1)(a)11.11. The enforcement practices described in subd. 7. consume an undue amount of law enforcement time.
29.03(1)(b)(b) It is the policy of the participating states to do all of the following:
29.03(1)(b)1.1. Promote compliance with the laws, regulations, ordinances, resolutions, and administrative rules relating to management of wildlife resources in their respective states.
29.03(1)(b)2.2. Recognize the suspension of wildlife license privileges of any person whose license privileges have been suspended by a participating state and treat the suspension as if it had occurred in the home state.
29.03(1)(b)3.3. Allow a violator, except as provided in sub. (3) (b), to accept a wildlife citation and, without delay, proceed on his or her way, whether or not a resident of the state in which the citation was issued, if the violator’s home state is party to this compact.
29.03(1)(b)4.4. Report to the appropriate participating state, as provided in the compact manual, any conviction recorded against a violator whose home state was not the issuing state.
29.03(1)(b)5.5. Allow the home state to recognize and treat a conviction recorded against a resident, which occurred in a participating state other than the home state, as though the conviction had occurred in the home state.
29.03(1)(b)6.6. Extend cooperation to its fullest extent among the participating states for enforcing compliance with the terms of a wildlife citation issued in one participating state to a resident of another participating state.
29.03(1)(b)7.7. Maximize effective use of law enforcement personnel and information.
29.03(1)(b)8.8. Assist court systems in the efficient disposition of wildlife violations.
29.03(1)(c)(c) The purpose of this compact is to do all of the following:
29.03(1)(c)1.1. Provide a means through which participating states may join in a reciprocal program to effectuate the policies enumerated in par. (b) in a uniform and orderly manner.
29.03(1)(c)2.2. Provide for the fair and impartial treatment of violators in all participating states in recognition of the violator’s right to due process and the sovereign status of a participating state.
29.03(2)(2)Article II — Definitions. As used in this compact, unless the context requires otherwise:
29.03(2)(a)(a) “Citation” means any summons, complaint, summons and complaint, ticket, penalty assessment or other official document that a wildlife officer or other peace officer issues to a person for a wildlife violation that contains an order requiring the person to respond.
29.03(2)(b)(b) “Collateral” means any cash or other security deposited to secure an appearance for trial in connection with a citation issued by a wildlife officer or other peace officer for a wildlife violation.
29.03(2)(c)(c) “Compliance” with respect to a citation means the act of answering a citation through an appearance in a court or tribunal or through the payment of fines, costs, and surcharges, if any.
29.03(2)(d)(d) “Conviction” means a conviction, including any court conviction, for any offense related to the preservation, protection, management, or restoration of wildlife that is prohibited by state law, regulation, ordinance, resolution, or administrative rule. “Conviction” shall also include the forfeiture of any bail, bond, or other security deposited to secure appearance by a person charged with having committed the offense, the payment of a penalty assessment or surcharge, a plea of no contest, and the imposition of a deferred or suspended sentence by a court.
29.03(2)(e)(e) “Court” means a court of law, including municipal court.
29.03(2)(f)(f) “Home state” means the state of primary residence of a violator.
29.03(2)(g)(g) “Issuing state” means the participating state that issues a wildlife citation to the violator.
29.03(2)(h)(h) “License” means any approval, license, permit, or other public document that conveys to a person the privilege of pursuing, possessing, or taking any wildlife regulated by law, regulation, ordinance, resolution, or administrative rule of a participating state.
29.03(2)(i)(i) “Licensing authority” means the department or division within each participating state that is authorized by law to issue or approve licenses or permits to hunt, fish, trap, or possess wildlife. In this state, the licensing authority is the department.
29.03(2)(j)(j) “Participating state” means any state that enacts legislation to become a member of this wildlife compact.
29.03(2)(k)(k) “Personal recognizance” means an agreement a person makes at the time of issuance of the wildlife citation that the person will comply with the terms of the citation.
29.03(2)(L)(L) “State” means any state, territory, or possession of the United States, and includes the District of Columbia, the Commonwealth of Puerto Rico, the Provinces of Canada, and all other countries.
29.03(2)(m)(m) “Suspension” means any revocation, denial, or withdrawal of any or all license privileges, including the privilege to apply for, purchase, or exercise the benefits conferred by any license.
29.03(2)(n)(n) “Terms of the citation” means those conditions and options expressly stated upon the citation.
29.03(2)(o)(o) “Violator” means a person who commits a wildlife violation.
29.03(2)(p)(p) “Wildlife” means all species of wild animals that are protected or otherwise regulated by law, regulation, ordinance, resolution, or administrative rule in a participating state. Species included in the definition of “wildlife” vary from state to state and determination of whether a species is “wildlife” for the purposes of this compact shall be based on the law of the participating state.
29.03(2)(q)(q) “Wildlife law” means any law, regulation, ordinance, resolution, or administrative rule developed and enacted for the management and use of wildlife resources.
29.03(2)(r)(r) “Wildlife officer” means any individual authorized by a participating state to issue a citation for a wildlife violation.
29.03(2)(s)(s) “Wildlife violation” means any cited violation of a law, regulation, ordinance, resolution, or administrative rule developed and enacted for the management and use of wildlife resources.
29.03(3)(3)Article III — Procedures for issuing state.
29.03(3)(a)(a) When issuing a citation for a wildlife violation, a wildlife officer shall issue a citation to any violator whose primary residence is in a participating state in the same manner as though the violator were a resident of the issuing state and shall not require the violator to post collateral to secure appearance, subject to par. (b), if the officer receives the recognizance of the violator that he or she will comply with the terms of the citation.
29.03(3)(b)(b) Personal recognizance is acceptable if both of the following apply:
29.03(3)(b)1.1. Personal recognizance is not prohibited by local law or the compact manual.
29.03(3)(b)2.2. The violator provides adequate proof of identification to the wildlife officer.
