SB45,2828 Section 2828. 450.08 (2) (a) of the statutes is amended to read:

SB45,1377,2 450.08 (2) (a) A pharmacist’s license may be renewed by complying with continuing education requirements under s. 450.085 and paying the applicable fee determined by the department under s. 440.03 (9) (a) on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a). Notwithstanding s. 440.08 (3) (a), if a pharmacist fails to obtain renewal by that date, the board may suspend the pharmacist’s license, and the board may require the pharmacist to pass an examination to the satisfaction of the board to restore that license.

SB45,2829 Section 2829. 450.08 (2) (b) of the statutes is amended to read:

SB45,1377,8 450.08 (2) (b) A pharmacy, pharmacy technician’s, manufacturer’s, distributor’s, or home medical oxygen provider’s license or registration may be renewed by paying the applicable fee determined by the department under s. 440.03 (9) (a) on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a).

SB45,2830 Section 2830. 450.085 (1) of the statutes is amended to read:

SB45,1377,21 450.085 (1) An applicant for renewal of a license under s. 450.08 (2) (a) shall submit proof that he or she has completed, within the 2-year period immediately preceding the date of his or her application, satisfied the applicable continuing education requirements established by the board under this subsection. The board shall require the completion of 30 hours of continuing education per 2-year period in courses conducted by a provider that is approved by the Accreditation Council for Pharmacy Education or in courses approved by the board. Courses specified in s. 450.035 (1r) and (2) are courses in continuing education for purposes of this subsection. This subsection does not apply to an applicant for renewal of a license that expires on the first renewal date after the date on which the board initially granted the license The board shall, for up to a 2-year period, exempt new licensees from the requirements under this subsection.

SB45,2831 Section 2831. 450.11 (1g) (b) of the statutes is amended to read:

SB45,1378,13 450.11 (1g) (b) A pharmacist may, upon the prescription order of a practitioner providing expedited partner therapy, as specified in s. 441.092, 448.035, or 448.9725, that complies with the requirements of sub. (1), dispense an antimicrobial drug as a course of therapy for treatment of chlamydial infections, gonorrhea, or trichomoniasis to the practitioner’s patient or a person with whom the patient has had sexual contact for use by the person with whom the patient has had sexual contact. The pharmacist shall provide a consultation in accordance with rules promulgated by the board for the dispensing of a prescription to the person to whom the antimicrobial drug is dispensed. A pharmacist providing a consultation under this paragraph shall ask whether the person for whom the antimicrobial drug has been prescribed is allergic to the antimicrobial drug and advise that the person for whom the antimicrobial drug has been prescribed must discontinue use of the antimicrobial drug if the person is allergic to or develops signs of an allergic reaction to the antimicrobial drug.

SB45,2832 Section 2832. 450.11 (1i) (a) 1. of the statutes is amended to read:

SB45,1379,3 450.11 (1i) (a) 1. A pharmacist may, upon and in accordance with the prescription order of an advanced practice registered nurse prescriber under s. 441.18 (2) (a) 1., of a physician under s. 448.037 (2) (a) 1., or of a physician assistant under s. 448.9727 (2) (a) 1. that complies with the requirements of sub. (1), deliver an opioid antagonist to a person specified in the prescription order and may, upon and in accordance with the standing order of an advanced practice registered nurse prescriber under s. 441.18 (2) (a) 2., of a physician under s. 448.037 (2) (a) 2., or of a physician assistant under s. 448.9727 (2) (a) 2. that complies with the requirements of sub. (1), deliver an opioid antagonist to an individual in accordance with the order. The pharmacist shall provide a consultation in accordance with rules promulgated by the board for the delivery of a prescription to the person to whom the opioid antagonist is delivered.

SB45,2833 Section 2833. 450.11 (1i) (b) 2. b. of the statutes is amended to read:

SB45,1379,7 450.11 (1i) (b) 2. b. An advanced practice registered nurse prescriber may only deliver or dispense an opioid antagonist in accordance with s. 441.18 (2) or in accordance with his or her other legal authority to dispense prescription drugs.

SB45,2834 Section 2834. 450.11 (7) (b) of the statutes is amended to read:

SB45,1379,12 450.11 (7) (b) Information communicated to a physician, physician assistant, or advanced practice registered nurse prescriber in an effort to procure unlawfully a prescription drug or the administration of a prescription drug is not a privileged communication.

SB45,2835 Section 2835. 450.11 (8) (e) of the statutes is amended to read:

SB45,1379,15 450.11 (8) (e) The board of nursing, insofar as this section applies to advanced practice nurse prescribers registered nurses.

SB45,2836 Section 2836. 450.13 (5) (b) of the statutes is amended to read:

SB45,1379,20 450.13 (5) (b) The patient’s advanced practice registered nurse prescriber, if the advanced practice registered nurse prescriber has entered into a written agreement to collaborate with a physician may issue prescription orders under s. 441.09 (2).

SB45,2837 Section 2837. 450.135 (7) (b) of the statutes is amended to read:

SB45,1380,2 450.135 (7) (b) The patient’s advanced practice registered nurse prescriber, if the advanced practice registered nurse prescriber has entered into a written agreement to collaborate with a physician may issue prescription orders under s. 441.09 (2).

SB45,2838 Section 2838. 451.04 (4) of the statutes is amended to read:

SB45,1380,8 451.04 (4) Expiration and renewal. Renewal applications shall be submitted to the department on a form provided by the department on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a) and shall include the applicable renewal fee determined by the department under s. 440.03 (9) (a).

SB45,2839 Section 2839. 452.10 (2) of the statutes is repealed.

SB45,2840 Section 2840. 452.12 (1) of the statutes is amended to read:

SB45,1380,13 452.12 (1) Expiration. A license granted by the board entitles the holder to act as a broker or salesperson, as the case may be, until the applicable renewal date specified under s. 440.08 (2) (a).

SB45,2841 Section 2841. 452.12 (5) (a) of the statutes is amended to read:

SB45,1380,21 452.12 (5) (a) Renewal applications for all licenses shall be submitted with the applicable renewal fee determined by the department under s. 440.03 (9) (a) on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a). The department shall pay $10 of each renewal fee received under this paragraph to the Board of Regents of the University of Wisconsin System for research and educational, public outreach, and grant activities under s. 36.25 (34).

SB45,2842 Section 2842. 452.132 (2) (c) of the statutes is amended to read:

SB45,1381,2 452.132 (2) (c) Before a licensee becomes associated with the firm and at the beginning of each biennial licensure period, ensure that the licensee holds a valid license.

SB45,2843 Section 2843. 452.14 (3) (n) of the statutes is amended to read:

SB45,1381,7 452.14 (3) (n) Treated any person unequally solely because of sex, race, color, handicap, national origin, ancestry, marital status, lawful source of income, status as a holder or nonholder of a license under s. 343.03 (3r), or status as a victim of domestic abuse, sexual assault, or stalking, as defined in s. 106.50 (1m) (u).

SB45,2844 Section 2844. 454.06 (8) of the statutes is amended to read:

SB45,1381,14 454.06 (8) Expiration and renewal. The renewal date for licenses issued under subs. (2) to (6) is specified shall be as determined by the department under s. 440.08 (2) (a), and the renewal fees for such licenses are determined by the department under s. 440.03 (9) (a). The examining board may not renew a license issued to a person under subs. (2) to (6) unless the person certifies to the examining board that the person has reviewed the current digest under s. 454.125.

SB45,2846 Section 2846. 454.23 (5) of the statutes is amended to read:

SB45,1382,2 454.23 (5) Expiration and renewal. The renewal date for a license granted under sub. (2) is specified shall be as determined by the department under s. 440.08 (2) (a), and the renewal fee for that license is determined by the department under s. 440.03 (9) (a). The department may not renew a license granted to a person under this section unless the person certifies to the department that the person has reviewed the current digest under s. 454.267.

SB45,1382,7 454.25 (9) The renewal date for a barbering establishment license is specified shall be as determined by the department under s. 440.08 (2) (a), and the renewal fee for a barbering establishment license is determined by the department under s. 440.03 (9) (a).

SB45,2848 Section 2848. 455.06 (1) (a) of the statutes is amended to read:

SB45,1382,12 455.06 (1) (a) Except as provided in par. (b), the renewal dates for licenses issued under this subchapter or under s. 455.04 (4), 2019 stats., are specified shall be as determined by the department under s. 440.08 (2) (a), and the renewal fee for such licenses is determined by the department under s. 440.03 (9) (a).

SB45,2849 Section 2849. 455.06 (1) (b) of the statutes is amended to read:

SB45,1382,21 455.06 (1) (b) A license issued under s. 455.04 (2) is valid for 2 years or until the individual obtains a license under s. 455.04 (1) and may not be renewed, except that the examining board may promulgate rules specifying circumstances in which the examining board, in cases of hardship, may allow an individual to renew a license issued under s. 455.04 (2). Notwithstanding sub. (2), an individual holding a license issued under s. 455.04 (2) is not required to complete continuing education the examining board shall, for up to a 2-year period, exempt new licensees from the requirements under sub. (2).

SB45,2850 Section 2850. 455.065 (7) of the statutes is amended to read:

SB45,1383,6 455.065 (7) Grant an exemption from the continuing education requirements under this section to a psychologist who certifies to the examining board that he or she has permanently retired from the practice of psychology. A psychologist who has been granted an exemption under this subsection may not return to active practice without submitting evidence satisfactory to the examining board of having completed the required continuing education credits within the 2-year period specified by the board prior to the return to the practice of psychology.

SB45,2853 Section 2853. 456.07 (2) of the statutes is amended to read:

SB45,1383,23 456.07 (2) The application for a new certificate of registration The renewal date for a license issued under this subchapter shall be as determined by the department under s. 440.08 (2). A renewal application shall include the applicable renewal fee determined by the department under s. 440.03 (9) (a), a report of any facts requested by the examining board on forms provided for such purpose, and evidence satisfactory to the examining board that during the biennial period immediately preceding application for registration the applicant has attended a continuing education program or course of study. During the time between initial licensure and commencement of a full 2-year licensure period, new licensees shall not be required to meet continuing education requirements. All registration fees are payable on or before the applicable renewal date specified under s. 440.08 (2) (a) The examining board shall, for up to a 2-year period, exempt new licensees from the continuing education requirements under this subsection.

SB45,2854 Section 2854. 456.07 (5) of the statutes is amended to read:

SB45,1384,9 456.07 (5) Only an individual who has qualified as a is licensed and registered as a nursing home administrator under this chapter and who holds a valid current registration certificate under this section for the current registration period may use the title “Nursing Home Administrator”, and the abbreviation “N.H.A.” after the person’s name. No other person may use or be designated by such title or such abbreviation or any other words, letters, sign, card or device tending to or intended to indicate that the person is a licensed and registered nursing home administrator.

SB45,2855 Section 2855. 457.20 (2) of the statutes is amended to read:

SB45,1384,14 457.20 (2) The renewal dates for certificates and licenses granted under this subchapter, other than training certificates and licenses or temporary certificates or licenses, are specified shall be as determined by the department under s. 440.08 (2) (a).

SB45,2856 Section 2856. 457.22 (2) of the statutes is amended to read:

SB45,1384,22 457.22 (2) The rules promulgated under sub. (1) may not require an individual to complete more than 30 hours of continuing education programs or courses of study in order to qualify for renewal per 2-year period. The appropriate section of the examining board may waive all or part of the requirements established in rules promulgated under this section if it determines that prolonged illness, disability, or other exceptional circumstances have prevented the individual from completing the requirements.

SB45,2857 Section 2857. 458.085 (3) of the statutes is amended to read:

SB45,1385,2 458.085 (3) Continuing education requirements for renewal of certificates issued individuals certified under this subchapter.

SB45,2858 Section 2858. 458.09 (3) of the statutes is amended to read:

SB45,1385,13 458.09 (3) The number of hours of attendance at and completion of continuing education programs or courses of study required under the rules promulgated under s. 458.085 (3) shall be reduced by one hour for each hour of attendance at and completion of, within the 2 years immediately preceding the date on which the renewal application is submitted current reporting period, continuing education programs or courses of study that the applicant has attended and completed in order to continue to qualify for employment as an assessor and that the department determines is substantially equivalent to attendance at and completion of continuing education programs or courses of study for certified general appraisers, certified residential appraisers or licensed appraisers, as appropriate.

SB45,2859 Section 2859. 458.11 of the statutes is amended to read:

SB45,1386,10 458.11 Expiration and renewal. Renewal applications shall be submitted to the department on a form provided by the department on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a) and shall include the applicable renewal fee determined by the department under s. 440.03 (9) (a). Renewal of an appraiser certificate automatically renews the individual’s appraiser license without payment of the renewal fee for the appraiser license or completion of any additional continuing education requirements that would otherwise be required for renewal of the appraiser license. Renewal applications shall be accompanied by proof of completion of the continuing education requirements in s. 458.13. Notwithstanding s. 458.06 (3) (b) 2. and (4) (b) 2., 1989 stats., and s. 458.08 (3) (b) 2. and (c) 2., 1991 stats., the department may not renew a certificate that was granted under s. 458.06 (3) or (4) before May 29, 1993, unless the holder of the certificate submits evidence satisfactory to the department that he or she has successfully completed the applicable educational requirements specified in rules promulgated under s. 458.085 (1) and the department may not renew a certificate that was granted under s. 458.08 (3) before May 29, 1993, unless the holder of the certificate submits evidence satisfactory to the department that he or she has successfully completed the applicable education and experience requirements specified in rules promulgated under s. 458.085 (1) and (2).

SB45,2860 Section 2860. 458.13 of the statutes is amended to read:

SB45,1386,16 458.13 Continuing education requirements. At the time of renewal of a certificate issued under this subchapter, each applicant shall submit proof that, within the 2 years immediately preceding the date on which the renewal application is submitted, he or she has satisfied the continuing education requirements specified in the rules promulgated under s. 458.085 (3).

SB45,1386,23 458.33 (5) Renewals. A licensed appraisal management company shall submit a renewal application, along with the applicable renewal fee determined by the department under s. 440.03 (9) (a), but not to exceed $2,000, to the department on a form prescribed by the department by the applicable renewal date specified determined by the department under s. 440.08 (2) (a). A renewal under this subsection is subject to sub. (4).

The rules shall require the completion of 20 hours per 2-year period in programs or courses of study approved under this subsection. The rules shall establish the criteria for approval of continuing education programs or courses of study required for renewal of a license under s. 459.09 and for approval of the sponsors and cosponsors of continuing education programs or courses of study. The examining board shall, for up to a 2-year period, exempt new licensees from the requirements under this section.

SB45,1389,8 460.10 (1) (a) Requirements and procedures for a license holder to complete continuing education programs or courses of study to qualify for renewal of his or her license. The rules promulgated under this paragraph may not require a license holder to complete more than 24 hours of continuing education programs or courses of study in order to qualify for renewal of his or her license per 2-year period.

SB45,2870 Section 2870. 462.04 of the statutes is amended to read:

SB45,1389,21 462.04 Prescription or order required. A person who holds a license or limited X-ray machine operator permit under this chapter may not use diagnostic X-ray equipment on humans for diagnostic purposes unless authorized to do so by prescription or order of a physician licensed under s. 448.04 (1) (a), a naturopathic doctor licensed under s. 466.04 (1), a dentist who is licensed under s. 447.04 (1) or who holds a compact privilege under subch. II of ch. 447, a dental therapist licensed under s. 447.04 (1m), a podiatrist licensed under s. 448.63, a chiropractor licensed under s. 446.02, an advanced practice registered nurse certified licensed under s. 441.16 (2) 441.09, a physician assistant who is licensed under s. 448.974 or who holds a compact privilege under subch. XIII of ch. 448, or, subject to s. 448.56 (7) (a), a physical therapist who is licensed under s. 448.53 or who holds a compact privilege under subch. XI of ch. 448.
