AB261,2,3250.33 (1a) Ambulatory surgical center has the meaning given in 42 CFR
3416.2.
AB261,24Section 2. 50.33 (4) of the statutes is created to read:
AB261,2,6550.33 (4) Surgical technology means surgical patient care, including all of
6the following:
AB261,2,87(a) Collaboration with a team of health care providers prior to a surgical
8procedure to carry out the plan of care by doing the following:
AB261,2,991. Preparing the operating room.
AB261,2,10102. Gathering and preparing sterile supplies, instruments, and equipment.
AB261,2,12113. Preparing and maintaining the sterile field using sterile and aseptic
12techniques and ensuring that surgical equipment is functioning properly and safely.
AB261,2,13134. Assisting with transferring patients and positioning patients.
AB261,2,1614(b) Intraoperative anticipation and response to the needs of a surgeon and
15other team members in the operating room by monitoring the sterile field and
16providing the required instruments or supplies in the sterile field.

1(c) Performance of tasks in the sterile field as directed in an operating room
2setting, including all of the following:
AB261,3,331. Passing supplies, equipment, or instruments.
AB261,3,442. Sponging or suctioning an operative site.
AB261,3,553. Preparing and cutting suture material.
AB261,3,664. Transferring and irrigating with fluids.
AB261,3,775. Transferring, but not administering, drugs within the sterile field.
AB261,3,886. Handling specimens.
AB261,3,997. Holding retractors.
AB261,3,11108. Assisting in counting sponges, needles, supplies, and instruments with a
11registered nurse.
AB261,312Section 3. 50.385 of the statutes is created to read:
AB261,3,161350.385 Surgical technology. (1) No hospital or ambulatory surgical center
14may employ or otherwise retain the services of an individual to perform surgical
15technology tasks or functions unless the individual satisfies any of the following
16criteria:
AB261,3,1717(a) The individual meets all of the following requirements:
AB261,3,19181. Has successfully completed an accredited educational program for surgical
19technologists.
AB261,3,21202. Holds and maintains certification as a surgical technologist from a national
21and accredited certifying body that certifies surgical technologists.
AB261,3,2322(b) The individual was employed as a surgical technologist in a hospital or
23ambulatory surgical center on December 31, 2027.
AB261,4,224(c) The individual has successfully completed a training program for surgical

1technology in connection with the individuals military service, as defined in s.
2111.32 (12g).
AB261,4,53(d) The individual is performing surgical technology tasks or functions in the
4service of the federal government but only to the extent that the individual is
5performing duties related to that service.
AB261,4,176(2) Notwithstanding sub. (1), a hospital or ambulatory surgical center may
7employ or otherwise retain the services of an individual to perform surgical
8technology services during the 24-month period that immediately follows the
9individuals successful completion of an educational program for surgical
10technologists described under sub. (1) (a) 1. If a hospital or ambulatory surgical
11center employs or otherwise retains the services of an individual to perform
12surgical technology services under this subsection, the hospital or ambulatory
13surgical center may not continue to employ or otherwise retain the services of that
14individual beyond the 24-month period that immediately follows the individuals
15successful completion of the educational program for surgical technologists
16described under sub. (1) (a) 1. unless the individual has obtained the certification
17described under sub. (1) (a) 2.
AB261,4,2018(3) Nothing in this section may be construed to prohibit a health care provider
19from performing surgical technology services if the health care provider is acting
20within the scope of his or her license, permit, registration, or certification.
AB261,4,2121(4) This section does not apply to any of the following:
AB261,4,2222(a) The practice of cardiac or interventional radiology.
AB261,5,2
1(b) An individual who practices as an expanded function dental auxiliary as
2delegated and supervised by a dentist licensed under ch. 447.
AB261,5,43(c) An individual who practices optometry under the supervision of an
4optometrist licensed under ch. 449.
AB261,5,85(5) Nothing in this section prohibits a hospital or ambulatory surgical center
6with an employment or other contractual relationship with an individual to
7perform surgical technology services from establishing additional requirements for
8the individual as a condition of employment or contract.
AB261,49Section 4. Effective date.
AB261,5,1010(1) This act takes effect on January 1, 2028.
