SB762,,2222(c) “Manager” means the nonprofit corporation with which the department executes a contract to manage the Wisconsin climate corps program under sub. (3). SB762,,2323(d) “Nonprofit corporation” means a nonstock, nonprofit corporation described under section 501 (c) (3) or (4) of the Internal Revenue Code that is exempt from the federal income tax under section 501 (a) of that code and organized under the laws of this state. SB762,,2424(e) “Project” means a planned undertaking of the Wisconsin climate corps for a sponsor to carry out a specific goal within a defined period of time that is focused on the restoration and rebuilding of natural lands, weatherization and energy efficiency projects in homes, or other climate resiliency projects in urban and rural areas of this state. SB762,,2525(f) “Sponsor” means a local government, tribal government, or nonprofit corporation or an executive branch agency, as defined in s. 16.70 (4), that proposes to undertake a project. SB762,,2626(2) Establishment of program. There is established the Wisconsin climate corps program. The purpose of the program is to provide workers to assist with the restoration and rebuilding of natural lands, the weatherization of homes, energy efficiency projects for homes, and other climate resiliency projects in both rural and urban areas and to provide employment training, professional development, and career pathways for underserved communities in this state. SB762,,2727(3) Board duties. The board shall contract with a nonprofit corporation to administer and manage the Wisconsin climate corps program. The nonprofit corporation shall be operating on a statewide basis on the effective date of this subsection .... [LRB inserts date], and have demonstrated experience in grant program writing and administration, natural resource restoration and rebuilding, and youth training, education, and employment. SB762,,2828(4) Contract terms. The contract under sub. (3) shall require the manager to do all of the following: SB762,,2929(a) Develop a project application form. SB762,,3030(b) Review project applications submitted by sponsors, approve projects, and negotiate agreements with sponsors to provide work crews to complete eligible projects. SB762,,3131(c) Require projects to be sited on land that is located in this state. SB762,,3232(d) Require projects to be for one or more of the purposes specified under sub. (5) or for any other similar project, as determined by the manager. SB762,,3333(e) Give preference to members of a work crew on a project who are at least 16 years of age and not more than 30 years of age. SB762,,3434(f) Require that at least 50 percent of the members of a work crew come from an underserved population in this state, as determined by the manager. SB762,,3535(g) Prohibit any employee or contractor from performing services under the Wisconsin climate corps program if those services displace the services of any individual who is employed by this state in a position, as defined in s. 230.03 (11), or who is employed by a local government in a permanent position. SB762,,3636(h) Pay each worker on a project at least $15 per hour worked. SB762,,3737(i) Provide each worker on a project with a housing stipend of not less than $100 per week or provide housing to each worker. SB762,,3838(j) Provide each worker on a project with health insurance coverage that is equivalent to a gold level health plan purchased on the American health benefit exchange, as described in 42 USC 18031, in this state. SB762,,3939(k) Remain neutral with respect to any labor organizing among workers on a project. SB762,,4040(L) Require each sponsor, upon completion of a project, to erect a permanent plaque at each project work site located on land owned by the federal or state government, a local government, a tribal government, or a nonprofit entity that identifies the site as a Wisconsin climate corps project. SB762,,4141(m) Submit an annual report to the department, no later than January 31, identifying, to the greatest extent practicable, information regarding the location of each project, a brief description of each project, and the training provided to employees. The manager shall also provide to the department any information the department considers necessary to complete the report under sub. (11) and may recommend improvements to the program. SB762,,4242(5) Scope of projects. Projects may include any of the following: SB762,,4343(a) Coordination of flood resilience activities in urban and rural watershed areas of this state. SB762,,4444(b) Restoration of natural outdoor spaces in underserved areas of this state, as determined by the manager. SB762,,4545(c) Planting trees in urban areas of this state, on tribal lands, and on other state or local lands. SB762,,4646(d) Assisting in the building of community gardens in underserved areas of this state, as determined by the manager, and on tribal lands and training in the maintenance of such gardens. SB762,,4747(e) Assisting in weatherization and energy efficiency projects for homes. SB762,,4848(f) Activities to improve climate resilience, equity, and environmental justice in this state, as determined by the manager. SB762,,4949(6) Work crews. The work crew members on a project shall constitute the Wisconsin climate corps. Each work crew shall have a crew leader. The manager shall determine the size of work crews. SB762,,5050(7) Staff support. The department shall provide all staff support to the board that is necessary for the operation of the Wisconsin climate corps program. SB762,,5151(8) Rules. The board shall promulgate rules for the operation of the Wisconsin climate corps program. SB762,,5252(9) Grants. From the appropriation under s. 20.505 (1) (bm), the board may award a grant for a proposed project that is approved by the manager. The cumulative amount of administrative costs charged by the board, the manager, and the sponsor in connection with a grant awarded under this subsection may not exceed 10 percent of the amount of the grant. SB762,,5353(10) Annual audit. Annually, no later than January 31, the department shall audit the Wisconsin climate corps program and include the information in its report to the legislature under sub. (11). SB762,,5454(11) Annual report. Annually, no later than March 31, the department shall submit a report to the chief clerk of each house of the legislature for distribution to the legislature under s. 13.172 (2) identifying Wisconsin climate corps projects that were completed in the preceding year or that were in the process of completion at the end of that year. The report shall also include the locations of all such projects. SB762,,5555(12) Intergovernmental cooperation. The board may, on behalf of the manager or a sponsor, enter into a cooperative purchasing agreement under s. 16.73 (1). The board may request cooperative assistance from other state agencies in carrying out its program responsibilities as provided in s. 20.901 (1) (a). The department may enter into an intergovernmental service agreement under s. 66.0301 on behalf of itself, the manager, an applicant, or a sponsor. (1m), when appropriate, the location of the agency, the quantities of the articles to be supplied, their conformity with the specifications, and the purposes for which they are required and the date of delivery.
