SB478,,22An Act to amend 944.20 (1) (a) and (b) and 944.20 (2) of the statutes; relating to: intentional exposure of genitals and providing a penalty. SB478,,33Analysis by the Legislative Reference Bureau Current law prohibits a person from publicly and indecently exposing genitals or pubic area. A person who violates the prohibition is guilty of a Class A misdemeanor. This bill eliminates the element that the exposure be indecent and instead requires that the exposure be intentional.
Because this bill creates a new crime or revises a penalty for an existing crime, the Joint Review Committee on Criminal Penalties may be requested to prepare a report.
SB478,,44The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SB478,15Section 1. 944.20 (1) (a) and (b) of the statutes are amended to read: SB478,,66944.20 (1) (a) Commits an indecent act of sexual gratification with another with knowledge that they are in the presence of others; or. SB478,,77(b) Publicly and indecently Intentionally exposes genitals or pubic area in a public area. SB478,28Section 2. 944.20 (2) of the statutes is amended to read: SB478,,99944.20 (2) Subsection (1) does not apply to a mother’s breast-feeding of her child. Subsection (1) (b) does not apply to diapering a baby.
