Under current law, the state superintendent must reimburse a school board or the governing body of a private school or tribal school for each breakfast served at a school that meets certain federal regulatory requirements. Current law contains a reference to a federal regulation that was, by rule, deleted and incorporated into current federal school breakfast regulations. This bill removes that reference.
The bill repeals a provision that 1) until the end of the 1971-72 school year, prohibited the issuance of a certificate or license to teach in any public school unless the applicant had completed two years of post-high school education devoted to pedagogical instruction and training; and 2) allowed any teacher who taught in any public school during or before the 1937-38 school year to continue to teach in public schools without complying with that educational requirement.

Law Revision Committee prefatory note: This bill is a remedial legislation proposal, requested by the Department of Public Instruction and introduced by the Law Revision Committee under s. 13.83 (1) (c) 4. and 5., stats. After careful consideration of the various provisions of the bill, the Law Revision Committee has determined that this bill makes minor substantive changes in the statutes, and that these changes are desirable as a matter of public policy.
AB1103,15Section 1. 115.28 (7) (a) of the statutes, as affected by 2023 Wisconsin Act 20, is amended to read:
AB1103,,66115.28 (7) (a) License all teachers for the public schools of the state; make rules establishing standards of attainment and procedures for the examination and licensing of teachers within the limits prescribed in ss. 118.19 (2) and (3), 118.191, 118.1915, 118.192, 118.193, 118.194, 118.195, and 118.197; prescribe by rule standards, requirements, and procedures for the approval of teacher preparatory programs leading to licensure, including a requirement that, to be approved by the state superintendent, a teacher preparatory program shall demonstrate that it provides instruction that prepares teachers to teach reading and language arts using science-based early reading instruction, as defined in s. 118.015 (1c) (b), and does not provide instruction on teaching reading and language arts that incorporates 3-cueing, as defined in s. 118.015 (1c) (c), and a requirement that, beginning on July 1, 2012, and annually thereafter, each teacher preparatory program located in this state shall submit to the department a list of individuals who have completed the program and who have been recommended by the program for licensure under this subsection, together with each individual’s date of program completion, from each term or semester of the program’s most recently completed academic year; file in the state superintendent’s office all papers relating to state teachers’ licenses; and register each such license.
AB1103,27Section 2. 115.341 (1) of the statutes is amended to read:
AB1103,,88115.341 (1) From the appropriation under s. 20.255 (2) (cm), the state superintendent shall reimburse each school board 15 cents for each breakfast served at a school that meets the requirements of 7 CFR 220.8 or 220.8a, whichever is applicable, and shall reimburse each governing body of a private school or tribal school 15 cents for each breakfast served at the private school or tribal school that meets the requirements of 7 CFR 220.8 or 220.8a, whichever is applicable.
Note: This Section removes references to a federal regulation that was repealed.
AB1103,39Section 3. 118.19 (2) of the statutes is repealed.
Note: This Section repeals two obsolete provisions. One applied only until the end of the 1971-72 school year. The other applied to any teacher who taught in the 1937-38 school year or a prior school year. Section 1 removes a reference to the repealed provisions.
