SB298,1,2 1An Act to amend 97.30 (5) of the statutes; relating to: allowing dogs on the
2premises of certain retail food establishments.

This bill prohibits the Department of Agriculture, Trade and Consumer
Protection from promulgating a rule that prohibits dogs from the premises of a retail
food establishment that receives not more than 5 percent of its total revenues from
the sale of food. Under current law, DATCP has authority to promulgate rules
governing the operation of retail food establishments.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB298,1 3Section 1. 97.30 (5) of the statutes is amended to read:
SB298,2,34 97.30 (5) Rule making. The department may promulgate rules to establish the
5fees required under sub. (3) or to govern the operation of retail food establishments.
6Rules may include standards for the construction and maintenance of facilities; the
7design, installation, cleaning and maintenance of equipment and utensils; personnel
8sanitation; food handling, display and storage; and food sources and food labeling.

1No rule promulgated under this subsection may prohibit dogs from the premises of
2a retail food establishment that receives not more than 5 percent of its total revenues
3from the sale of food.
