SB255,1,2 1An Act to create 49.46 (2) (bh) of the statutes; relating to: reimbursement of
2pharmacist services under the Medical Assistance program.
Analysis by the Legislative Reference Bureau
The bill requires the Department of Health Services to provide reimbursement
under the Medical Assistance program for services that are typically reimbursable
under the program but that are provided by a pharmacist within the scope of his or
her license or that are provided by a pharmacist that were delegated by a physician.
DHS is required to seek any necessary state plan amendment or waiver necessary
to allow for such pharmacist reimbursement and is not required to provide
reimbursement if the federal government disapproves.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB255,1 3Section 1 . 49.46 (2) (bh) of the statutes is created to read:
SB255,2,64 49.46 (2) (bh) The department shall provide reimbursement for services that
5are reimbursable under this section and that are provided by a licensed pharmacist
6within the scope of his or her license or are services performed under s. 450.033. If

1the department determines it is unable to implement this paragraph without a state
2plan amendment or waiver of federal law, the department shall submit to the federal
3department of health and human services any necessary state plan amendment or
4waiver of federal law necessary to implement this paragraph. If the federal
5government disapproves the amendment or waiver request, the department is not
6required to implement this paragraph.
