SB1046,1,3 1An Act to create 20.435 (4) (bu) and 49.79 (7s) of the statutes; relating to:
2payment processing equipment and services for farmers and farmers' markets
3and making an appropriation.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Health Services to provide electronic
benefit transfer and credit and debit card processing equipment and services to
farmers' markets and farmers who sell directly to consumers as a payment
processing program. The bill specifies that the electronic benefit transfer processing
equipment and services must include equipment and services for the food stamp
program, which is known as FoodShare. Under the bill, the vendor that processes
the electronic benefit transfer and credit and debit card transactions must also
process any local purchasing incentives. The bill provides $735,000 for this payment
processing program, and included in that amount is funding for a portion of a
full-time employee position for DHS to coordinate and provide other services for the
payment processing program. The bill also appropriates additional moneys to the
Department of Public Instruction for special education and to the University of
Wisconsin System and the state's technical college system for higher education to
satisfy maintenance of effort requirements to sustain certain federal funding.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB1046,1 1Section 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert

SB1046,2 3Section 2. 20.435 (4) (bu) of the statutes is created to read:
SB1046,2,74 20.435 (4) (bu) Payment processing program for farmers. Biennially, the
5amounts in the schedule to provide electronic benefit transfer and credit and debit
6card processing equipment and services to farmers' markets and farmers who sell
7directly to consumers under s. 49.79 (7s).
SB1046,3 8Section 3. 49.79 (7s) of the statutes is created to read:
SB1046,3,29 49.79 (7s) Payment processing program. The department shall administer a
10payment processing program to provide to farmers' markets and farmers who sell
11directly to consumers electronic benefit transfer and credit and debit card processing
12equipment and services, including electronic benefit transfer for the food stamp
13program. To participate in the payment processing program, the vendor that is
14under contract to process the electronic benefit transfer and credit and debit card

1transactions shall also process any local purchasing incentives, even if those local
2purchasing incentives are funded by a local third-party entity.
SB1046,4 3Section 4. Nonstatutory provisions.
SB1046,3,74 (1) Payment processing program; position. The authorized FTE positions for
5the department of health services are increased by 0.625 GPR position, to be funded
6from the appropriation under s. 20.435 (4) (bu), for the purpose of coordinating the
7payment processing program and providing other services under s. 49.79 (7s).
SB1046,5 8Section 5 . Fiscal changes.
SB1046,3,159 (1) Special education aid. In the schedule under s. 20.005 (3) for the
10appropriation to the department of public instruction under s. 20.255 (2) (b), the
11dollar amount for fiscal year 2021-22 is increased by $230,000 to increase funding
12for aids for special education under s. 115.88. In the schedule under s. 20.005 (3) for
13the appropriation to the department of public instruction under s. 20.255 (2) (b), the
14dollar amount for fiscal year 2022-23 is increased by $230,000 to increase funding
15for aids for special education under s. 115.88.
SB1046,3,2316 (2) University of Wisconsin System; general program operations. In the
17schedule under s. 20.005 (3) for the appropriation to the Board of Regents of the
18University of Wisconsin System under s. 20.285 (1) (a), the dollar amount for fiscal
19year 2021-22 is increased by $51,000 to increase funding for the purposes for which
20the appropriation is made. In the schedule under s. 20.005 (3) for the appropriation
21to the Board of Regents of the University of Wisconsin System under s. 20.285 (1) (a),
22the dollar amount for fiscal year 2022-23 is increased by $51,000 to increase funding
23for the purposes for which the appropriation is made.
SB1046,4,524 (3) State aids for technical colleges. In the schedule under s. 20.005 (3) for
25the appropriation to the technical college system board under s. 20.292 (1) (d), the

1dollar amount for fiscal year 2021-22 is increased by $9,000 to increase funding for
2the purposes for which the appropriation is made. In the schedule under s. 20.005
3(3) for the appropriation to the technical college system board under s. 20.292 (1) (d),
4the dollar amount for fiscal year 2022-23 is increased by $9,000 to increase funding
5for the purposes for which the appropriation is made.
