Emergency rule-making authority; family and medical leave. The
10department of workforce development may use the procedure under s. 227.24 to
11promulgate rules to implement s. 103.10 (3) (b) 4. and to revise ch. DWD 225 of the
12administrative code as needed to implement the changes made by this act's
13treatment of s. 103.10 (1) (a) (intro.), 1., 2., and 3., (ao), (ap), (b), (c), (dg), (dr), (dt),
14(em), and (gm), (2) (c), (3) (a) 1. and 2m. and (b) 3., 4., 4m., 5., and 6., (4) (a), (6) (b)
15and (c), (7) (a), (b) (intro.), 1., 2., and 3., (d), (e), and (f), (10), (12) (b) and (c), and (14)
16(a) and (b). Notwithstanding s. 227.24 (1) (c) and (2), emergency rules promulgated
17under this subsection remain in effect until July 1, 2022, or the date on which
18permanent rules take effect, whichever is sooner. Notwithstanding s. 227.24 (1) (a)
19and (3), the department is not required to provide evidence that promulgating a rule
20under this subsection as an emergency rule is necessary for the preservation of the
21public peace, health, safety, or welfare and is not required to provide a finding of
22emergency for a rule promulgated under this subsection.

5of the Wisconsin statutes relating to marriage and the determination of parentage
6with the provision of s. 990.001 (2), which specifies that words importing one gender
7extend and may be applied to any gender. The legislature intends that by amending
8the statutes relating to marriage and the determination of parentage with respect
9to married couples to use gender neutral language where appropriate so as to clarify
10that the same statutory rights and responsibilities apply between married persons
11of the same sex as between married persons of different sexes and to extend some of
12the presumptions of paternity to either parent, the Wisconsin statutes will be better
13aligned with the holding of the U.S. Supreme Court in Obergefell v. Hodges, 135 S.
14Ct. 2584, 192 L. Ed. 2d 609 (2015), which recognizes that same-sex couples have a
15fundamental constitutional right to marriage.
