AB537,20,2422 (km) “Psychology interjurisdictional compact commission" also referred to as
23“commission" means: the national administration of which all compact states are
24members.
AB537,21,2
1(L) “Receiving state" means: a compact state where the client/patient is
2physically located when the telepsychological services are delivered.
AB537,21,83 (Lm) “Rule" means: a written statement by the Psychology Interjurisdictional
4Compact Commission promulgated pursuant to sub. (11) that is of general
5applicability, implements, interprets, or prescribes a policy or provision of the
6compact, or an organizational, procedural, or practice requirement of the
7commission and has the force and effect of statutory law in a compact state, and
8includes the amendment, repeal or suspension of an existing rule.
AB537,21,99 (m) “Significant investigatory information" means:
AB537,21,1410 1. Investigative information that a state psychology regulatory authority, after
11a preliminary inquiry that includes notification and an opportunity to respond if
12required by state law, has reason to believe, if proven true, would indicate more than
13a violation of state statute or ethics code that would be considered more substantial
14than minor infraction; or
AB537,21,1715 2. Investigative information that indicates that the psychologist represents an
16immediate threat to public health and safety regardless of whether the psychologist
17has been notified and/or had an opportunity to respond.
AB537,21,1918 (mm) “State" means: a state, commonwealth, territory, or possession of the
19United States, the District of Columbia.
AB537,21,2220 (n) “State psychology regulatory authority" means: the board, office or other
21agency with the legislative mandate to license and regulate the practice of
22psychology.
AB537,21,2423 (nm) “Telepsychology" means: the provision of psychological services using
24telecommunication technologies.
AB537,22,3
1(o) “Temporary authorization to practice" means: a licensed psychologist's
2authority to conduct temporary in-person, face-to-face practice, within the limits
3authorized under this compact, in another compact state.
AB537,22,74 (om) “Temporary in-person, face-to-face practice" means: where a
5psychologist is physically present (not through the use of telecommunications
6technologies), in the distant state to provide for the practice of psychology for 30 days
7within a calendar year and based on notification to the distant state.
AB537,22,9 8(3) Article III — Home state licensure. (a) The home state shall be a compact
9state where a psychologist is licensed to practice psychology.
AB537,22,1410 (b) A psychologist may hold one or more compact state licenses at a time. If the
11psychologist is licensed in more than one compact state, the home state is the
12compact state where the psychologist is physically present when the services are
13delivered as authorized by the authority to practice interjurisdictional
14telepsychology under the terms of this compact.
AB537,22,1815 (c) Any compact state may require a psychologist not previously licensed in a
16compact state to obtain and retain a license to be authorized to practice in the
17compact state under circumstances not authorized by the authority to practice
18interjurisdictional telepsychology under the terms of this compact.
AB537,22,2119 (d) Any compact state may require a psychologist to obtain and retain a license
20to be authorized to practice in a compact state under circumstances not authorized
21by temporary authorization to practice under the terms of this compact.
AB537,22,2422 (e) A home state's license authorizes a psychologist to practice in a receiving
23state under the authority to practice interjurisdictional telepsychology only if the
24compact state:
AB537,22,2525 1. Currently requires the psychologist to hold an active E.Passport;

12. Has a mechanism in place for receiving and investigating complaints about
2licensed individuals;
AB537,23,43 3. Notifies the commission, in compliance with the terms herein, of any adverse
4action or significant investigatory information regarding a licensed individual;
AB537,23,95 4. Requires an identity history summary of all applicants at initial licensure,
6including the use of the results of fingerprints or other biometric data checks
7compliant with the requirements of the federal bureau of investigation (FBI), or
8other designee with similar authority, no later than ten years after activation of the
9compact; and
AB537,23,1010 5. Complies with the bylaws and rules of the commission.
AB537,23,1211 (f) A home state's license grants temporary authorization to practice to a
12psychologist in a distant state only if the compact state:
AB537,23,1313 1. Currently requires the psychologist to hold an active IPC;
AB537,23,1514 2. Has a mechanism in place for receiving and investigating complaints about
15licensed individuals;
AB537,23,1716 3. Notifies the commission, in compliance with the terms herein, of any adverse
17action or significant investigatory information regarding a licensed individual;
AB537,23,2218 4. Requires an identity history summary of all applicants at initial licensure,
19including the use of the results of fingerprints or other biometric data checks
20compliant with the requirements of the federal bureau of investigation (FBI), or
21other designee with similar authority, no later than ten years after activation of the
22compact; and
AB537,23,2323 5. Complies with the bylaws and rules of the commission.
AB537,24,3 24(4) Article IV — Compact privilege to practice telepsychology. (a) Compact
25states shall recognize the right of a psychologist, licensed in a compact state in

1conformance with sub. (3), to practice telepsychology in other compact states
2(receiving states) in which the psychologist is not licensed, under the authority to
3practice interjurisdictional telepsychology as provided in the compact.
AB537,24,64 (b) To exercise the authority to practice interjurisdictional telepsychology
5under the terms and provisions of this compact, a psychologist licensed to practice
6in a compact state must:
AB537,24,87 1. Hold a graduate degree in psychology from an institute of higher education
8that was, at the time the degree was awarded:
AB537,24,119 a. Regionally accredited by an accrediting body recognized by the U.S.
10Department of Education to grant graduate degrees, OR authorized by provincial
11statute or royal charter to grant doctoral degrees; OR
AB537,24,1512 b. A foreign college or university deemed to be equivalent to subd. 1. a. by a
13foreign credential evaluation service that is a member of the National Association
14of Credential Evaluation Services (NACES) or by a recognized foreign credential
15evaluation service; AND
AB537,24,1616 2. Hold a graduate degree in psychology that meets the following criteria:
AB537,24,2017 a. The program, wherever it may be administratively housed, must be clearly
18identified and labeled as a psychology program. Such a program must specify in
19pertinent institutional catalogues and brochures its intent to educate and train
20professional psychologists;
AB537,24,2221 b. The psychology program must stand as a recognizable, coherent,
22organizational entity within the institution;
AB537,24,2423 c. There must be a clear authority and primary responsibility for the core and
24specialty areas whether or not the program cuts across administrative lines;
AB537,24,2525 d. The program must consist of an integrated, organized sequence of study;

1e. There must be an identifiable psychology faculty sufficient in size and
2breadth to carry out its responsibilities;
AB537,25,43 f. The designated director of the program must be a psychologist and a member
4of the core faculty;
AB537,25,65 g. The program must have an identifiable body of students who are
6matriculated in that program for a degree;
AB537,25,87 h. The program must include supervised practicum, internship, or field
8training appropriate to the practice of psychology;
AB537,25,119 i. The curriculum shall encompass a minimum of three academic years of
10full-time graduate study for doctoral degree and a minimum of one academic year
11of full-time graduate study for master's degree;
AB537,25,1312 j. The program includes an acceptable residency as defined by the rules of the
13commission.
AB537,25,1514 3. Possess a current, full and unrestricted license to practice psychology in a
15home state which is a compact state;
AB537,25,1616 4. Have no history of adverse action that violate the rules of the commission;
AB537,25,1817 5. Have no criminal record history reported on an identity history summary
18that violates the rules of the commission;
AB537,25,1919 6. Possess a current, active E.Passport;
AB537,25,2420 7. Provide attestations in regard to areas of intended practice, conformity with
21standards of practice, competence in telepsychology technology; criminal
22background; and knowledge and adherence to legal requirements in the home and
23receiving states, and provide a release of information to allow for primary source
24verification in a manner specified by the commission; and
AB537,25,2525 8. Meet other criteria as defined by the rules of the commission.
AB537,26,3
1(c) The home state maintains authority over the license of any psychologist
2practicing into a receiving state under the authority to practice interjurisdictional
3telepsychology.
AB537,26,114 (d) A psychologist practicing into a receiving state under the authority to
5practice interjurisdictional telepsychology will be subject to the receiving state's
6scope of practice. A receiving state may, in accordance with that state's due process
7law, limit or revoke a psychologist's authority to practice interjurisdictional
8telepsychology in the receiving state and may take any other necessary actions under
9the receiving state's applicable law to protect the health and safety of the receiving
10state's citizens. If a receiving state takes action, the state shall promptly notify the
11home state and the commission.
AB537,26,1612 (e) If a psychologist's license in any home state, another compact state, or any
13authority to practice interjurisdictional telepsychology in any receiving state, is
14restricted, suspended or otherwise limited, the E.Passport shall be revoked and
15therefore the psychologist shall not be eligible to practice telepsychology in a compact
16state under the authority to practice interjurisdictional telepsychology.
AB537,26,20 17(5) Article V — Compact temporary authorization to practice. (a) Compact
18states shall also recognize the right of a psychologist, licensed in a compact state in
19conformance with sub. (3), to practice temporarily in other compact states (distant
20states) in which the psychologist is not licensed, as provided in the compact.
AB537,26,2321 (b) To exercise the temporary authorization to practice under the terms and
22provisions of this compact, a psychologist licensed to practice in a compact state
23must:
AB537,26,2524 1. Hold a graduate degree in psychology from an institute of higher education

AB537,28,99 5. No criminal record history that violates the rules of the commission;
AB537,28,1010 6. Possess a current, active IPC;
AB537,28,1311 7. Provide attestations in regard to areas of intended practice and work

AB537,28,1414 8. Meet other criteria as defined by the rules of the commission.
AB537,28,1715 (c) A psychologist practicing into a distant state under the temporary
16authorization to practice shall practice within the scope of practice authorized by the
17distant state.
AB537,28,2418 (d) A psychologist practicing into a distant state under the temporary
19authorization to practice will be subject to the distant state's authority and law. A
20distant state may, in accordance with that state's due process law, limit or revoke a
21psychologist's temporary authorization to practice in the distant state and may take
22any other necessary actions under the distant state's applicable law to protect the
23health and safety of the distant state's citizens. If a distant state takes action, the
24state shall promptly notify the home state and the commission.
AB537,29,5
1(e) If a psychologist's license in any home state, another compact state, or any
2temporary authorization to practice in any distant state, is restricted, suspended or
3otherwise limited, the IPC shall be revoked and therefore the psychologist shall not
4be eligible to practice in a compact state under the temporary authorization to
5practice.
AB537,29,10 6(6) Article VI — Conditions of telepsychology practice in a receiving state.
7A psychologist may practice in a receiving state under the authority to practice
8interjurisdictional telepsychology only in the performance of the scope of practice for
9psychology as assigned by an appropriate state psychology regulatory authority, as
10defined in the rules of the commission, and under the following circumstances:
AB537,29,1211 (a) The psychologist initiates a client/patient contact in a home state via
12telecommunications technologies with a client/patient in a receiving state;
AB537,29,1413 (b) Other conditions regarding telepsychology as determined by rules
14promulgated by the commission.
AB537,29,18 15(7) Article VII — Adverse actions. (a) A home state shall have the power to
16impose adverse action against a psychologist's license issued by the home state. A
17distant state shall have the power to take adverse action on a psychologist's
18temporary authorization to practice within that distant state.
AB537,29,2219 (b) A receiving state may take adverse action on a psychologist's authority to
20practice interjurisdictional telepsychology within that receiving state. A home state
21may take adverse action against a psychologist based on an adverse action taken by
22a distant state regarding temporary in-person, face-to-face practice.
AB537,30,223 (c) If a home state takes adverse action against a psychologist's license, that
24psychologist's authority to practice interjurisdictional telepsychology is terminated

1and the E.Passport is revoked. Furthermore, that psychologist's temporary
2authorization to practice is terminated and the IPC is revoked.
AB537,30,63 1. All home state disciplinary orders which impose adverse action shall be
4reported to the commission in accordance with the rules promulgated by the
5commission. A compact state shall report adverse actions in accordance with the
6rules of the commission.
AB537,30,97 2. In the event discipline is reported on a psychologist, the psychologist will not
8be eligible for telepsychology or temporary in-person, face-to-face practice in
9accordance with the rules of the commission.
AB537,30,1110 3. Other actions may be imposed as determined by the rules promulgated by
11the commission.
AB537,30,1612 (d) A home state's psychology regulatory authority shall investigate and take
13appropriate action with respect to reported inappropriate conduct engaged in by a
14licensee which occurred in a receiving state as it would if such conduct had occurred
15by a licensee within the home state. In such cases, the home state's law shall control
16in determining any adverse action against a psychologist's license.
AB537,30,2217 (e) A distant state's psychology regulatory authority shall investigate and take
18appropriate action with respect to reported inappropriate conduct engaged in by a
19psychologist practicing under temporary authorization practice which occurred in
20that distant state as it would if such conduct had occurred by a licensee within the
21home state. In such cases, distant state's law shall control in determining any
22adverse action against a psychologist's temporary authorization to practice.
AB537,31,523 (f) Nothing in this compact shall override a compact state's decision that a
24psychologist's participation in an alternative program may be used in lieu of adverse
25action and that such participation shall remain non-public if required by the

1compact state's law. Compact states must require psychologists who enter any
2alternative programs to not provide telepsychology services under the authority to
3practice interjurisdictional telepsychology or provide temporary psychological
4services under the temporary authorization to practice in any other compact state
5during the term of the alternative program.
