AB444,17,2221 49.45 (23b) (title) Childless adults demonstration project reform waiver

AB444,32 23Section 32. 49.45 (23b) (b) of the statutes is amended to read:
AB444,18,224 49.45 (23b) (b) Beginning as soon as practicable after October 31, 2018, and
25ending no sooner than December 31, 2023, the department shall do all of the

1following with regard to the childless adults demonstration project under sub. (23)
2s. 49.471 (4) (a) 8.:
AB444,18,83 1. Require in each month persons, except exempt individuals, who are eligible
4to receive Medical Assistance under sub. (23) s. 49.471 (4) (a) 8. and who are at least
519 years of age but have not attained the age of 50 to participate in, document, and
6report 80 hours per calendar month of community engagement activities. The
7department, after finding good cause, may grant a temporary exemption from the
8requirement under this subdivision upon request of a Medical Assistance recipient.
AB444,18,119 2. Require persons with incomes of at least 50 percent of the poverty line to pay
10premiums in accordance with par. (c) as a condition of eligibility for Medical
11Assistance under sub. (23) s. 49.471 (4) (a) 8.

AB444,33 22Section 33. 49.45 (23b) (c) of the statutes is amended to read:
AB444,19,323 49.45 (23b) (c) 1. Persons who are eligible for the demonstration project under
24sub. (23) s. 49.471 (4) (a) 8. and who have monthly household income that exceeds
2550 percent of the poverty line shall pay a monthly premium amount of $8 per

1household. A person who is eligible to receive an item or service furnished by an
2Indian health care provider is exempt from the premium requirement under this
3subdivision.
AB444,19,94 2. The department may disenroll under par. (b) 5. a person for nonpayment of
5a required monthly premium only at annual eligibility redetermination after
6providing notice and reasonable opportunity for the person to pay. If a person who
7is disenrolled for nonpayment of premiums pays all owed premiums or becomes
8exempt from payment of premiums, he or she may reenroll in Medical Assistance
9under sub. (23) s. 49.471 (4) (a) 8.
AB444,19,1310 3. The department shall reduce the amount of the required household premium
11by up to half for a recipient of Medical Assistance under sub. (23) s. 49.471 (4) (a) 8.
12who does not engage in certain behaviors that increase health risks or who attests
13to actively managing certain unhealthy behaviors.
AB444,34 14Section 34. 49.45 (23b) (e) of the statutes is amended to read:
AB444,19,1915 49.45 (23b) (e) Before December 31, 2023, the demonstration project
16requirements under this subsection may not be withdrawn and the department may
17not request from the federal government withdrawal, suspension, or termination of
18the demonstration project requirements under this subsection unless legislation has
19been enacted specifically allowing for the withdrawal, suspension, or termination.
AB444,35 20Section 35. 49.471 (1) (cr) of the statutes is created to read:

AB444,20,66 a. The individual is an adult under the age of 65.
AB444,20,87 b. The individual has a family income that does not exceed 133 percent of the
8poverty line, except as provided in sub. (4g).
AB444,20,109 c. The individual is not otherwise eligible for the Medical Assistance program
10under this subchapter or the Medicare program under 42 USC 1395 et seq.
AB444,38 11Section 38. 49.471 (4g) of the statutes is created to read:
AB444,20,2112 49.471 (4g) Medicaid expansion; federal medical assistance percentage. For
13services provided to individuals described under sub. (4) (a) 8., the department shall
14comply with all federal requirements to qualify for the highest available enhanced
15federal medical assistance percentage. The department shall submit any
16amendment to the state medical assistance plan, request for a waiver of federal
17Medicaid law, or other approval request required by the federal government to
18provide services to the individuals described under sub. (4) (a) 8. and qualify for the
19highest available enhanced federal medical assistance percentage. Sections 20.940
20and 49.45 (2t) do not apply to a submission to the federal government under this
21subsection.
AB444,39 22Section 39. 49.686 (3) (d) of the statutes is amended to read:
AB444,21,323 49.686 (3) (d) Has applied for coverage under and has been denied eligibility
24for medical assistance within 12 months prior to application for reimbursement
25under sub. (2). This paragraph does not apply to an individual who is eligible for

1benefits under the demonstration project for childless adults under s. 49.45 (23) or
2to an individual who is eligible for benefits under BadgerCare Plus under s. 49.471
3(4) (a) 8. or (11).
AB444,40 4Section 40 . 51.72 of the statutes is created to read:
AB444,21,9 551.72 Suicide prevention programming grants. (1) From the
6appropriation under s. 20.435 (5) (ef), the department shall award grants to
7organizations or coalitions of organizations, which may include a city, village, town,
8county, or federally recognized American Indian tribe or band in this state, for suicide
9prevention programming.
AB444,21,12 10(2) The department may not award a grant under sub. (1) unless the recipient
11contributes matching funds or in-kind services having a value equal to at least 20
12percent of the grant.
AB444,21,14 13(3) The department may award a grant to a recipient under sub. (1) for an
14amount up to $25,000 in a particular fiscal year.
AB444,41 15Section 41 . 51.73 of the statutes is created to read:
AB444,21,20 1651.73 Grants to prevent suicide by firearm. (1) From the appropriation
17under s. 20.435 (5) (ef), the department shall award grants to organizations or
18coalitions of organizations, which may include a city, village, town, county, or
19federally recognized American Indian tribe or band in this state for any of the
20following purposes:
AB444,21,2221 (a) To train staff at a firearm retailer or firearm range on how to recognize a
22person who may be considering suicide.
AB444,21,2423 (b) To provide suicide prevention materials for distribution at a firearm retailer
24or firearm range.
AB444,21,2525 (c) To provide voluntary, temporary firearm storage.

1(2) The department may not award a grant under sub. (1) unless the recipient
2contributes matching funds or in-kind services having a value equal to at least 20
3percent of the grant.
AB444,22,11 4(3) The department may not award a grant to a recipient under sub. (1) for an
5amount that exceeds $5,000. The department may not award a grant under sub. (1)
6having a duration of more than one year and may not automatically renew a grant
7awarded under sub. (1). This subsection shall not be construed to prevent an
8organization or coalition of organizations from reapplying for a grant in consecutive
9years. In awarding grants under sub. (1), the department shall give preference to
10organizations or coalitions of organizations that have not previously received a grant
11under this section.
AB444,42 12Section 42 . 85.0215 of the statutes is created to read:
AB444,22,13 1385.0215 Local supplement. (1) In this section:
AB444,22,1514 (a) “Eligible applicant” means a city, village, town, or county or a combination
15of these or an eligible entity, as defined under 23 USC 133 (h) (4) (B).
AB444,22,1716 (b) “Eligible project” means a project eligible for funding under s. 84.12, 84.16,
1784.18, or 86.31 (3) or (3t) or 23 USC 133 (h) (3).
AB444,22,21 18(2) Funds provided under s. 20.395 (2) (fc) shall be distributed under this
19section as discretionary grants to reimburse eligible applicants for eligible projects.
20The department shall solicit and provide discretionary grants under this section
21until all funds appropriated under s. 20.395 (2) (fc) have been expended.

AB444,23,11 9153.85 Definition; opioid and methamphetamine data. In this
10subchapter, “vendor” means a person awarded the contract following a request for
11proposals described under s. 153.87.
AB444,23,16 12153.87 Opioid and methamphetamine data system. (1) Subject to sub.
13(3), the department of administration shall issue a request for proposals to establish
14and maintain an opioid and methamphetamine data system to collect, format,
15analyze, and disseminate information on opioid and methamphetamine use, which
16shall include all of the following:
AB444,23,1817 (a) Hospital discharge data from visits and stays related to opioid use or
18overdose.
AB444,23,2019 (b) Hospital discharge data from visits and stays related to methamphetamine

23individuals who overdose on opioids, and the opioids on which the individuals

2number of individuals who overdose on methamphetamines, and the forms of
3methamphetamines on which the individuals overdose.
AB444,24,44 (f) Death records related to opioid use or overdose.
AB444,24,55 (g) Death records related to methamphetamine use or overdose.
AB444,24,76 (h) The number of opioid treatment centers in the state, by the owner or
7operator of each opioid treatment center.
AB444,24,98 (i) The number of methamphetamine treatment centers in the state, by the
9owner or operator of each methamphetamine treatment center.
AB444,24,1410 (j) The number of providers in this state that are allowed to prescribe a drug
11that is a combination of buprenorphine and naloxone, the patient capacity for those
12prescribers, the number of patients taking such a combination drug, and the number
13of patients who have discontinued such a combination drug due to successful
14completion of a treatment program.
AB444,24,1915 (k) The number of methadone clinics in the state, the number of patients taking
16methadone, the number of patients who more than once have been on courses of
17methadone, the number of patients who have discontinued methadone use due to

7to which those adults use methamphetamines, and the forms of methamphetamines

AB444,25,109 (o) The number of minors in the state who use opioids, the extent to which those
10minors use opioids, and the type of opioids used.
AB444,25,1311 (p) The number of minors in the state who use methamphetamines, the extent
12to which those minors use methamphetamines, and the forms of methamphetamines
13used.
AB444,25,1714 (q) The number of minors who enter the child protective services system due
15to opioid use by a parent or guardian, length of time those minors are in out-of-home
16care, and the type of reporter who notified child protective services of the needs of
17the minor.
AB444,25,2518 (r) The number of persons who are incarcerated and who are receiving
19naltrexone for extended-release in injectable suspension, the number of persons
20who are on extended supervision or probation or on parole and who are receiving
21extended-release naltrexone, the total number of doses of extended-release

23or probation, or on parole in this state, and the length of time that persons who are
24incarcerated, on extended supervision or probation, or on parole are receiving

AB444,26,7 4(2) The opioid and methamphetamine data system under sub. (1) shall identify,
5to the extent possible, for sub. (1) (a), (b), (c), (d), (e), (f), (g), (j), (k), (m), (n), (o), (p),
6and (r), the number of individuals who have each of the following forms of health care
7coverage:
AB444,26,88 (a) Public health care coverage under the Medical Assistance program.
AB444,26,119 (b) Public health care coverage under Medicare, a veteran or military health
10plan, or another public form of coverage other than Medical Assistance, including
11any self-insured governmental health plan.
AB444,26,1212 (c) Private insurance or a private heath plan.
AB444,26,1313 (d) Self-coverage or uninsured.
AB444,26,25 14(3) (a) The department of administration shall submit the proposed request for
15proposals described under sub. (1) to the joint committee on finance before issuing
16the request for proposal. If the cochairpersons of the joint committee on finance do
17not notify the department of administration within 14 working days after the date
18of the submittal of the proposed request for proposals under this paragraph that the
19committee has scheduled a meeting for the purpose of reviewing the proposed
20request for proposals, the department may issue the request for proposals. If, within
2114 working days after the date of the submittal of the proposed request for proposals
22under this paragraph, the cochairpersons of the committee notify the department of
23administration that the committee has scheduled a meeting for the purpose of
24reviewing the proposed request for proposals, the department may issue the
25proposed request for proposals only upon approval by the committee.

1(b) At the time the department of administration submits the proposal under
2par. (a), the departments of health services, children and families, corrections,
3justice, and safety and professional services may submit to the joint committee on
4finance suggestions of opioid-related or methamphetamine-related information to
5collect, analyze, and disseminate in addition to information specified under sub. (1)
6to assist the agencies in analyzing the behavioral health status of the state's
7population, reducing relapse of opioid and methamphetamine misuse, improving
8patient outcomes after opioid or methamphetamine use or overdose, assisting
9minors who are in out-of-home care, and monitoring health costs related to
10substance use.
AB444,27,14 11(4) The department of administration shall collaborate with and collect data
12from the departments of health services, corrections, justice, safety and professional
13services, and children and families and any other applicable agencies for the opioid
14and methamphetamine data system under sub. (1).
AB444,27,20 15(5) (a) The department of administration shall administer the contract with the
16vendor to operate the opioid and methamphetamine data system and shall have
17access to the data contained in the opioid and methamphetamine data system. The
18department of administration shall work with the vendor to disseminate information
19and advanced analytics from the opioid and methamphetamine data system in as
20close to real time as possible.
AB444,27,2421 (b) The opioid and methamphetamine data system shall allow the state
22agencies that submit data to the opioid and methamphetamine data system access
23to the data in the opioid and methamphetamine data system as appropriate for the
24agency to fulfill its functions and as allowed by state and federal confidentiality laws.

1153.89 Reports; opioid and methamphetamine data system. By January
231, 2022, and annually thereafter, the department of administration shall submit a
3report to the joint committee on finance summarizing the information from the
4opioid and methamphetamine data system under s. 153.87 (1) and analyzing trends
5in that information across years of data collection.
