AB1191,1,3 1An Act to create 16.312 and 20.505 (7) (d) of the statutes; relating to: grants
2to provide legal services to tenants in eviction actions, granting rule-making
3authority, and making an appropriation.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Administration to establish a grant
program to provide funds to attorneys to provide legal services for low-income
tenants in eviction actions or in actions in which the tenant alleges he or she was
wrongfully evicted. Under the bill, the grant moneys may only be used to provide
legal services to a tenant whose family has an income at or below 200 percent of the
federal poverty line.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB1191,1 4Section 1. 16.312 of the statutes is created to read:
AB1191,2,4 516.312 Grants to provide legal services for tenants in eviction actions.
6(1) The department shall establish and administer a grant program to provide funds

1to attorneys or law firms to provide legal services to tenants in eviction actions and
2actions in which a tenant alleges that the tenant was excluded, forcibly evicted, or
3constructively evicted from the tenant's dwelling unit other than by an eviction
4procedure under ch. 799.
AB1191,2,6 5(2) (a) The department shall promulgate rules for awarding grants under sub.
6(1).
AB1191,2,107 (b) The rules promulgated under par. (a) shall require that the recipient of a
8grant may provide the legal services under sub. (1) only to a tenant whose family
9income is at or below 200 percent of the federal poverty line, as defined under 42 USC
109902
(2), for a family the size of the tenant's family.

AB1191,4 16Section 4. Effective date.
AB1191,2,1817 (1) This act takes effect on the day after publication or on the 2nd day after
18publication of the 2021 biennial budget act, whichever is later.
