TO SENATE BILL 811

SB811-SA1,1,11 At the locations indicated, amend the bill as follows:
SB811-SA1,1,3 21. Page 3, line 5: delete “(2) A nonprofit" and substitute “(2) (a) Subject to par.
3(b) and sub. (2m), a nonprofit".
SB811-SA1,1,4 42. Page 3, line 6: after that line insert:
SB811-SA1,1,7 5“(b) No nonprofit agricultural organization may provide health benefit
6coverage unless the nonprofit agricultural organization offers health benefit
7coverage to its members in every county in the state.
SB811-SA1,1,13 8(2m) (a) Before a nonprofit agricultural organization may provide health
9benefit coverage under sub. (2), the nonprofit agricultural organization shall file
10with the commissioner of insurance an attestation that the nonprofit agricultural
11organization qualifies as a nonprofit agricultural organization and that the
12nonprofit agricultural organization will offer health benefit coverage consistent with
13this section.

1(b) Any nonprofit agricultural organization that offers to provide health benefit
2coverage under sub. (2) shall, no later than one year after filing an attestation under
3par. (a) and annually thereafter, file with the commissioner of insurance a signed
4opinion of a qualified actuary that the financial reserves of the nonprofit agricultural
5organization and any affiliated entities of the nonprofit agricultural organization are
6sufficient and conform to appropriate actuarial standards. Any nonprofit
7agricultural organization that fails to file a signed opinion pursuant to this
8paragraph may not provide health benefit coverage under sub. (2) until the nonprofit
9agricultural organization comes into compliance with this paragraph.”.
SB811-SA1,2,10 103. Page 3, line 24: after that line insert:
SB811-SA1,2,16 11(7) A nonprofit agricultural organization that offers to provide health benefit
12coverage under sub. (2) shall adopt a process for members to file and resolve
13complaints related to health benefit coverage that is, to the greatest extent
14practicable, consistent with the process for health insurance consumers to file and
15resolve complaints related to health insurance coverage with the office of the
16commissioner of insurance.”.
