17education program that is approved by the board and that prepares the applicant for
18the practice of advanced practice registered nursing in one of the 4 recognized roles,
19and the applicant holds a current certification by a national certifying body approved
20by the board.
SB70-SSA2-SA1,371,2421 b. On January 1, 2023, the applicant was licensed as a registered nurse in this
22state and was practicing in a recognized role, and the applicant satisfies additional
23criteria established by the board by rule under sub. (6) (a) 3. relating to practice,
24education, or certification.

2under sub. (3m) (i), current evidence that the person satisfies each of the
3requirements under par. (a) 1., 2., 5. a., and 7. that apply with respect to the person,
4and any other information that the board requires by rule, with the applicable
5renewal fee determined by the department under s. 440.03 (9) (a). The board shall
6grant to a person who satisfies the requirements under this paragraph the renewal
7of his or her advanced practice registered nurse license and specialty designations
8granted under par. (b) 1. and shall, if the person holds a license under s. 441.06 (1),
9(1c), or (1m), also grant the renewal of that license.
SB70-SSA2-SA1,374,13 10(2) Prescribing authority. (a) Except as provided in par. (b), an advanced
11practice registered nurse may issue prescription orders, subject to the rules
12promulgated under sub. (6) (a) 1. and 4., and may provide expedited partner therapy
13in the manner described in s. 441.092.

15a notation under sub. (1) (b) 4. indicating that the advanced practice registered nurse

SB70-SSA2-SA1,375,23 20(3m) Practice requirements and limitations. (a) 1. An advanced practice
21registered nurse licensed under this section may, except as provided in subd. 2. and
22par. (b), practice advanced practice registered nursing only in collaboration with a
23physician or dentist.
SB70-SSA2-SA1,375,2524 2. Subdivision 1. does not apply to an advanced practice registered nurse with
25a certified nurse-midwife specialty designation.

1(b) An advanced practice registered nurse to whom par. (a) 1. applies may,

3nursing in a recognized role without being supervised by or collaborating with, and
4independent of, a physician or dentist if the board verifies, upon application of the
5advanced practice registered nurse, that the advanced practice registered nurse
6satisfies all of the following:
SB70-SSA2-SA1,376,137 1. The advanced practice registered nurse has, except as provided in subd. 3.,
8completed 3,840 hours of professional nursing in a clinical setting. Clinical hours
9completed as a requirement of a nursing program offered by a qualifying school of
10nursing described under s. 441.06 (1) (c) may be used to satisfy the requirement
11under this subdivision. Hours completed to satisfy a requirement of an education
12program described in sub. (1) (a) 2. a. may not be used to satisfy the requirement
13under this subdivision.
SB70-SSA2-SA1,376,1614 2. At least 24 months have elapsed since the advanced practice registered nurse
15first began completing the clinical hours required by a nursing program described
16under subd. 1.
SB70-SSA2-SA1,376,2517 3. The advanced practice registered nurse has completed 3,840 clinical hours
18of advanced practice registered nursing practice in that recognized role while
19working with a physician or dentist who was immediately available for consultation
20and accepted responsibility for the actions of the advanced practice registered nurse
21during those 3,840 hours of practice. The advanced practice registered nurse may
22substitute additional hours of advanced practice registered nursing working with a
23physician or dentist described in this subdivision to count toward the requirement
24under subd. 1. Each such additional hour shall count toward one hour of the
25requirement under subd. 1.

14. At least 24 months have elapsed since the advanced practice registered nurse
2first began practicing advanced practice registered nursing in that recognized role
3as described in subd. 3.
SB70-SSA2-SA1,377,74 (c) For purposes of par. (b) 3., hours of advanced practice registered nursing
5practice may include the lawful practice of advanced practice registered nursing
6outside this state or the lawful practice of advanced practice registered nursing in
7this state prior to the effective date of this paragraph .... [LRB inserts date].
SB70-SSA2-SA1,377,138 (d) 1. An advanced practice registered nurse may provide pain management
9services only while working in a collaborative relationship with a physician who,
10through education, training, and experience, specializes in pain management.
11Except as provided in subd. 2., this subdivision applies regardless of whether the
12advanced practice registered nurse has qualified for independent practice under par.
13(b).
SB70-SSA2-SA1,377,1714 2. Except as provided in par. (f), subd. 1. does not apply to an advanced practice
15registered nurse who is providing pain management services in a hospital, as defined
16in s. 50.33 (2), or a clinic associated with a hospital, and who has qualified for
17independent practice under par. (b).
SB70-SSA2-SA1,377,2318 (e) For purposes of pars. (a) 1. and (d) 1., a collaborative relationship is a process
19in which an advanced practice registered nurse is working with a physician or
20dentist, in each other's presence when necessary, to deliver health care services
21within the scope of the advanced practice registered nurse's training, education, and
22experience. The advanced practice registered nurse shall document such a
23collaborative relationship.
SB70-SSA2-SA1,378,224 (f) Nothing in this section prohibits an entity employing or with a relationship
25with an advanced practice registered nurse from establishing additional

1requirements for an advanced practice registered nurse as a condition of
2employment or relationship.
SB70-SSA2-SA1,378,83 (g) An advanced practice registered nurse shall adhere to professional
4standards when managing situations that are beyond the advanced practice
5registered nurse's expertise. If a particular patient's needs are beyond the advanced
6practice registered nurse's expertise, the advanced practice registered nurse shall,
7as warranted by the patient's needs, consult or collaborate with or refer the patient
8to at least one of the following:
SB70-SSA2-SA1,378,99 1. A physician licensed under ch. 448.
SB70-SSA2-SA1,378,1210 2. Another health care provider for whom the advanced practice registered
11nurse has reasonable evidence of having a scope of practice that includes the
12authorization to address the patient's needs.
SB70-SSA2-SA1,378,1913 (h) An advanced practice registered nurse licensed under this section may
14delegate a task or order to another clinically trained health care worker if the task
15or order is within the scope of the advanced practice registered nurse's practice, the
16advanced practice registered nurse is competent to perform the task or issue the
17order, and the advanced practice registered nurse has reasonable evidence that the
18health care worker is minimally competent to perform the task or issue the order
19under the circumstances.
SB70-SSA2-SA1,379,420 (i) An advanced practice registered nurse with a certified nurse-midwife
21specialty designation may not offer to deliver babies outside of a hospital setting
22unless the advanced practice registered nurse files with the board, and the board
23approves, a proactive plan for ensuring appropriate care or care transitions
24conforming with professional standards for patients with higher acuity or emergency
25care needs that exceed the advanced practice registered nurse's scope of practice. An

1advanced practice registered nurse who offers to deliver babies outside of a hospital
2setting shall file a plan under this paragraph when applying for an initial license
3under this section or a renewal of a license under this section, shall keep the plan
4current with the board, and shall follow the plan.
SB70-SSA2-SA1,379,9 5(4) Continuing education. Every advanced practice registered nurse shall
6submit to the board evidence of having completed at least 16 contact hours per
7biennium in clinical pharmacology or therapeutics relevant to the advanced practice
8registered nurse's area of practice. The board may promulgate rules regarding the
9continuing education requirements under this subsection.
SB70-SSA2-SA1,379,16 10(5) Malpractice liability insurance. No person may practice advanced
11practice registered nursing unless he or she at all times has in effect malpractice
12liability insurance coverage in the minimum amounts specified under s. 655.23 (4).
13An advanced practice registered nurse shall submit evidence of that coverage to the
14board when applying for an initial license under this section or a renewal of a license
15under this section. An advanced practice registered nurse shall also submit such
16evidence to the board upon request of the board.
SB70-SSA2-SA1,379,18 17(6) Rules. (a) The board shall promulgate rules necessary to administer this
18section, including rules for all of the following:
SB70-SSA2-SA1,379,2319 1. Further defining the scope of practice of an advanced practice registered
20nurse, practice of a certified nurse-midwife, practice of a certified registered nurse
21anesthetist, practice of a nurse practitioner, and practice of a clinical nurse specialist
22and defining the scope of practice within which an advanced practice registered
23nurse may issue prescription orders under sub. (2).

SB70-SSA2-SA1,380,1614 (b) The board may not promulgate rules that expand the scope of practice of an
15advanced practice registered nurse beyond the practices within advanced practice
16registered nursing.
SB70-SSA2-SA1,814 17Section 814. 441.092 of the statutes is created to read:
SB70-SSA2-SA1,380,18 18441.092 Expedited partner therapy. (1) In this section:
SB70-SSA2-SA1,380,1919 (b) “Antimicrobial drug" has the meaning given in s. 448.035 (1) (b).
SB70-SSA2-SA1,380,2020 (c) “Expedited partner therapy" has the meaning given in s. 448.035 (1) (c).
SB70-SSA2-SA1,381,7 21(2) Notwithstanding the requirements of s. 448.9785, an advanced practice
22registered nurse who may issue prescription orders under s. 441.09 (2) may provide
23expedited partner therapy if a patient is diagnosed as infected with a chlamydial
24infection, gonorrhea, or trichomoniasis and the patient has had sexual contact with
25a sexual partner during which the chlamydial infection, gonorrhea, or

1trichomoniasis may have been transmitted to or from the sexual partner. The
2advanced practice registered nurse shall attempt to obtain the name of the patient's
3sexual partner. A prescription order for an antimicrobial drug prepared under this
4subsection shall include the name and address of the patient's sexual partner, if
5known. If the advanced practice registered nurse is unable to obtain the name of the
6patient's sexual partner, the prescription order shall include, in ordinary, bold-faced
7capital letters, the words, “expedited partner therapy" or the letters “EPT."
SB70-SSA2-SA1,381,11 8(3) The advanced practice registered nurse shall provide the patient with a
9copy of the information sheet prepared by the department of health services under
10s. 46.03 (44) and shall request that the patient give the information sheet to the
11person with whom the patient had sexual contact.
SB70-SSA2-SA1,381,16 12(4) (a) Except as provided in par. (b), an advanced practice registered nurse is
13immune from civil liability for injury to or the death of a person who takes any
14antimicrobial drug if the antimicrobial drug is prescribed, dispensed, or furnished
15under this section and if expedited partner therapy is provided as specified under
16this section.
SB70-SSA2-SA1,381,2017 (b) The immunity under par. (a) does not extend to the donation, distribution,
18furnishing, or dispensing of an antimicrobial drug by an advanced practice
19registered nurse whose act or omission involves reckless, wanton, or intentional
20misconduct.
SB70-SSA2-SA1,815 21Section 815. 441.10 (6) of the statutes is amended to read:
SB70-SSA2-SA1,382,522 441.10 (6) On or before the applicable renewal date specified determined by the

under s. 440.08 (2) (a), a licensed practical nurse practicing for
24compensation shall submit to the board, on forms furnished by the department, an
25application for license renewal, together with a statement giving name, residence,

1nature and extent of practice as a licensed practical nurse during the prior year and
2prior unreported years, the nursing workforce survey and fee required under s.
3441.01 (7),
and other facts bearing upon current competency that the board requires,
4accompanied by the applicable license renewal fee determined by the department
5under s. 440.03 (9) (a).
SB70-SSA2-SA1,816 6Section 816. 441.10 (7) of the statutes is amended to read:
SB70-SSA2-SA1,382,197 441.10 (7) No license is required for practical nursing, but, except as provided
8in s. 257.03, no person without a license may hold himself or herself out as a licensed
9practical nurse or licensed attendant, use the title or letters “Trained Practical
10Nurse" or “T.P.N.", “Licensed Practical Nurse" or “L.P.N.", “ Licensed Attendant" or
11“L.A.", “Trained Attendant" or “T.A.", or otherwise seek to indicate that he or she is
12a licensed practical nurse or licensed attendant. No licensed practical nurse or
13licensed attendant may use the title, or otherwise seek to act as a registered, licensed,
14graduate or professional nurse. Anyone violating this subsection shall be subject to
15the penalties prescribed by s. 441.13. The board shall grant without examination a
16license as a licensed practical nurse to any person who was on July 1, 1949, a licensed
17attendant.
This subsection does not apply to any licensed practical nurse who holds
18a multistate license, as defined in s. 441.51 (2) (h), issued by a jurisdiction, other than
19this state, that has adopted the nurse licensure compact under s. 441.51.
SB70-SSA2-SA1,817 20Section 817. 441.11 (title) of the statutes is repealed.
SB70-SSA2-SA1,818 21Section 818. 441.11 (1) of the statutes is repealed.
SB70-SSA2-SA1,819 22Section 819. 441.11 (2) of the statutes is renumbered 441.09 (5m) and
23amended to read:

SB70-SSA2-SA1,821 6Section 821 . 441.15 of the statutes, as affected by 2023 Wisconsin Act .... (this
7act), is repealed.
SB70-SSA2-SA1,164e 8Section 164e. 441.15 (3) (b) of the statutes is amended to read:

under s. 440.08 (2) (a), a person issued a license under par. (a) and
11practicing nurse-midwifery shall submit to the board on furnished forms a
12statement giving his or her name, residence, and other information that the board
13requires by rule, with the applicable renewal fee determined by the department
14under s. 440.03 (9) (a). If applicable, the person shall also submit evidence
15satisfactory to the board that he or she has in effect the malpractice liability
16insurance required under the rules promulgated under sub. (5) (bm). The board shall
17grant to a person who pays the fee determined by the department under s. 440.03 (9)
18(a) for renewal of a license to practice nurse-midwifery and who satisfies the
19requirements of this paragraph the renewal of his or her license to practice
20nurse-midwifery and the renewal of his or her license to practice as a registered
21nurse.
SB70-SSA2-SA1,822 22Section 822. 441.16 of the statutes is repealed.
SB70-SSA2-SA1,823 23Section 823. 441.18 (2) (a) (intro.) of the statutes is amended to read:

4antagonist is prescribed has or has the capacity to provide the knowledge and
5training necessary to safely administer the opioid antagonist to an individual
6undergoing an opioid-related overdose and that the person demonstrates the
7capacity to ensure that any individual to whom the person further delivers the opioid
8antagonist has or receives that knowledge and training.
SB70-SSA2-SA1,825 9Section 825. 441.18 (3) of the statutes is amended to read:
SB70-SSA2-SA1,384,1510 441.18 (3) An advanced practice registered nurse who, acting in good faith,
11prescribes or delivers an opioid antagonist in accordance with sub. (2), or who, acting
12in good faith, otherwise lawfully prescribes or dispenses an opioid antagonist, shall
13be immune from criminal or civil liability and may not be subject to professional
14discipline under s. 441.07 for any outcomes resulting from prescribing, delivering,
15or dispensing the opioid antagonist.
SB70-SSA2-SA1,826 16Section 826. 441.19 of the statutes is repealed.
