AB251-ASA1-AA1,1,11 At the locations indicated, amend the substitute amendment as follows:
AB251-ASA1-AA1,1,4 21. Page 1, line 1: delete the material beginning with “a tier" and ending with
3“Instruction" on line 2 and substitute “services provided by clinically trained mental
4health professionals in public schools”.
AB251-ASA1-AA1,1,6 52. Page 1, line 3: after “Instruction" insert “and by the Marriage and Family
6Therapy, Professional Counseling, and Social Work Examining Board".
AB251-ASA1-AA1,1,7 73. Page 1, line 4: before that line insert:
AB251-ASA1-AA1,1,8 8 Section 1. 120.12 (22m) of the statutes is created to read:
AB251-ASA1-AA1,2,29 120.12 (22m) Clinically trained mental health professional; services.
10Adopt a policy on pupil access to services provided by an individual who holds a
11clinically trained mental health professional license issued by the department. A

1school board shall include in a policy under this subsection at least all of the
2following:
AB251-ASA1-AA1,2,63 (a) Before a pupil obtains services, the school board shall notify the pupil's
4parent or guardian that a clinically trained mental health professional provides
5services to pupils in the school district. The notice shall include a description of the
6clinically trained mental health professional's scope of practice.
AB251-ASA1-AA1,2,87 (b) A requirement that the parent or guardian consent to the pupil obtaining
8services from a clinically trained mental health professional.
AB251-ASA1-AA1,2,169 (c) An agreement between the pupil's parent or guardian, the pupil's school,
10and the clinically trained mental health professional who will provide services to the
11pupil that clearly states the extent to which the parent or guardian may access
12information and records related to services provided to the pupil. Unless the parties
13agree otherwise, the clinically trained mental health professional shall agree to
14provide the pupil's parent or guardian with the most access allowed under state and
15federal law, including providing the parent or guardian with information related to
16providing a referral to the pupil for a health care provider.
AB251-ASA1-AA1,2,1817 (d) An opportunity for an adult pupil or the parent or guardian of a minor pupil
18to opt out of the policy.
AB251-ASA1-AA1,1m 19Section 1m. MPSW 20.02 (32) of the administrative code is created to read:
AB251-ASA1-AA1,2,2120 MPSW 20.02 (32) Violating an agreement with a school and a pupil's parent
21or guardian under s. 120.12 (22m).”.
