21Section 7 . 440.08 (2) (a) 1n., 2n., 3n. and 4n. of the statutes are created to read:
22 440.08 (2) (a) 1n. Beginning with the first renewal after the initial issuance of
23a credential, the credential may be renewed every 4 years as provided in this
24paragraph.
25 2n. General renewal dates shall be as specified in par. (ag).

13n. The department may, if practical and expedient, stagger renewal dates
2among credential holders so that approximately half of renewals occur every 2 years.

5Section 8 . 440.08 (2) (ag) (intro.) of the statutes is created to read:

8Section 9 . 440.08 (2) (ar) of the statutes is created to read:
9 440.08 (2) (ar) 1. Notwithstanding pars. (a), (ag), and (c) and chs. 440 to 480,
10the department may, in cooperation with credentialing boards, establish a system to
11transition credential holders from 2-year credential periods under chs. 440 to 480,
122021 stats., to 4-year credential periods by phasing in the application of par. (a). The
13department shall promulgate rules to implement any transition system established
14under this paragraph, which shall not allow for more than one 2-year renewal of a
15credential after the effective date of this subdivision .... [LRB inserts date].
16 2. a. Notwithstanding the requirement to pay the renewal fee under par. (c),
17a person who renews a credential for 2 years pursuant to the transition system
18established under this paragraph is required to pay only one-half of the renewal fee
19that applies to a person renewing a credential for 4 years.
20 b. Notwithstanding the fees for credential renewals approved under s. 440.03
21(9), if the department transitions credential holders from 2-year credential periods
22under chs. 440 to 480, 2021 stats., to 4-year credential periods before revised
23renewal fees can be approved under s. 440.03 (9), the department may double the
24applicable renewal fee until a revised fee can be approved under s. 440.03 (9).
25Section 10 . 440.08 (2) (b) of the statutes is amended to read:

1440.08 (2) (b) The renewal fee for an apprentice, journeyman, student or
2temporary credential is $10.
The renewal dates specified in par. (a) determined
3under pars. (a) to (ar)
do not apply to apprentice, journeyman, student or temporary
4credentials.
5Section 11 . 440.08 (2) (c) of the statutes is renumbered 440.08 (2m) (a) and
6amended to read:
7 440.08 (2m) (a) Except as provided in par. (e) (d) and sub. (3), renewal
8applications shall include the applicable renewal fee as determined by the
9department under s. 440.03 (9) (a) or as specified in par. (b).
10Section 12 . 440.08 (2) (d) of the statutes is renumbered 440.08 (2m) (c).

17Section 16. 440.08 (3m) of the statutes is created to read:
18 440.08 (3m) Continuing education. The department or the interested
19examining board or affiliated credentialing board, as appropriate, may, as provided
20in s. 440.20 (6), specify makeup continuing education requirements that must be
21completed in order for the holder of a credential who fails to complete continuing
22education requirements within a required period to be able to renew the credential,
23notwithstanding the failure.
24Section 17 . 440.08 (4) (a) of the statutes is amended to read:

1440.08 (4) (a) Generally. If the department or the interested examining board
2or affiliated credentialing board, as appropriate, determines that an applicant for
3renewal has failed to comply with sub. (2) (c) (2m) (a) or (3) or with any other
4applicable requirement for renewal established under chs. 440 to 480 or that the
5denial of an application for renewal of a credential is necessary to protect the public
6health, safety or welfare, the department, examining board or affiliated
7credentialing board may summarily deny the application for renewal by mailing to
8the holder of the credential a notice of denial that includes a statement of the facts
9or conduct that warrant the denial and a notice that the holder may, within 30 days
10after the date on which the notice of denial is mailed, file a written request with the
11department to have the denial reviewed at a hearing before the department, if the
12department issued the credential, or before the examining board or affiliated
13credentialing board that issued the credential.
14Section 18 . 440.09 (3) (a) of the statutes is amended to read:
15 440.09 (3) (a) A reciprocal credential granted under this section expires on the
16applicable renewal date specified in determined under s. 440.08 (2) (a), except that
17if the first renewal date specified in s. 440.08 (2) (a) after the date on which the
18credential is granted is within 180 365 days of the date on which the credential is
19granted, the credential expires on the 2nd renewal date specified in s. 440.08 (2) (a)
20after the date on which the credential is granted.
21Section 19. 440.20 (6) of the statutes is created to read:
22 440.20 (6) (a) The department or appropriate examining board, affiliated
23credentialing board, or board in the department may reprimand the holder of a
24credential or deny, limit, suspend, or revoke the credential of any person who fails
25to satisfy applicable continuing education requirements within a required period

1and may specify makeup continuing education requirements that must be completed
2in order to maintain his or her credential or to restore it to good standing.
3 (b) The grounds for discipline specified under par. (a) are in addition to any
4grounds for discipline specified in chs. 440 to 480.
5Section 20 . 440.26 (3) of the statutes is amended to read:
6 440.26 (3) Issuance of licenses; fees. Upon receipt and examination of an
7application executed under sub. (2), and after any investigation that it considers
8necessary, the department shall, if it determines that the applicant is qualified, grant
9the proper license upon payment of the initial credential fee determined by the
10department under s. 440.03 (9) (a). No license shall be issued for a longer period than
11 2 4 years, and the license of a private detective shall expire on the renewal date of
12the license of the private detective agency, even if the license of the private detective
13has not been in effect for a full 2 4 years. Renewals of the original licenses issued
14under this section shall be issued in accordance with renewal forms prescribed by the
15department and shall be accompanied by the applicable fees specified in s. 440.08 or
16determined by the department under s. 440.03 (9) (a). The department may not
17renew a license unless the applicant provides evidence that the applicant has in force
18at the time of renewal the bond or liability policy specified in this section.
19Section 21 . 440.26 (5m) (b) of the statutes is amended to read:
20 440.26 (5m) (b) The renewal dates for permits issued under this subsection are
21specified
shall be as determined under s. 440.08 (2) (a). Renewal applications shall
22be submitted to the department on a form provided by the department and shall
23include the renewal fee determined by the department under s. 440.03 (9) (a).
24Section 22 . 440.313 (1) of the statutes is amended to read:

1440.313 (1) The renewal date for licenses granted under this subchapter is

12department on a form provided by the department on or before the applicable
13renewal date specified determined under s. 440.08 (2) (a) and shall include the
14applicable renewal fee determined by the department under s. 440.03 (9) (a).
15Section 25 . 440.88 (4) of the statutes is amended to read:
16 440.88 (4) Applications; certification period. An application for certification
17as a substance abuse counselor, clinical supervisor, or prevention specialist under
18this section shall be made on a form provided by the department and filed with the
19department and shall be accompanied by the initial credential fee determined by the
20department under s. 440.03 (9) (a). The renewal date for certification as a substance
21abuse counselor, clinical supervisor, or prevention specialist is specified shall be as
22determined
under s. 440.08 (2) (a) and the renewal fee for such certifications is
23determined by the department under s. 440.03 (9) (a). Renewal of certification as a
24substance abuse counselor-in-training, a clinical supervisor-in-training, or a
25prevention specialist-in-training may be made only twice.
