SENATE AMENDMENT 2, TO SENATE BILL 682

SB682-SA2,1,1 At the locations indicated, amend the bill as follows:

SB682-SA2,1,2 1. Page 1, line 3: delete “for recorded" and substitute “for certain recorded".

SB682-SA2,1,4 2. Page 2, line 9: delete that line and substitute “purpose if any of the following applies:

SB682-SA2,1,5 1. The instrument is recorded on or after January 1, 1960.

SB682-SA2,1,8 2. An instrument is recorded before January 1, 1960, and a notice, the instrument, or an instrument expressly referring to the easement is recorded on or after January 1, 1960, and before the property is sold or transferred.

SB682-SA2,1,12 3. The instrument or instruments expressly referring to the easement were recorded before January 1, 1960, and it is apparent from or can be proved from physical evidence of its use at such time when a person acquired the real estate subject to the easement.”.

SB682-SA2,2,2 3. Page 2, line 13: after “this subsection" insert “unless a final judgment has been entered resolving the action, defense, or counterclaim".
