AB68-SSA1,56 Section 56. 13.94 (1) (e) of the statutes is amended to read:

AB68-SSA1,35,10 13.94 (1) (e) Make such special examinations of the accounts and financial transactions of any department, agency, or officer as the legislature, joint legislative audit committee, or joint committee on legislative organization directs. Examinations of the accounts and transactions of a county, city, village, town, or, subject to par. (os), of a school district, may be performed only as authorized in par. (m).

AB68-SSA1,57 Section 57. 13.94 (1) (os) of the statutes is repealed.

AB68-SSA1,58 Section 58. 13.94 (1s) (a) of the statutes is amended to read:

AB68-SSA1,35,18 13.94 (1s) (a) Except as otherwise provided in par. (c), the legislative audit bureau may charge any department for the reasonable cost of auditing services performed at the request of a department or at the request of the federal government that the bureau is not required to perform under sub. (1) (b) or (c) or any other law. This paragraph does not apply to counties, cities, villages, towns, or school districts or to the opportunity schools and partnership programs under sub. (1) (os).

AB68-SSA1,59 Section 59 . 14.46 of the statutes is created to read:

AB68-SSA1,35,25 14.46 Assistant secretary of state. The secretary of state may appoint an assistant secretary of state who may perform and execute any duty or power of the secretary of state, except duties and powers the secretary of state performs as a member of the board of commissioners of public lands. The assistant secretary of state shall take and file the official oath and shall file an official bond in the sum and with the conditions as the secretary of state prescribes.

AB68-SSA1,60 Section 60. 15.01 (6) of the statutes is amended to read:

AB68-SSA1,36,13 15.01 (6) “Division," “bureau," “section," and “unit" means the subunits of a department or an independent agency, whether specifically created by law or created by the head of the department or the independent agency for the more economic and efficient administration and operation of the programs assigned to the department or independent agency. The office of credit unions and the office of the student loan ombudsman in the department of financial institutions, the office of the inspector general in the department of children and families, the office of the inspector general in the department of health services, and the office of children's mental health in the department of health services have the meaning of “division" under this subsection. The office of the long-term care ombudsman under the board on aging and long-term care and the office of educational accountability in the department of public instruction have the meaning of “bureau" under this subsection.

AB68-SSA1,61 Section 61. 15.02 (1) of the statutes is amended to read:

AB68-SSA1,36,18 15.02 (1) Separate constitutional offices. The governor, lieutenant governor, secretary of state, and state treasurer each head a staff to be termed the “office" of the respective constitutional officer. Each of those offices shall be attached to the department of administration under s. 15.03.

AB68-SSA1,62 Section 62. 15.02 (3) (c) 1. of the statutes is amended to read:

AB68-SSA1,37,2 15.02 (3) (c) 1. The principal subunit of the department is the “division". Each division shall be headed by an “administrator". The office of credit unions and the office of the student loan ombudsman in the department of financial institutions and the office of children's mental health in the department of health services have the meaning of “division" and the director of credit unions in the department of financial institutions and the director of the office of children's mental health in the department of health services have the meaning of “administrator" under this subdivision.

AB68-SSA1,63 Section 63. 15.03 of the statutes is amended to read:

AB68-SSA1,37,19 15.03 Attachment for limited purposes. Any division, office, commission, council, or board attached under this section to a department or independent agency or a specified division thereof or constitutional office shall be a distinct unit of that department, independent agency, or specified division or constitutional office. Any division, office, commission, council, or board so attached shall exercise its powers, duties, and functions prescribed by law, including rule making, licensing and regulation, and operational planning within the area of program responsibility of the division, office, commission, council, or board, independently of the head of the department or independent agency, but budgeting, program coordination , and related management functions shall be performed under the direction and supervision of the head of the department or independent agency, except that with respect to the office of the commissioner of railroads, all personnel and biennial budget requests by the office of the commissioner of railroads shall be provided to the department of transportation as required under s. 189.02 (7) and shall be processed and properly forwarded by the public service commission without change except as requested and concurred in by the office of the commissioner of railroads.

AB68-SSA1,39,25 (bm) Board member status. Any member of the employee trust funds board who loses the status upon which the appointment or election was based shall cease to be a member of the board upon appointment or election to the board of a qualified successor.

AB68-SSA1,40,5 (cm) Membership. The employee trust funds board shall consist of the governor or the governor's designee on the group insurance board, the administrator of the division of personnel management in the department of administration or the administrator's designee, and 11 individuals appointed or elected for 4-year terms as follows:

AB68-SSA1,40,7 1. To represent the interests of annuitants and participating employees, the following individuals:

AB68-SSA1,40,11 a. One member who is a participating employee and who is a public school teacher, elected by participating employees meeting the same criteria. The member elected under this subd. 1. a. may not be from the same county as the member appointed under subd. 2. e.

AB68-SSA1,40,13 b. One member who is an annuitant and who retired from covered service, elected by annuitants meeting the same criteria.

AB68-SSA1,40,15 c. One member who is an annuitant and who retired from covered service as a public school teacher, elected by annuitants.

AB68-SSA1,40,18 d. One member who is a protective occupation participant or who retired from a protective occupation, elected by protective occupation participants meeting the same criteria.

AB68-SSA1,40,21 e. One member who is a participating employee and who is an educational support personnel employee, elected by participating employees meeting the same criteria.

AB68-SSA1,40,24 2. To represent the interests of participating employers, elected officials, municipal employers, and administrators, the following individuals, appointed by the governor:

AB68-SSA1,41,2 a. One member who is a participating employee and who is an employee of the University of Wisconsin System or a state employee.

AB68-SSA1,41,4 b. One member who is a participating employee and who is an administrator of a public school in this state.

AB68-SSA1,41,6 c. One member who is a participating employee and who is an elected member of the governing body of a municipal employer that is a participating employer.

AB68-SSA1,41,9 d. One member who is a participating employee as an administrator of a municipal employer that is a participating employer and who is not employed by a public school district.

AB68-SSA1,41,12 e. One member who is a participating employee and who is a public school teacher. The member appointed under this subd. 2. e. may not be from the same county as the member appointed under subd. 1. a.

AB68-SSA1,41,19 3. One member who is elected by participating employees and is a public member and who is not a participant in or beneficiary of the Wisconsin Retirement System, with experience in actuarial analysis, audit functions, or finance related to an employee benefit plan or experience with significant administrative responsibility for a major insurer. It is the intent of the legislature that the member elected under this subdivision shall represent the interests of the taxpayers of this state and shall not be representative of public employee or employer interests.

AB68-SSA1,74 Section 74 . 15.165 (title) of the statutes is amended to read:

AB68-SSA1,41,21 15.165 (title) Same; attached boards and offices.

AB68-SSA1,75 Section 75 . 15.165 (1) (b) of the statutes is amended to read:

AB68-SSA1,42,2 15.165 (1) (b) For purposes of this section, annuitants are deemed to be employees in the last position in which they were covered by the Wisconsin retirement system, except that annuitants may not be elected, appointed or vote under sub. (3) (a) 1., 2., 4. or 7.

AB68-SSA1,76 Section 76 . 15.165 (3) of the statutes is repealed.

AB68-SSA1,77 Section 77 . 15.165 (5) of the statutes is created to read:

AB68-SSA1,42,9 15.165 (5) Office of internal audit. There is created an office of internal audit that is attached to the department of employee trust funds under s. 15.03. The office shall be under the direction and supervision of an internal auditor who shall be appointed by the employee trust funds board in the classified service. The internal auditor shall report directly to the employee trust funds board.

AB68-SSA1,42,14 15.185 (4) Small business retirement savings board. (a) There is created a small business retirement savings board that is attached to the department of financial institutions under s. 15.03. The board shall consist of the following members:

AB68-SSA1,42,15 1. The state treasurer or his or her designee.

AB68-SSA1,42,16 2. The secretary of financial institutions or his or her designee.

AB68-SSA1,42,19 3. One member who has a favorable reputation for skill, knowledge, and experience in the field of retirement saving and investments, appointed by the governor.

AB68-SSA1,42,21 4. One member who has a favorable reputation for skill, knowledge, and experience relating to small business, appointed by the governor.

AB68-SSA1,42,25 5. One member who is a representative of an association representing employees or who has a favorable reputation for skill, knowledge, and experience in the interests of employees in retirement saving, appointed by the speaker of the assembly.

AB68-SSA1,43,3 6. One member who has a favorable reputation for skill, knowledge, and experience in the interests of employers in retirement saving, appointed by the president of the senate.

AB68-SSA1,43,6 7. One member who has a favorable reputation for skill, knowledge, and experience in retirement investment products or retirement plan designs, appointed by the state treasurer.

AB68-SSA1,43,7 8. One member appointed by the investment board.

AB68-SSA1,43,9 9. One member appointed, notwithstanding s. 15.07 (4), by a majority vote of all of the members identified in subds. 1. to 8.

AB68-SSA1,43,10 (b) The members under par. (a) 3. to 9. shall be appointed for 4-year terms.
