AB68-ASA2,356,73 (b) Employee status. An employee transferred under par. (a ) has all the rights
4and the same status under ch. 230 in the department of transportation that the
5employee enjoyed in the department of administration before the transfer.
6Notwithstanding s. 230.28 (4), no employee transferred under par. (a) who has
7attained permanent status in class is required to serve a probationary period.
AB68-ASA2,356,158 (2) Department of workforce development clearing account deficit. The
9department of administration shall identify amounts from general purpose revenue
10appropriations to executive branch state agencies in fiscal year 2021-22 that can be
11used to reconcile the unresolved clearing account deficit reported by the department
12of workforce development at the close of the 2019-20 fiscal year. The department of
13workforce development and the department of administration shall submit a request
14under s. 13.101 (4) to transfer the amounts so identified in this subsection to the
15appropriation under s. 20.445 (1) (a) no later than March 1, 2022.
AB68-ASA2,356,1916 (3) Assistant district attorneys; pay progression. Notwithstanding s. 230.12
17(10) (c), any pay progression adjustment for assistant district attorneys made during
18the 2021-23 fiscal biennium shall be made in the first pay period that occurs after
19January 1, 2022 and January 1, 2023.
AB68-ASA2,356,2320 (4) Assistant state public defenders; pay progression. Notwithstanding s.
21230.12 (11) (c), any pay progression adjustment for assistant state public defenders
22made during the 2021-23 fiscal biennium shall be made in the first pay period that
23occurs after January 1, 2022 and January 1, 2023.
AB68-ASA2,356,2524 (5) Supplemental pay plans for correctional officers and correctional
25sergeants during the 2021-23 fiscal biennium.

1(a) The administrator of the division of personnel management in the
2department of administration shall include in the compensation plan under s. 230.12
3for the 2021-23 fiscal biennium supplemental pay of $5 per hour worked for
4correctional officers and correctional sergeants at any adult correctional institution
5with a vacancy rate among correctional officers and correctional sergeants of more
6than 40 percent, as determined by the administrator of the division of personnel
7management in the department of administration. If a correctional institution that
8has provided supplemental pay under this paragraph has a vacancy rate among
9correctional officers and correctional sergeants of 40 percent or less, as determined
10by the administrator of the division of personnel management in the department of
11administration, for 6 consecutive months, the provision of supplemental pay under
12this paragraph shall be suspended. If the vacancy rate among correctional officers
13and correctional sergeants at a correctional institution that has suspended
14supplemental pay under this paragraph increases to more than 40 percent, as
15determined by the administrator of the division of personnel management in the
16department of administration, supplemental pay under this paragraph shall be
17reinstated.
AB68-ASA2,357,2418 (b) If, on the effective date of this paragraph, the compensation plan under s.
19230.12 has been adopted for the 2021-23 biennium and the compensation plan does
20not include the supplemental pay required under par. (a ), by no later than 30 days
21after the effective date of this paragraph, the administrator of the division of
22personnel management in the department of administration shall propose an
23amendment under s. 230.12 (3) (c) to include the supplemental pay required under
24par. (a) in the compensation plan for the 2021-23 biennium.

AB68-ASA2,358,83 (1) Submission of plan. The department of agriculture, trade and consumer
4protection and the Wisconsin Economic Development Corporation shall jointly
5submit to the cochairpersons of the joint committee on finance a proposal for
6allocating $5,000,000 over 5 years to pursue an increase in dairy, meat, poultry, fish,
7crop, and other agricultural product exports by 25 percent over their 2021 levels by
82026.
AB68-ASA2,358,149 (2) Hemp program report. The department of agriculture, trade and consumer
10protection shall study options for resolving the deficit in the hemp program under
11s. 94.55, including modifying fees, relinquishing operations to the U.S. department
12of agriculture, and restructuring program operations. No later than March 30, 2022,
13the department shall report to the cochairpersons of the joint committee on finance
14the department's recommendations for resolving the hemp program deficit.

17building commission may not make a grant to Historic Haymarket Milwaukee, LLC,
18for the construction of a museum of nature and culture, as enumerated in sub. (1) (j),
19under s. 13.48 (42m), unless the department of administration has reviewed and
20approved plans for the project. Notwithstanding ss. 16.85 (1) and 16.855 (1m), the
21department of administration may not supervise any services or work or let any
22contract for the project. Section 16.87 does not apply to the project.
AB68-ASA2,384,223 (11) Wisconsin History Museum. From the appropriation under s. 20.867 (2)
24(r), the building commission may expend up to $4,000,000 for project planning,

AB68-ASA2,384,93 (12) Psychiatric and behavioral health beds. Notwithstanding s. 13.48 (20t)
4(b), the building commission may not make a grant to an organization for renovation
5of an existing mental health facility in Marathon County, as enumerated in sub. (1)
6(k), under s. 13.48 (20t), unless the department of administration has reviewed and
7approved plans for the project. Notwithstanding ss. 16.85 (1) and 16.855 (1m), the
8department of administration may not supervise any services or work or let any
9contract for the project. Section 16.87 does not apply to the project.
AB68-ASA2,384,1010 (13) Grant for psychiatric beds.
AB68-ASA2,384,1711 (a) The legislature finds and determines that expanding psychiatric bed
12capacity as described in par. (b ) would greatly benefit state residents by expanding
13access to timely inpatient mental health treatment and services and allowing public
14financial resources to be better distributed to more effectively improve delivery of
15mental health services. It is therefore in the public interest, and it is the public policy
16of this state, to assist the health system described under par. (b) in expanding
17psychiatric bed capacity.
AB68-ASA2,384,2018 (b) In fiscal year 2021-22, the building commission shall award a grant in the
19amount of $15,000,000 to a health system that applies to the commission and meets
20all of the following criteria:
AB68-ASA2,384,23 211. The health system has a hospital that is located in Eau Claire County, south
22of the Chippewa River, and northeast of the intersection of STH 37 and USH 12 and
23has a hospital in Chippewa County.
AB68-ASA2,385,6 242. The health system agrees to expand psychiatric bed capacity by 22 beds
25between the Eau Claire County hospital and the Chippewa County hospital. A

1hospital shall give preference in admissions to fill beds added under this subdivision
2to individuals who meet the criteria for emergency detention under s. 51.15 and who
3are from Ashland, Barron, Bayfield, Buffalo, Burnett, Chippewa, Clark, Douglas,
4Dunn, Eau Claire, Iron, Jackson, La Crosse, Lincoln, Marathon, Monroe, Oneida,
5Pepin, Pierce, Polk, Price, Rusk, Sawyer, St. Croix, Taylor, Trempealeau, Vilas,
6Washburn, or Wood Counties.
AB68-ASA2,385,9 73. The health system identifies measures that it believes will serve the needs
8of area residents with mental health needs, especially, as a critical component of the
9measures, in reducing the burden on the Winnebago Mental Health Institute.
AB68-ASA2,385,13 104. The health system agrees to annually report to the legislature, in the manner
11described under s. 13.172 (2), the services provided with the resources funded by the
12grant awarded under this subsection, including the number of individuals diverted
13from the Winnebago Mental Health Institute.
AB68-ASA2,385,18 145. The health system recognizes that it is liable to repay the grant funds to the
15state if it fails to continue to maintain the expanded services and number of
16expanded psychiatric beds available. The amount the health system is liable for
17repayment is reduced proportionately each year for 10 years of continuing expanded
18services as described under par. (c ).
AB68-ASA2,385,2019 (c) A determination of continued services shall be based on findings that the
20health system does all of the following:
AB68-ASA2,385,25 211. Maintains an agreed upon number of beds for acceptance of admissions for
22emergency detention under s. 51.15. The health system is considered to be in
23compliance with this subdivision if at least half of the expanded psychiatric beds
24under par. (b) 2. are available for individuals who are initially admitted under an
25emergency detention under s. 51.15.

12. Enters into a contract with, at minimum, two-thirds of the counties specified
2in par. (b) 2. in which at least one of the hospitals agrees to do all of the following:
AB68-ASA2,386,4 3a. Be the primary receiver for individuals under an emergency detention under
4s. 51.15 for the county.
AB68-ASA2,386,6 5b. Accept for admission under an emergency detention individuals regardless
6of payment source.
AB68-ASA2,386,9 7c. Accept any individual subject to an emergency detention from the county
8unless all psychiatric beds added under par. (b ) 2. are filled. The hospital may set
9its payment rate based on the acuity of the individual being detained.
AB68-ASA2,386,11 10d. Ensure the county department is the secondary payer after any other
11coverage the individual has is exhausted.
AB68-ASA2,386,1312 (d) Notwithstanding s. 150.93, any hospital that expands psychiatric bed
13capacity under this subsection may increase its approved bed capacity.
AB68-ASA2,386,1514 (14) Transfer to the state building trust fund. There is transferred from the
15general fund to the state building trust fund $15,000,000 in fiscal year 2021-22.
AB68-ASA2,9106 16Section 9106. Nonstatutory provisions; Children and Families.
AB68-ASA2,386,2217 (1) Adoption recruitment services for children with special needs. In each
18year of the 2021-23 fiscal biennium, the department of children and families shall
19provide $300,000 from the appropriations under s. 20.437 (1) (cx) and (mx) to the
20Wendy's Wonderful Kids program at the Children's Hospital of Wisconsin to recruit
21adoptive placements for children with special needs in a county with a population of
22750,000 or more.
AB68-ASA2,9107 23Section 9107. Nonstatutory provisions; Circuit Courts.
AB68-ASA2,387,224 (1) Circuit courts designated to begin operation in 2021. The circuit court
25branches added in s. 753.06 (4) (a), (7) (e), (9) (g), and (10) (f), are the additional

1branches authorized to be added and allocated by the director of state courts under
2s. 753.0605 (1) to begin operation on August 1, 2021.
AB68-ASA2,9119 3Section 9119. Nonstatutory provisions; Health Services.
AB68-ASA2,387,44 (1) Position transfer to the department of administration.
AB68-ASA2,387,85 (a) Employee transfer. On the effective date of this paragraph, 1.0 FTE position
6classified as equal opportunity specialist—senior in the department of health
7services and the incumbent employee holding that position is transferred to the
8department of administration.
AB68-ASA2,387,139 (b) Employee status. An employee transferred under par. (a ) has all the rights

AB68-ASA2,387,1914 (2) Surgical quality improvement grant. From the appropriation under s.
1520.435 (1) (b), the department of health services may award a onetime grant of
16$335,000 in fiscal year 2021-22 to support surgical quality improvement activities.
17Notwithstanding ss. 20.001 (3) (a) and 20.002 (1), the department of health services
18may transfer moneys appropriated for the purpose described under this subsection
19from fiscal year 2021-22 to fiscal year 2022-23.
AB68-ASA2,387,2020 (3) Grants for employer blood drives.
AB68-ASA2,387,2121 (a) Definitions. In this subsection:
AB68-ASA2,387,24 221. “Blood donation” means the voluntary and uncompensated donation of whole
23blood, or specific components of blood, by an employee of the organizing employer
24that is drawn for use by a nonprofit blood bank organization.
AB68-ASA2,388,3
12. “Blood drive” means a function that is held at a specific date and time, is
2organized by a nonprofit blood bank organization in coordination with an employer,
3and is open only to individuals who are employees of the employer.
AB68-ASA2,388,94 (b) Award. From the appropriation under s. 20.435 (1) (b), the department of
5health services shall award grants to employers who apply to the department to
6organize blood drives. The department shall award grants equal to $20 per blood
7donation. The department may not award more than $250,000 in grants in any fiscal
8year. The department may award a grant to an employer under this subsection only
9if the employer retains documentation of each blood donation.
AB68-ASA2,388,1010 (c) Duration. This subsection does not apply after June 30, 2023.
AB68-ASA2,388,1811 (4) Medical Assistance reimbursement for direct care. From the increase in
12reimbursement paid by the department of health services under the Medical
13Assistance program to nursing facilities and to intermediate care facilities for
14persons with an intellectual disability, the department shall increase by $20,000,000
15as the state share of payments, plus the matching federal share of payments, in fiscal
16year 2021-22 and by $20,000,000 as the state share of payments, plus the matching
17federal share of payments, in fiscal year 2022-23 payments to support the staff in
18those facilities who perform direct care to residents.
AB68-ASA2,389,219 (5) Medical Assistance rate increase for nursing in home health agencies.
20For dates of services beginning January 1, 2022, the department of health services
21shall increase the Medical Assistance rates paid for nursing care in home health
22agencies that are licensed under s. 50.49 by a budgeted sum of $473,300 as the state
23share of payments, and provide the matching federal share of payments, in fiscal
24year 2021-22, and by a budgeted sum of $960,200, as the state share of payments,
25and provide the matching federal share of payments, in fiscal year 2022-23, to

1support licensed practical nurses, registered nurses, and nurse practitioners in those
2agencies.
AB68-ASA2,389,103 (6) Medical assistance reimbursement rate increase for direct care in
4personal care agencies.
The department of health services shall increase the
5Medical Assistance rates paid for direct care to agencies that provide personal care
6services by a budgeted sum of $7,584,400, as the state share of payments, and the
7matching federal share of payments, in fiscal year 2021-22, and by a budgeted sum
8of $23,557,700, as the state share of payments, and the matching federal share of
9payments, in fiscal year 2022-23, to support staff in those agencies who perform
10direct care.
AB68-ASA2,9125 11Section 9125. Nonstatutory provisions; Joint Committee on Finance.
AB68-ASA2,389,1812 (1) State aid; repeal of personal property taxes. The department of
13administration shall submit a request under s. 13.101 to the joint committee on
14finance to supplement the appropriation under s. 20.835 (1) (em) in 2022-23 to make
15payments to local taxing jurisdictions equal to the amount of revenues not collected
16by the local taxing jurisdictions because of the elimination of the personal property
17tax imposed under ch. 70, effective with January 1, 2022, assessments, in any
18legislation enacted during the 2021-22 legislative session.

AB68-ASA2,389,2220 (1) Required general fund structural balance. Section 20.003 (4m) shall not
21apply to the actions of the legislature in enacting any legislation during the 2021-22
