5“(cm) 1. In this paragraph, “nurse anesthetist” means an advanced practice

3. If an advanced practice registered nurse has not engaged in the practice of
12advanced practice registered nursing for at least 2 years' worth of full-time practice,
1the advanced practice registered nurse may not practice advanced practice
2registered nursing outside the context of an employment relationship with an

a. The nurse anesthetist may practice outside the context of an employment
5relationship with an employer if the nurse anesthetist is working in a collaborative
6relationship with a physician, a dentist, or another nurse anesthetist to whom this
7subdivision does not apply. The collaborative relationship is a process in which the
8nurse anesthetist is working with a physician, dentist, or another nurse anesthetist
9to whom this subdivision does not apply, in each other's presence when necessary, to
10deliver health care services within the scope of the nurse anesthetist's training,
11education, and experience. The nurse anesthetist shall document this relationship.

b. The advanced practice registered nurse may apply to the board for a written
13exemption from this subdivision. The board shall approve an application under this
14subd. 3. b. if the board determines that the advanced practice registered nurse
15satisfies education, training, or experience requirements established by the board by
16rule.

4. For purposes of subd. 3., practice of advanced practice registered nursing
18may include the lawful practice of advanced practice registered nursing outside this
19state or the lawful practice of advanced practice registered nursing in this state prior
