2023 WISCONSIN ACT 153
An Act to repeal 20.445 (1) (bk) and 106.276; to amend 20.445 (1) (bm); and to create 20.445 (1) (bk) and 106.276 of the statutes; relating to: a commercial driver training grant program.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
153,1Section 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated: 153,2Section 2. 20.445 (1) (bk) of the statutes is created to read: 20.445 (1) (bk) Commercial driver training grant program. The amounts in the schedule for the commercial driver training grant program under s. 106.276.
153,3Section 3. 20.445 (1) (bk) of the statutes, as created by 2023 Wisconsin Act .... (this act), is repealed. 153,4Section 4. 20.445 (1) (bm) of the statutes is amended to read: 20.445 (1) (bm) Workforce training; administration. Biennially, the amounts in the schedule for the administration of the local youth apprenticeship grant program under s. 106.13 (3m), the youth summer jobs program under s. 106.18, the employment transit assistance grant program under s. 106.26, the workforce training program under s. 106.27, the teacher development program grants under s. 106.272, the career and technical education incentive grant program under s. 106.273, the technical education equipment grant program under s. 106.275, the commercial driver training grant program under s. 106.276, and the apprentice programs under subch. I of ch. 106.
153,5Section 5. 20.445 (1) (bm) of the statutes, as affected by 2023 Wisconsin Act .... (this act), is amended to read: 20.445 (1) (bm) Workforce training; administration. Biennially, the amounts in the schedule for the administration of the local youth apprenticeship grant program under s. 106.13 (3m), the youth summer jobs program under s. 106.18, the employment transit assistance grant program under s. 106.26, the workforce training program under s. 106.27, the teacher development program grants under s. 106.272, the career and technical education incentive grant program under s. 106.273, the technical education equipment grant program under s. 106.275, the commercial driver training grant program under s. 106.276, and the apprentice programs under subch. I of ch. 106.
153,6Section 6. 106.276 of the statutes is created to read: 106.276 Commercial driver training grant program. (1) (a) The department shall establish and administer a commercial driver training grant program.
(b) A person that satisfies the eligibility requirements under par. (c) may apply to the department for a grant under this section. The department shall prescribe the form, nature, and extent of information that shall be contained in applications for grants under this section.
(c) An applicant is eligible for a grant under this section if all of the following are satisfied:
1. The applicant provides to an individual who resides in this state training in the operation of commercial motor vehicles that satisfies the requirements of 49 CFR part 380, subparts F and G.
2. The applicant is listed on the Training Provider Registry (TPR), as set forth in 49 CFR part 380, subpart G.
2m. The applicant has a facility in this state that is listed in the Training Provider Registry described in subd. 2., and the training described in subd. 1. is provided at or through that facility.
3. The individual for whom the applicant provides training under subd. 1. obtains an initial commercial driver license, as defined in s. 340.01 (7m), in this state after the effective date of this subdivision .... [LRB inserts date].
4. The application is received by the department before July 1, 2025.
(d) From the appropriation under s. 20.445 (1) (bk), the department may award grants to eligible applicants under par. (c). The amount of a grant under this section with regard to each individual trained may not exceed 50 percent of the costs of training the individual in the operation of commercial motor vehicles or $3,000, whichever is less.
(2) Before July 1 of each year, the department shall prepare a report summarizing the number and amount of grants awarded under sub. (1). The department shall submit the report to the appropriate standing committees of the legislature under s. 13.172 (3).
153,7Section 7. 106.276 of the statutes, as created by 2023 Wisconsin Act .... (this act), is repealed. 153,8Section 8. Effective dates. This act takes effect on the day after publication, except as follows: (1) The treatment of s. 20.445 (1) (bm) (by Section 5) and the repeal of ss. 20.445 (1) (bk) and 106.276 take effect July 1, 2025.
