Notice of Preliminary Hearing on Statement of Scope
The Department of Natural Resources (DNR) announces that it will hold a preliminary public hearing on Statement of Scope SS 047-22 (Board Order AM-05-22) relating to revisions to ch. NR 439 to simplify, reduce, modernize, and make more efficient the reporting, recordkeeping, testing, inspection and determination of compliance requirements for sources of air contaminants. In accordance with s. 227.136, Wis. Stats., the DNR is seeking public comment and feedback on Statement of Scope SS 047-22 at the time and virtual location shown below. Hearing Information

Rule Information
The primary objective of the proposed rule is to simplify, reduce, modernize, and make more efficient the requirements for sources of air contaminants related to reporting, recordkeeping, testing, inspection and demonstrating compliance administered under ch. NR 439, Wis. Adm. Code, while remaining consistent with the federal Clean Air Act and retaining approvability by the U.S. Environmental Protection Agency. The proposed revisions will remove inconsistencies between state and federal rules. In addition, the department is proposing to update related sections of the NR 400 series to meet federal requirements and ensure consistency with the proposed revisions to ch. NR 439, Wis. Adm. Code. The public has the opportunity to testify at the hearing. Pre-registration is strongly encouraged if you plan to provide spoken comments during the hearing. Comments on the proposed scope statement must be received on or before August 22, 2022. Written comments may be submitted by U.S. mail, E-mail, or through the internet and will have the same weight and effect as oral statements presented at the public hearing.
