FINDINGS
1. On December 16, 2005 and July 30, 2012, the Department of Justice, Drug Enforcement Administration published its final rules in the Federal Register placing thirty-eight (38) anabolic steroids into schedule III of the federal Controlled Substances Act. The scheduling actions are effective January 20, 2005 and August 29, 2012.
2. The Controlled Substances Board did not receive an objection to similarly treating thirty-eight (38) anabolic steroids as schedule III under ch. 961, Stats. within 30 days of the date of publication in the federal register of the final order designating thirty-eight (38) anabolic steroids as a controlled substance.
3. The Controlled Substances Board will promulgate a final rule, without making the determinations or findings required by ss. 961.11(1), (1m), (1r) and (2) or s. 961.19 and omitting the notice of proposed rule making, designating thirty-eight (38) anabolic steroids as a schedule III controlled substance.
ORDER
Pursuant to s. 961.11(4), Stats., the Controlled Substances Board by affirmative action similarly treats thirty-eight (38) anabolic steroids under chapter 961, Stats. by creating the following:
CSB 2.92 Addition of thirty-eight (38) Anabolic Steroids to schedule III. Section 961.18 (7), Stats., is repealed and recreated to read:
961.18 (7) ANABOLIC STEROIDS. Unless specifically excepted or listed in another schedule, any material, compound, mixture, or preparation containing any quantity of any of the following anabolic steroids, including any of their esters, ethers, isomers, esters or ethers of isomers, salts and salts of esters or ethers, isomers and esters or ethers of isomers that are theoretically possible within the specific chemical designation. Except such terms do not include an anabolic steroid that is expressly intended for administration through implants to cattle or other nonhuman species and that has been approved by the Secretary of Health and Human Services for such administration. If any person prescribes, dispenses, or distributes such steroid for human use, the person shall be considered to have prescribed, dispensed, or distributed an anabolic steroid within the meaning of this section:
(a) 3beta,17-dihydroxy-5alpha-androstane;
(b) 3alpha,17beta-dihydroxy-5alpha-androstane;
(c) 5alpha-androstan-3,17-dione;
(d) 1-androstenediol (3beta,17beta-dihydroxy-5alpha-androst-1-ene; 3alpha,17beta-dihydroxy-5alpha-androst-1-ene);
(e) 4-androstenediol;
(f) 5-androstenediol;
(g) 1-androstenedione;
(h) 4-androstenedione;
(i) 5-androstenedione;
(j) Bolasterone;
(k) Boldenone;
(L) Boldione;
(m) Calusterone;
(n) 4-chlorotestosterone, which is also called clostebol;
(o) Dehydrochloromethyltestosterone;
(p) Desoxymethyltestosterone
(q) delta1-dihydrotestosterone
(r) 4-dihydrotestosterone, which is also called stanolone;
(s) Drostanolone;
(t) Ethylestrenol;
(u) Fluoxymesterone;
(v) Formebulone, which is also called fromebolone;
(w) Furazabol;
(x) 13beta-ethyl-17beta-hydroxygon-4-en-3-one;
(y) 4-hydroxytestosterone;
(z) 4-hydroxy-19-nortestosterone;
(aa) Mestanolone;
(bb) Mesterolone;
(cc) Methandienone, which is also called methandrostenolone;
(dd) Methandriol;
(ee) Methasterone;
(ff) Methenolone;
(gg) 17alpha-methyl-3beta, 17beta-dihydroxy-5alpha-androstane;
(hh) 17alpha-methyl-3alpha,17beta-dihydroxy-5alpha-androstane;
(ii) 17alpha-methyl-3beta,17beta-dihydroxyandrost-4-ene;
(jj) 17alpha-methyl-4-hydroxynandrolone;
