Application for Waiver of Requirements under the Nita M. Lowey 21st Century Community Learning Centers Program
The Wisconsin Department of Public Instruction (WDPI) is seeking to submit an application for a waiver from Section 4201(b)(1)(A) under the Elementary and Secondary Education Act (ESEA), as amended by the Every Student Succeeds Act (ESSA).
Section 8401(b) of ESEA, as amended by ESSA, allows the Secretary of the U.S. Department of Education to waive the requirement in ESEA section 4201(b)(1)(A) that restricts activities provided by a 21st CCLC program to activities provided only during non-school hours or periods when school is not in session. Under the waiver, the WDPI may permit 21st CCLC programs to provide supplemental activities when school is in session but students are not receiving in-person instruction, such as by permitting a teacher to provide additional academic supports during remote learning. All other requirements for a 21st CCLC program continue to apply.
As required under Section 8401(b)(3)(A), the state educational agency must provide the public and all local education agencies and subgrantees in the state with notice of and the opportunity to comment on this request.

Written comments should be submitted no later than 10 a.m. on Friday, October 9, 2020, in order to receive consideration.
