The Department recently promulgated a rule revising PI 34 of the Wisconsin Administrative Code, Clearinghouse Rule 17-093 relating to stakeholder workgroups revisions to licensure, which became effective August 1, 2018. Upon further review, the Department has identified further points of clarification within the rule. Without a rule change, the Department will be required to implement rules for educator licensure as they currently exist in PI 34; applicants for specific licenses may face unclear guidance on license requirements as a result.

  SECTION 1. PI 8.01 (2) (a) 2. a. and b. are amended to read:
PI 8.01 (2) (a) 2. a. Each school district board shall ensure that all instructional staff of charter schools located in the school district hold a department issued license or permit to teach at the level and in the subject of their assignments or a tier I charter school instructional staff license or permit issued under s. PI 34.241 or 34.24234.031.
b. For purposes of this subdivision, a virtual charter school is located in the school district specified under s. 118.40 (8) (a), Stats. Virtual charter school instructional staff shall meet the requirements under s. 118.40 (8) (b), Stats., and s. PI 34.243.
SECTION 2. PI 34.001 (8) and (11) are amended to read:
PI 34.001 (8) Educator preparation program” means the sequence of courses included in a baccalaureate or bachelor's degree program or post baccalaureate program or the training provided by an entity for preparing professional school personnel for licensure.
(11) “Institutional endorsement” means written verification from an accredited approvededucator preparation program that an individual has satisfactorily completed the program or its equivalent and is recommended for a specific license.
  SECTION 3. PI 34.001 (11m) is created to read:
PI 34.001 (11m) “Kindergarten” includes 4-year-old or 5-year-old-kindergarten.
SECTION 4. PI 34.008 (4) is amended to read:
PI 34.008 (4) Notification of the date that the state superintendent will conduct an onsite comprehensive review to determine whether the educator preparation program corrected the areas of noncompliance. The onsite review date shall occur within 90 calendar days of the written notification.
  SECTION 5. PI 34.011 (2) is amended to read:
PI 34.011 (2) Approval. The state superintendent shall grant initial approval under s. PI 34.007 (3) if the state superintendent determines that the experimental or innovative educator preparation program meets the requirements under sub. (1). A professional educator preparation program approved under this subsection shall maintain approval by meeting the requirements under s. PI 34.007 (6).
  SECTION 6. PI 34.011 (3) is created to read:
PI 34.011 (3) Maintaining approval. If an educator preparation program is approved under sub. (2), the state superintendent shall annually extend approval for one year if all of the following occur:
(a) An onsite review visit demonstrates that the educator preparation program successfully prepares candidates for licensure.
(b) The educator preparation program is in compliance with the requirements of this chapter, modified as initially approved under sub. (2).
SECTION 7. PI 34.022 (5) is amended to read:
PI 34.022 (5) Teacher responsibilities. For classroom teacher licenses, the role and responsibility of a teacher through a student teaching experience that meets all of the requirements under s. PI 34.023.
  SECTION 8. PI 34.023 (1) (b) is amended to read:
PI 34.023 (1) (b) Occur in a variety of variety of school settings.
  SECTION 9. PI 34.026 (1) (c) is amended to read:
PI 34.026 (1) (c) If an applicant completecompletes an approved program in December, the effective date of the license is January 1.
  SECTION 10. PI 34.028 (2) (f) 1. is renumbered PI 34.028 (2) (f) 1. a. and amended to read:
PI 34.028 (2) (f) 1. a. TheExcept as provided in subd. 1. b., the applicant holds a masters degree required by the pupil service category under subchVII from an accredited college or university in the area of the license or is enrolled in an approved preparation program that leads to licensure for that position.
  SECTION 11. PI 34.028 (2) (f) 1. b. is created to read:
PI 34.028 (2) (f) 1. b. If the applicant is applying for licensure under s. PI 34.061, the applicant holds a masters degree from an accredited college or university in the area of the license and is enrolled in an approved preparation program that leads to licensure for that position.
  SECTION 12. PI 34.028 (4) (a) 3. and (c) 3. are amended to read:
PI 34.028 (4) (a) 3. If the license holder does not meet the requirements under subd. 1. or 2., the district administrator of the employing school district submits to the state superintendent a written plan that demonstrates, by clear and convincing evidence, that the license holder will complete all of the licensure requirements during the term of the renewed license.
(c) 3. If the license holder does not meet the requirements under subd. 1. or 2., the district administrator of the employing school district submits to the state superintendent a written plan that demonstrates, by clear and convincing evidence, that the license holder will complete all of the licensure requirements during the term of the renewed license.
  SECTION 13. PI 34.029 (1g) is created to read:
PI 34.029 (1g) Definition. In this section, “residential school” means the Wisconsin educational services program for the deaf and hard of hearing, under s. 115.52, Stats., and the Wisconsin center for the blind and visually impaired, under s. 115.525, Stats.
SECTION 14. PI 34.029 (1) is renumbered PI 34.029 (1r) and amended to read:
PI 34.029 (1r) Authorization. A license issued under this section authorizes the license holder to teach in a subject area or grade level other than the subject area or grade level covered by the license holder's valid tier II, III, or IV license. A license issued under this section only authorizes the license holder to teach in the school district, CESA, or residential school which requested the license under sub. (2) (c).
  SECTION 15. PI 34.029 (2) (b) and (c) are amended to read:
