NR 440.40(1)(1)Applicability and designation of affected facility.
NR 440.40(1)(a)(a) The affected facility to which the provisions of this section apply is each triple superphosphate plant having a design capacity of more than 15 tons of equivalent P2O5 feed per calendar day. For the purpose of this section, the affected facility includes any combination of: mixers, curing belts or dens, reactors, granulators, dryers, cookers, screens, mills and facilities which store run-of-pile triple superphosphate.
NR 440.40(1)(b)(b) Any facility under par. (a) that commences construction or modification after October 22, 1974, is subject to the requirements of this section.
NR 440.40(2)(2)Definitions. As used in this section, terms not defined in this subsection have the meanings given in s. NR 440.02.
NR 440.40(2)(a)(a) “Equivalent P2O5 feed” means the quantity of phosphorus, expressed as phosphorus pentoxide, fed to the process.
NR 440.40(2)(b)(b) “Run-of-pile triple superphosphate” means any triple superphosphate that has not been processed in a granulator and is composed of particles at least 25% by weight of which when not caked will pass through a 16 mesh screen.
NR 440.40(2)(c)(c) “Total fluorides” means elemental fluorine and all fluoride compounds as measured by reference methods specified in sub. (5), or equivalent or alternative methods.
NR 440.40(2)(d)(d) “Triple superphosphate plant” means any facility manufacturing triple superphosphate by reacting phosphate rock with phosphoric acid. A run-of-pile triple superphosphate plant includes curing and storing.
NR 440.40(3)(3)Standard for fluorides. On and after the date on which the performance test required to be conducted by s. NR 440.08 is completed, no owner or operator subject to the provisions of this section may cause to be discharged into the atmosphere from any affected facility any gases which contain total fluorides in excess of 100 g/Mg of equivalent P2O5 feed (0.20 lb/ton).
NR 440.40(4)(4)Monitoring of operations.
NR 440.40(4)(a)(a) The owner or operator of any triple superphosphate plant subject to the provisions of this section shall install, calibrate, maintain and operate a flow monitoring device which can be used to determine the mass flow of phosphorus-bearing feed material to the process. The flow monitoring device shall have an accuracy of ± 5% over its operating range.
NR 440.40(4)(b)(b) The owner or operator of any triple superphosphate plant shall maintain a daily record of equivalent P2O5 feed by first determining the total mass rate in Mg/hr of phosphorus-bearing feed using a flow monitoring device meeting the requirements of par. (a) and then by proceeding according to sub. (5) (b) 3.
NR 440.40(4)(c)(c) The owner or operator of any triple superphosphate plant subject to the provisions of this section shall install, calibrate, maintain and operate a monitoring device which continuously measures and permanently records the total pressure drop across the process scrubbing system. The monitoring device shall have an accuracy of ± 5% over its operating range.
NR 440.40(5)(5)Test methods and procedures.
NR 440.40(5)(a)(a) In conducting the performance tests required in s. NR 440.08, the owner or operator shall use as reference methods and procedures the test methods in Appendix A of 40 CFR part 60, incorporated by reference in s. NR 440.17, or other methods and procedures as specified in this subsection, except as provided in s. NR 440.08 (2).
NR 440.40(5)(b)(b) The owner or operator shall determine compliance with the total fluorides standard in sub. (3) as follows:
NR 440.40(5)(b)1.1. The emission rate (E) of total fluorides shall be computed for each run using the following equation:

E is the emission rate of total fluorides, g/Mg (lb/ton) of equivalent P2O5 feed
Csi is the concentration of total fluorides from emission point “i”, mg/dscm (gr/dscf)
Qsdi is the volumetric flow rate of effluent gas from emission point “i”, dscm/hr (dscf/hr)
N is the number of emission points associated with the affected facility
P is the equivalent P2O5 feed rate, Mghr (ton/hr)
K is the conversion factor, 1000 mg/g (7000 gr/lb)
NR 440.40(5)(b)2.2. Method 13A or 13B shall be used to determine the total fluorides concentration (Csi) and volumetric flow rate (Qsdi) of the effluent gas from each of the emission points. The sampling shall be at least 60 minutes and 0.85 dscm (30 dscf).
NR 440.40(5)(b)3.3. The equivalent P2O5 feed rate (P) shall be computed for each run using the following equation:

NR 440.40(5)(b)3.a.a. The accountability system of sub. (4) (a) shall be used to determine the mass flow rate (Mp) of the phosphorus-bearing feed.
NR 440.40(5)(b)3.b.b. The Association of Official Analytical Chemists (AOAC) Method 9, incorporated by reference in s. NR 440.17, shall be used to determine the P2O5 content (Rp) of the feed.

NR 440.41NR 440.41Phosphate fertilizer industry: granular triple superphosphate storage facilities.
NR 440.41(1)(1)Applicability and designation of affected facility.
NR 440.41(1)(a)(a) The affected facility to which the provisions of this section apply is each granular triple superphosphate storage facility. For the purpose of this section, the affected facility includes any combination of: storage or curing piles, conveyors, elevators, screens and mills.
NR 440.41(1)(b)(b) Any facility under par. (a) that commences construction or modification after October 22, 1974, is subject to the requirements of this section.
NR 440.41(2)(2)Definitions. As used in this section, terms not defined in this subsection have the meanings given in s. NR 440.02.
NR 440.41(2)(a)(a) “Equivalent P2O5 stored” means the quantity of phosphorus, expressed as phosphorus pentoxide, being cured or stored in the affected facility.
NR 440.41(2)(b)(b) “Fresh granular triple superphosphate” means granular triple superphosphate produced within the preceding 72 hours.
NR 440.41(2)(c)(c) “Granular triple superphosphate storage facility” means any facility curing or storing fresh granular triple superphosphate.
NR 440.41(2)(d)(d) “Total fluorides” means elemental fluorine and all fluoride compounds as measured by reference methods specified in sub. (5), or equivalent or alternative methods.
NR 440.41(3)(3)Standard for fluorides.
NR 440.41(3)(a)(a) On and after the date on which the performance test required to be conducted by s. NR 440.08 is completed, no owner or operator subject to the provisions of this section may cause to be discharged into the atmosphere from any affected facility any gases which contain total fluorides in excess of 0.25 g/hr/Mg of equivalent P2O5 stored (5.0 × 10-4 lb/hr/ton of equivalent P2O5 stored).
NR 440.41(3)(b)(b) No owner or operator subject to the provisions of this section shall ship fresh granular triple superphospate from an affected facility.
NR 440.41(4)(4)Monitoring of operations.
NR 440.41(4)(a)(a) The owner or operator of any granular triple superphosphate storage facility subject to the provisions of this section shall maintain an accurate account of triple superphosphate in storage to permit the determination of the amount of equivalent P2O5 stored.
NR 440.41(4)(b)(b) The owner or operator of any granular triple superphosphate storage facility subject to the provisions of this section shall maintain a daily record of total equivalent P2O5 stored by multiplying the percentage P2O5 content, as determined by sub. (5) (c) 3., times the total mass of granular triple superphosphate stored.
NR 440.41(4)(c)(c) The owner or operator of any granular triple superphosphate storage facility subject to the provisions of this section shall install, calibrate, maintain and operate a monitoring device which continuously measures and permanently records the total pressure drop across any process scrubbing system. The monitoring device shall have an accuracy of ±5% over its operating range.
NR 440.41(4)(d)(d) The owner or operator of any granular triple superphosphate storage facility subject to the provisions of this section shall develop for approval by the department a site-specific methodology including sufficient recordkeeping for the purposes of demonstrating compliance with sub. (3) (b).
NR 440.41(5)(5)Test methods and procedures.
NR 440.41(5)(a)(a) The owner or operator shall conduct performance tests required in s. NR 440.08 only when the following quantities of products are being cured or stored in the facility.
NR 440.41(5)(a)1.1. Total granular triple superphosphate is at least 10% of the building capacity and
NR 440.41(5)(a)2.2. Fresh granular triple superphosphate is at least 6% of the total amount of triple superphosphate, or
NR 440.41(5)(a)3.3. If the provision in subd. 2. exceeds production capabilities for fresh granular triple superphosphate, fresh granular triple superphosphate is equal to at least 5 days maximum production.
NR 440.41(5)(b)(b) In conducting the performance tests required in s. NR 440.08, the owner or operator shall use as reference methods and procedures the test methods in Appendix A of 40 CFR part 60, incorporated by reference in s. NR 440.17, or other methods and procedures as specified in this subsection, except as provided in s. NR 440.08 (2).
NR 440.41(5)(c)(c) The owner or operator shall determine compliance with the total fluorides standard in sub. (3) as follows:

NR 440.42NR 440.42Coal preparation plants.
NR 440.42(1)(1)Applicability and designation of affected facility.
NR 440.42(1)(a)(a) The provisions of this section are applicable to any of the following affected facilities in coal preparation plants which process more than 181 Mg (200 tons) per day: thermal dryers, pneumatic coal-cleaning equipment (air tables), coal processing and conveying equipment (including breakers and crushers), coal storage systems and coal transfer and loading systems.
NR 440.42(1)(b)(b) Any facility under par. (a) that commences construction or modification after October 24, 1974, is subject to the requirements of this section.
NR 440.42(2)(2)Definitions. As used in this section, terms not defined in this subsection have the meanings given in s. NR 440.02.
NR 440.42(2)(a)(a) “Bituminous coal” means solid fossil fuel classified as bituminous coal by ASTM D388-99 (reapproved 2004), incorporated by reference in s. NR 440.17 (2) (a) 12.
NR 440.42(2)(b)(b) “Coal” means all solid fossil fuels classified as anthracite, bituminous, subbituminous or lignite by ASTM D388-99 (reapproved 2004), incorporated by reference in s. NR 440.17 (2) (a) 12.
NR 440.42(2)(c)(c) “Coal preparation plant” means any facility, excluding underground mining operations, which prepares coal by one or more of the following processes: breaking, crushing, screening, wet or dry cleaning and thermal drying.
NR 440.42(2)(d)(d) “Coal processing and conveying equipment” means any machinery used to reduce the size of coal or to separate coal from refuse, and the equipment used to convey coal to or remove coal and refuse from the machinery. This includes, but is not limited to, breakers, crushers, screens and conveyor belts.
NR 440.42(2)(e)(e) “Coal storage system” means any facility used to store coal except for open storage piles.
NR 440.42(2)(f)(f) “Cyclonic flow” means a spiraling movement of exhaust gases within a duct or stack.
NR 440.42(2)(g)(g) “Pneumatic coal-cleaning equipment” means any facility which classifies bituminous coal by size or separates bituminous coal from refuse by application of one or more air streams.
NR 440.42(2)(h)(h) “Thermal dryer” means any facility in which the moisture content of bituminous coal is reduced by contact with a heated gas stream which is exhausted to the atmosphere.
NR 440.42(2)(i)(i) “Transfer and loading system” means any facility used to transfer and load coal for shipment.
NR 440.42(3)(3)Standards for particulate matter.
NR 440.42(3)(a)(a) On and after the date on which the performance test required to be conducted by s. NR 440.08 is completed, an owner or operator subject to the provisions of this section may not cause to be discharged into the atmosphere from any thermal dryer gases which:
NR 440.42(3)(a)1.1. Contain particulate matter in excess of 0.070 g/dscm (0.031 gr/dscf).
