ATCP 93.240(17)(e)5. 5. Installation or activation of department-accepted, factory-supplied cathodic protection systems.
ATCP 93.240 Note Note: The department of agriculture, trade and consumer protection has accepted factory-supplied cathodic protection systems that comply with the sti-P3® specifications from the Steel Tank Institute, and may accept other systems of this type.
ATCP 93.240(17)(e)6. 6. Installation and testing of all connections and tank-related piping including vapor recovery, vents and supply pipes.
ATCP 93.240(17)(e)7. 7. Installation of leak detection devices and any monitoring wells.
ATCP 93.240(17)(e)8. 8. Testing of tanks and piping both prior to and after backfilling.
ATCP 93.240(17)(e)9. 9. Installation of pumps.
ATCP 93.240(17)(f) (f) Renewal.
ATCP 93.240(17)(f)1.a.a. A person may renew a certification as an underground tank system installer.
ATCP 93.240(17)(f)1.b. b. An underground tank system installer certification shall be renewed in accordance with sub. (7).
ATCP 93.240(17)(f)2.a.a. The renewal of a certification as an underground tank system installer shall be contingent upon the installer obtaining at least 12 hours of acceptable continuing education prior to the expiration date of the certification as specified in sub. (8) and Table 93.240 except as provided in subd. 2. b.
ATCP 93.240(17)(f)2.b. b. A person who holds a certification as an underground tank system installer may apply to the department for waiver of the continuing education requirements under subd. 2. a. on the grounds of prolonged illness or disability or similar circumstances. Each application for waiver shall be considered individually on its merits by the department.
ATCP 93.240(18) (18)Underground tank system liners.
ATCP 93.240(18)(a) (a) General. No person may line, reline, or perform the lining inspection of an underground tank system that has held or will hold flammable or combustible liquids which are regulated under this chapter unless the person complies with one of the following:
ATCP 93.240(18)(a)1. 1. The person holds a certification issued by the department as a certified tank system liner.
ATCP 93.240(18)(a)2. 2. The person is under the direct supervision of another person who holds a certification issued by the department as a certified tank system liner.
ATCP 93.240(18)(b) (b) Application for examination. A person applying to take a tank system liner certification examination shall submit all of the following:
ATCP 93.240(18)(b)1. 1. An application in accordance with sub. (2).
ATCP 93.240(18)(b)2. 2. An application fee and examination fee in accordance with Table 93.240.
ATCP 93.240(18)(c) (c) Examination. A person seeking to obtain a tank system liner certification shall take and pass an examination in accordance with sub. (9).
ATCP 93.240(18)(d) (d) Application for certification. Upon notification of successfully passing the examination for a tank system liner certification, a person may obtain the certification by submitting an application and the certification fee in accordance with sub. (2).
ATCP 93.240(18)(e) (e) Responsibilities. A person who lines or supervises the lining of underground tanks as a certified tank system liner shall be present at the job site for at least all of the following activities:
ATCP 93.240(18)(e)1. 1. Removal of product from the tanks and making the atmosphere of the tanks inert or vapor-free.
ATCP 93.240 Note Note: Chapter ATCP 93 requires plan submittal and approval prior to lining a tank.
ATCP 93.240(18)(e)2. 2. Cutting of openings in tanks.
ATCP 93.240(18)(e)3. 3. Removal and handling of sludge and other wastes from tanks.
ATCP 93.240(18)(e)4. 4. Sand blasting of the tank interior.
ATCP 93.240(18)(e)5. 5. Inspection for holes and wall thickness.
ATCP 93.240(18)(e)6. 6. Notifying the owner if an internal tank assessment determines that a tank system assessment under this chapter is required.
ATCP 93.240(18)(e)7. 7. Repair of holes.
ATCP 93.240(18)(e)8. 8. Notifying and arranging for a certified tank system inspector to visit the site and authorize the lining, prior to applying the lining to the tank.
ATCP 93.240(18)(e)9. 9. Coating of tanks.
ATCP 93.240(18)(e)10. 10. Testing for holidays.
ATCP 93.240(18)(e)11. 11. Testing for coating hardness.
ATCP 93.240(18)(e)12. 12. Resealing of tanks.
ATCP 93.240(18)(e)13. 13. Completing an API 1631 inspection form B and submitting it to the owner, authorized agent, and the department.
ATCP 93.240(18)(f) (f) Renewal.
ATCP 93.240(18)(f)1.1. A person may renew a certification as a tank system liner.
ATCP 93.240(18)(f)2. 2. A tank system liner certification shall be renewed in accordance with sub. (7).
ATCP 93.240(19) (19)Tank system removers and cleaners.
ATCP 93.240(19)(a)(a) General. Except as provided in par. (g), no person may remove or clean a tank system that is regulated under this chapter unless the person complies with one of the following:
ATCP 93.240(19)(a)1. 1. The person holds a certification issued by the department as a certified tank system remover-cleaner.
ATCP 93.240(19)(a)2. 2. The person is under the direct supervision of another person who holds a certification issued by the department as a certified tank system remover-cleaner.
ATCP 93.240(19)(b) (b) Application for examination. A person applying to take a tank system remover-cleaner certification examination shall submit all of the following:
ATCP 93.240(19)(b)1. 1. An application in accordance with sub. (2).
ATCP 93.240(19)(b)2. 2. An application fee and examination fee in accordance with Table 93.240.
ATCP 93.240(19)(c) (c) Examination. A person seeking to obtain a tank system remover-cleaner certification shall take and pass an examination in accordance with sub. (9).
ATCP 93.240(19)(d) (d) Application for certification. Upon notification of successfully passing the examination for a tank system remover-cleaner certification, a person may obtain the certification by submitting an application and the certification fee in accordance with subs. (2) and (9) (g).
ATCP 93.240(19)(e) (e) Responsibilities. A person who removes or cleans or supervises the removing or cleaning of tanks as a certified tank system remover-cleaner shall be present at the job site for at least all of the following activities:
ATCP 93.240(19)(e)1. 1. Disconnecting and draining of piping.
ATCP 93.240(19)(e)2. 2. Capping of piping.
ATCP 93.240(19)(e)3. 3. Vapor freeing or inerting of tanks.
ATCP 93.240(19)(e)4. 4. Cleaning of tanks and handling of sludge and other wastes.
ATCP 93.240(19)(e)5. 5. Removal of tank systems from the ground and loading them for transport or filling the tank systems with an inert material.
ATCP 93.240(19)(e)6. 6. Visual inspection of the soils around the excavation or tank system location.
ATCP 93.240(19)(f) (f) Renewal.
ATCP 93.240(19)(f)1.1. A person may renew a certification as a tank system remover-cleaner.
ATCP 93.240(19)(f)2. 2. A tank system remover-cleaner certification shall be renewed in accordance with sub. (7).
ATCP 93.240(19)(f)3. 3. An application for a renewal under this section shall include proof of the liability coverage specified in sub. (14) (a) 2.
ATCP 93.240(19)(g) (g) Exclusions. This section does not apply to any of the following:
ATCP 93.240(19)(g)1. 1. Field-constructed aboveground tanks.
ATCP 93.240(19)(g)2. 2. Heating fuel tanks located aboveground or in basements of 1- or 2-family dwellings.
ATCP 93.240(20) (20)Tank system tightness testers.
ATCP 93.240(20)(a) (a) General.
ATCP 93.240(20)(a)1.1. No person may conduct the tightness testing specified in this chapter for a tank system unless the person holds a certification issued by the department as a certified tank system tightness tester.
ATCP 93.240(20)(a)2. 2. Tank system tightness testing shall be performed by a person with no personal or monetary interest in the facility and whose employer has no personal or monetary interest in the facility.
ATCP 93.240(20)(b) (b) Application for certification. A person applying for a tank system tightness tester certification shall submit all of the following:
ATCP 93.240(20)(b)1. 1. An application in accordance with sub. (2).
ATCP 93.240(20)(b)2. 2. An application fee and a certification fee in accordance with Table 93.240.
ATCP 93.240(20)(c) (c) Qualifications for certification.
ATCP 93.240(20)(c)1.1. A person applying for a tank system tightness tester certification shall have completed training in one or more tightness test methods that have been approved under this chapter, within the 2 years immediately preceding the application.
ATCP 93.240(20)(c)2. 2. The test methodology training qualifying for certification shall have been provided by the person or entity that obtained the approval under this chapter for the methodology.
ATCP 93.240(20)(d) (d) Responsibilities. A person who conducts tightness tests for tank systems as a certified tank system tightness tester shall do all of the following:
ATCP 93.240(20)(d)1. 1. Conduct tightness tests in accordance with the material approval under this chapter and any additional manufacturer's instructions.
ATCP 93.240(20)(d)2. 2. Employ only those test methodologies for which training has been obtained.
ATCP 93.240(20)(e) (e) Renewal.
ATCP 93.240(20)(e)1.1. A person may renew a certification as a tank system tightness tester.
ATCP 93.240(20)(e)2. 2. A tank system tightness tester certification shall be renewed in accordance with sub. (7).
ATCP 93.240(21) (21)Cathodic protection specialties.
ATCP 93.240(21)(a) (a) General.
ATCP 93.240(21)(a)1.1. `Cathodic protection tester.' No person may conduct cathodic protection testing of a tank system that is regulated under this chapter unless the person holds a certification issued by the department as a certified cathodic protection tester.
ATCP 93.240(21)(a)2. 2. `Corrosion expert.'
ATCP 93.240(21)(a)2.a.a. No person may design or install a cathodic protection system for a tank system that is regulated under this chapter unless the person holds a certification issued by the department as a certified corrosion expert.
ATCP 93.240(21)(a)2.b. b. This paragraph does not apply to department-accepted, factory-supplied cathodic protection systems.

ATCP 93.240(21)(a)3. 3. `Independence.' Cathodic protection activities covered under this section shall be performed by a person with no personal or monetary interest in the facility and whose employer has no personal or monetary interest in the facility.
ATCP 93.240(21)(b) (b) Application for certification. A person applying for certification as a cathodic protection tester or a corrosion expert shall submit all of the following:
