129.596 Sandhill crane hunter education program. (1) The department 2shall establish and conduct a sandhill crane hunter education program. The 3program shall provide a course of instruction that includes all of the following: SB112,8,54(a) History and recovery of the sandhill crane in this state and in the eastern 5United States. SB112,8,66(b) Methods used to distinguish sandhill cranes from other birds. SB112,8,77(c) Methods used to estimate the population of sandhill cranes in the state. SB112,8,88(d) Areas covered by sandhill crane hunting zones. SB112,8,109(e) Any rules promulgated by the department concerning the hunting of 10sandhill cranes. SB112,8,1711(2) The department shall offer a test for a person to demonstrate successful 12completion of the course of instruction and shall issue a certificate of 13accomplishment for free to a person who completes the course of instruction and 14passes the test. A certificate of accomplishment issued under this subsection is 15valid for one year. At least once each year, the department shall offer the test to any 16person who has previously completed the course of instruction to allow the person 17to renew their certificate of accomplishment for one year. SB112,8,1918(3) No person may hunt sandhill cranes unless he or she has a current, valid 19certificate of accomplishment issued under sub. (2). SB112,8,2420(4) If the department maintains a system under which the department stores 21information in an electronic format as described under s. 23.47 (2), the department 22shall store information in that system relating to persons who have completed a 23sandhill crane hunter education program, and any associated tests, that satisfies 24the requirements of this section. (1) In this 20section: SB112,9,2421(a) “Eligible applicant” means a person that plants corn on land that is 22operated as part of a farm that produced at least $6,000 in gross farm revenues 23during the taxable year preceding the year in which the person applies for 24reimbursement under this section. SB112,10,2
1(b) “Farm” means all land under common ownership that is primarily devoted 2to agricultural use. SB112,10,43(c) “Seed coating” means a nonlethal treatment registered for use on corn seed 4to discourage sandhill cranes from consuming the seed. SB112,10,75(2) (a) The department shall administer a program to provide 6reimbursements to eligible applicants for the purchase of seed coating that is 7applied as a seed treatment. SB112,10,108(b) A reimbursement under this section shall cover not more than 50 percent 9of the actual cost of the purchase of seed coating that is applied as a seed treatment 10and may not exceed $6,250 per eligible applicant per planting season. SB112,10,1511(c) From March 1 to June 15 of each year, eligible applicants may apply to the 12department for reimbursement for seed coating purchased no earlier than 13November 1 of the prior year. Eligible applicants shall provide to the department 14proof of purchase and an application on a form provided by the department to be 15eligible to receive a reimbursement under this section. SB112,10,1716(d) From the appropriation under s. 20.115 (7) (ac), the department shall 17prioritize reimbursement payments under par. (c) to all of the following: SB112,10,19181. Eligible applicants that received a federal depredation permit for sandhill 19crane in the previous year. SB112,10,22202. Eligible applicants that received reimbursement under this section in any 21of the prior 3 years or that can provide documentation of purchase of seed coating in 22any of the prior 3 years. SB112,11,2233. Eligible applicants planting corn on land vulnerable to sandhill crane
1depredation as determined by the department in consultation with the department 2of natural resources and applicable conservation organizations. SB112,11,83(e) After reimbursing all eligible applicants under par. (d), from the 4appropriation under s. 20.115 (7) (ac), the department shall make reimbursement 5payments to other eligible applicants that have experienced or are likely to 6experience seed or crop damage from sandhill cranes. The department shall make 7payments under this paragraph to eligible applicants in the order in which 8applications are received by the department. SB112,11,119(f) The department shall make all reimbursement payments under pars. (d) 10and (e) no later than September 15 of the year in which applications are made 11under par. (c). SB112,11,1312(g) A farm is eligible to receive only one reimbursement payment per year 13under this section. SB112,11,1914(3) The department shall compile an annual report detailing the number of 15reimbursements requested, the total dollar amount requested as reimbursement, 16the number of reimbursements issued, and the total dollar amount disbursed as 17reimbursement under this section. The department shall submit the report to the 18appropriate standing committees of the legislature in the manner provided in s. 1913.172 (3) no later than December 31 each year. SB112,11,2320(4) The department may promulgate rules to establish prioritization of 21payments under sub. (2) (d) and (e), including identifying applicable conservation 22organizations under sub. (2) (d) 3. and determining whether eligible applicants 23have experienced or are likely to experience seed or crop damage under sub. (2) (e). SB112,2924Section 29. Nonstatutory provisions. SB112,12,5
1(1) Federal approval of sandhill crane hunting. When the department 2of natural resources receives approval from the U.S. fish and wildlife service to 3authorize the hunting of sandhill cranes in this state, the department shall notify 4the legislative reference bureau. The legislative reference bureau shall publish a 5notice in the Wisconsin Administrative Register that specifies that date. SB112,12,186(2) Emergency rules. The department of agriculture, trade and consumer 7protection may use the procedure under s. 227.24 to promulgate emergency rules 8under s. 93.67 (4) for the period before the date on which permanent rules under s. 993.67 (4) take effect. Notwithstanding s. 227.24 (1) (c) and (2), emergency rules 10promulgated under this subsection remain in effect until the first day of the 25th 11month beginning after the effective date of the emergency rules, the date on which 12the permanent rules take effect, or the effective date of the repeal of the emergency 13rules, whichever is earlier. Notwithstanding s. 227.24 (1) (a) and (3), the 14department of agriculture, trade and consumer protection is not required to provide 15evidence that promulgating a rule under this subsection as an emergency rule is 16necessary for the preservation of public peace, health, safety, or welfare and is not 17required to provide a finding of emergency for a rule promulgated under this 18subsection. SB112,13,220(1) In the schedule under s. 20.005 (3) for the appropriation to the department 21of agriculture, trade and consumer protection under s. 20.115 (7) (a), the dollar 22amount for fiscal year 2025-26 is increased by $85,000 and the dollar amount for 23fiscal year 2026-27 is increased by $85,000 to increase the authorized FTE positions 24for the department by 1.0 GPR position to administer the sandhill crane damage
1reimbursement program under s. 93.67 and for administrative costs related to the 2program. SB112,313Section 31. Effective dates. This act takes effect on the day after 4publication, except as follows: SB112,13,75(1) The treatment of s. 29.563 (13) (a) and (b) takes effect on the date specified 6in the notice published in the Wisconsin Administrative Register under Section 29 7(1) of this act. SB112,13,108(2) The treatment of ss. 20.005 (3), 20.115 (7) (ac), and 93.67 takes effect on 9the first day of the 4th month beginning after publication, or on the 2nd day after 10publication of the 2025 biennial budget act, whichever is later.
