If a spouse, widow surviving spouse, or minor, or an 22incapacitated person may be lawfully dependent upon the property for his or her 23support, the court shall release all or such part of the property and estate from the
1charges that may be necessary to provide for the person. The department shall 2make every reasonable effort to notify the liable persons as soon as possible after 3the beginning of the maintenance, but the notice or the receipt of the notice is not a 4condition of liability.
