AB193,28,63c. Subpoenas issued by a respiratory therapy licensing authority in a member 4state for production of evidence from another member state shall be enforced in the 5latter state, according to the practice and procedure of that court applicable to 6subpoenas issued in the proceedings pending before it. AB193,28,97d. The issuing authority shall pay any witness fees, travel expenses, mileage, 8and other fees required by the service statutes of the state where the witnesses or 9evidence are located; AB193,28,12103. Unless otherwise prohibited by state law, recover from the licensee the costs 11of investigations and disposition of cases resulting from any adverse action taken 12against that licensee; AB193,28,16134. Notwithstanding subd. 2., a member state may not issue a subpoena to 14gather evidence of conduct in another member state that is lawful in such other 15member state for the purpose of taking adverse action against a licensee’s compact 16privilege or application for a compact privilege in that member state; and AB193,28,19175. Nothing in this compact authorizes a member state to impose discipline 18against a respiratory therapist’s compact privilege in that member state for the 19individual’s otherwise lawful practice in another state. AB193,29,220(e) Joint investigations. 1. In addition to the authority granted to a member 21state by its respective respiratory therapy practice act or other applicable state law, 22a member state may participate with other member states in joint investigations of 23licensees, provided, however, that a member state receiving such a request has no
1obligation to respond to any subpoena issued regarding an investigation of conduct 2or practice that was lawful in a member state at the time it was undertaken. AB193,29,832. Member states shall share any significant investigative information, 4litigation, or compliance materials in furtherance of any joint or individual 5investigation initiated under the compact. In sharing such information between 6member state respiratory therapy licensing authorities, all information obtained 7shall be kept confidential, except as otherwise mutually agreed upon by the sharing 8and receiving member state(s). AB193,29,119(f) Nothing in this compact may permit a member state to take any adverse 10action against a licensee or holder of a compact privilege for conduct or practice that 11was legal in the member state at the time it was undertaken. AB193,29,1412(g) Nothing in this compact may permit a member state to take disciplinary 13action against a licensee or holder of a compact privilege for conduct or practice that 14was legal in the member state at the time it was undertaken. AB193,29,2115(7) Establishment of the respiratory care interstate compact 16commission. (a) The compact member states hereby create and establish a joint 17government agency whose membership consists of all member states that have 18enacted the compact known as the respiratory care interstate compact commission. 19The commission is an instrumentality of the compact member states acting jointly 20and not an instrumentality of any one state. The commission shall come into 21existence on or after the effective date of the compact, as set forth in sub. (11). AB193,29,2422(b) Membership, voting, and meetings. 1. Each member state shall have and 23be limited to one commissioner selected by that member state’s respiratory therapy 24licensing authority. AB193,30,2
12. The commissioner shall be an administrator or their designated staff 2member of the member state’s respiratory therapy licensing authority. AB193,30,433. The commission shall by rule or bylaw establish a term of office for 4commissioners and may by rule or bylaw establish term limits. AB193,30,654. The commission may recommend to a member state the removal or 6suspension of any commissioner from office. AB193,30,975. A member state’s respiratory therapy licensing authority shall fill any 8vacancy of its commissioner occurring on the commission within 60 days of the 9vacancy. AB193,30,11106. Each commissioner shall be entitled to one vote on all matters before the 11commission requiring a vote by commissioners. AB193,30,14127. A commissioner shall vote in person or by such other means as provided in 13the bylaws. The bylaws may provide for commissioners to meet by 14telecommunication, videoconference, or other means of communication. AB193,30,16158. The commission shall meet at least once during each calendar year. 16Additional meetings may be held as set forth in the bylaws. AB193,30,1717(c) The commission shall have the following powers: AB193,30,18181. Establish and amend the fiscal year of the commission; AB193,30,20192. Establish and amend bylaws and policies, including but not limited to, a 20code of conduct and conflict of interest; AB193,30,21213. Establish and amend rules, which shall be binding in all member states; AB193,30,22224. Maintain its financial records in accordance with the bylaws; AB193,30,24235. Meet and take such actions as are consistent with the provisions of this 24compact, the commission’s rules, and the bylaws; AB193,31,3
16. Initiate and conduct legal proceedings or actions in the name of the 2commission, provided that the standing of any respiratory therapy licensing 3authority to sue or be sued under applicable law shall not be affected; AB193,31,647. Maintain and certify records and information provided to a member state 5as the authenticated business records of the commission, and designate an agent to 6do so on the commission’s behalf; AB193,31,778. Purchase and maintain insurance and bonds; AB193,31,989. Accept or contract for services of personnel, including, but not limited to, 9employees of a member state; AB193,31,101010. Conduct an annual financial review; AB193,31,151111. Hire employees, elect or appoint officers, fix compensation, define duties, 12grant such individuals appropriate authority to carry out the purposes of the 13compact, and establish the commission’s personnel policies and programs relating 14to conflicts of interest, qualifications of personnel, and other related personnel 15matters; AB193,31,161612. Assess and collect fees; AB193,31,191713. Accept any and all appropriate gifts, donations, grants of money, other 18sources of revenue, equipment, supplies, materials, and services, and receive, 19utilize, and dispose of the same, provided that at all times: AB193,31,2020a. The commission shall avoid any appearance of impropriety; and AB193,31,2121b. The commission shall avoid any appearance of conflict of interest; AB193,31,232214. Lease, purchase, retain, own, hold, improve, or use any property, real, 23personal, or mixed, or any undivided interest therein; AB193,32,2
115. Sell, convey, mortgage, pledge, lease, exchange, abandon, or otherwise 2dispose of any property real, personal, or mixed; AB193,32,3316. Establish a budget and make expenditures; AB193,32,4417. Borrow money in a fiscally responsible manner; AB193,32,8518. Appoint committees, including standing committees, composed of 6commissioners state regulators, state legislators or their representatives, and 7consumer representatives, and such other interested persons as may be designated 8in this compact and the bylaws; AB193,32,10919. Provide and receive information from, and cooperate with, law 10enforcement agencies; AB193,32,131120. Establish and elect an executive committee, including a chair, vice-chair, 12secretary, treasurer, and such other offices as the commission shall establish by 13rule or bylaw; AB193,32,151421. Enter into contracts or arrangements for the management of the affairs of 15the commission; AB193,32,181622. Determine whether a state’s adopted language is materially different from 17the model compact language such that the state would not qualify for participation 18in the compact; and AB193,32,201923. Perform such other functions as may be necessary or appropriate to 20achieve the purposes of this compact. AB193,32,2321(d) The executive committee. 1. The executive committee shall have the power 22to act on behalf of the commission according to the terms of this compact. The 23powers, duties, and responsibilities of the executive committee shall include: AB193,33,224a. Overseeing the day-to-day activities of the administration of the compact,
1including enforcement and compliance with the provisions of the compact, its rules 2and bylaws, and other such duties as deemed necessary; AB193,33,53b. Recommending to the commission changes to the rules or bylaws, changes 4to this compact legislation, fees charged to compact member states, fees charged to 5licensees, and other fees; AB193,33,76c. Ensuring compact administration services are appropriately provided, 7including by contract; AB193,33,88d. Preparing and recommending the budget; AB193,33,99e. Maintaining financial records on behalf of the commission; AB193,33,1110f. Monitoring compact compliance of member states and providing compliance 11reports to the commission; AB193,33,1212g. Establishing additional committees as necessary; AB193,33,1613h. Exercising the powers and duties of the commission during the interim 14between commission meetings, except for adopting or amending rules, adopting or 15amending bylaws, and exercising any other powers and duties expressly reserved to 16the commission by rule or bylaw; and AB193,33,1817i. Performing other duties as provided in the rules or bylaws of the 18commission. AB193,33,20192. The executive committee shall be composed of up to 9 members, as further 20set forth in the bylaws of the commission: AB193,33,2221a. Seven voting members who are elected by the commission from the current 22membership of the commission; and AB193,33,2323b. Two ex-officio, nonvoting members. AB193,34,2
13. The commission may remove any member of the executive committee as 2provided in the commission’s bylaws. AB193,34,334. The executive committee shall meet at least annually. AB193,34,64a. Executive committee meetings shall be open to the public, except that the 5executive committee may meet in a closed, nonpublic meeting as provided in par. (f) 64. below; AB193,34,97b. The executive committee shall give advance notice of its meetings, posted 8on its website and as determined to provide notice to persons with an interest in the 9business of the commission; and AB193,34,1110c. The executive committee may hold a special meeting in accordance with 11par. (f) 2. below. AB193,34,1312(e) The commission shall adopt and provide to the member states an annual 13report. AB193,34,1714(f) Meetings of the commission. 1. All meetings of the commission that are not 15closed pursuant to subd. 4. shall be open to the public. Notice of public meetings 16shall be posted on the commission’s website at least 30 days prior to the public 17meeting. AB193,34,23182. Notwithstanding subd. 1., the commission may convene an emergency 19public meeting by providing at least 24 hours prior notice on the commission’s 20website, and any other means as provided in the commission’s rules, for any of the 21reasons it may dispense with notice of proposed rule making under sub. (9) (g). The 22commission’s legal counsel shall certify that one of the reasons justifying an 23emergency public meeting has been met. AB193,35,3243. Notice of all commission meetings shall provide the time, date, and location
1of the meeting, and if the meeting is to be held or accessible via telecommunication, 2video conference, or other electronic means, the notice shall include the mechanism 3for access to the meeting. AB193,35,644. The commission or the executive committee may convene in a closed, 5nonpublic meeting for the commission or executive committee to receive or solicit 6legal advice or to discuss: AB193,35,77a. Noncompliance of a member state with its obligations under the compact; AB193,35,98b. The employment, compensation, discipline or other matters, practices or 9procedures related to specific employees; AB193,35,1110c. Current or threatened discipline of a licensee or compact privilege holder by 11the commission or by a member state’s respiratory therapy licensing authority; AB193,35,1212d. Current, threatened, or reasonably anticipated litigation; AB193,35,1413e. Negotiation of contracts for the purchase, lease, or sale of goods, services, or 14real estate; AB193,35,1515f. Accusing any person of a crime or formally censuring any person; AB193,35,1716g. Trade secrets or commercial or financial information that is privileged or 17confidential; AB193,35,1918h. Information of a personal nature where disclosure would constitute a 19clearly unwarranted invasion of personal privacy; AB193,35,2020i. Investigative records compiled for law enforcement purposes; AB193,35,2321j. Information related to any investigative reports prepared by or on behalf of 22or for use of the commission or other committee charged with responsibility of 23investigation or determination of compliance issues pursuant to the compact; AB193,35,2424k. Legal advice; AB193,36,2
1L. Matters specifically exempted from disclosure by federal or member state 2law; or AB193,36,33m. Other matters as promulgated by the commission by rule. AB193,36,645. If a meeting, or portion of a meeting, is closed, the presiding officer shall 5state that the meeting will be closed and reference each relevant exempting 6provision, and such reference shall be recorded in the minutes. AB193,36,1176. The commission shall keep minutes in accordance with commission rules 8and bylaws. All documents considered in connection with an action shall be 9identified in such minutes. All minutes and documents of a closed meeting shall 10remain under seal, subject to release only by a majority vote of the commission or 11order of a court of competent jurisdiction. AB193,36,1412(g) Financing of the commission. 1. The commission shall pay, or provide for 13the payment of, the reasonable expenses of its establishment, organization, and 14ongoing activities. AB193,36,16152. The commission may accept any and all appropriate revenue sources as 16provided herein. AB193,36,22173. The commission may levy on and collect an annual assessment from each 18member state and impose fees on licensees of member states to whom it grants a 19compact privilege to cover the cost of the operations and activities of the commission 20and its staff. The aggregate annual assessment amount for member states, if any, 21shall be allocated based upon a formula that the commission shall promulgate by 22rule. AB193,37,2234. The commission shall not incur obligations of any kind prior to securing the 24funds or a loan adequate to meet the same; nor shall the commission pledge the
1credit of any of the member states, except by and with the authority of the member 2state. AB193,37,935. The commission shall keep accurate accounts of all receipts and 4disbursements. The receipts and disbursements of the commission shall be subject 5to the financial review and accounting procedures established under its bylaws. 6However, all receipts and disbursements of funds handled by the commission shall 7be subject to an annual financial review by a certified or licensed public accountant, 8and the report of the financial review shall be included in and become part of the 9annual report of the commission. AB193,37,1310(h) Qualified immunity, defense, and indemnification. 1. Nothing herein 11shall be construed as a limitation on the liability of any licensee for professional 12malpractice or misconduct, which shall be governed solely by any other applicable 13state laws. AB193,38,2142. The member states, commissioners, officers, executive directors, employees, 15and agents of the commission shall be immune from suit and liability, both 16personally and in their official capacity, for any claim for damage to or loss of 17property or personal injury or other civil liability caused by or arising out of any 18actual or alleged act, error, or omission that occurred, or that the person against 19whom the claim is made had a reasonable basis for believing occurred within the 20scope of commission employment, duties or responsibilities; provided that nothing 21in this subdivision shall be construed to protect any such person from suit or 22liability for any damage, loss, injury, or liability caused by the intentional or willful 23or wanton misconduct of that person. The procurement of insurance of any type by
1the commission shall not in any way compromise or limit the immunity granted 2hereunder.
