SB45-SSA2-SA7,23,8 100.306 Prohibited selling practices upon the occurrence of a severe thunderstorm. (1) Definitions. In this section:

SB45-SSA2-SA7,23,10 (a) “Consumer goods or services” means goods or services that are used primarily for personal, family, or household purposes.

SB45-SSA2-SA7,23,13 (b) “Restoration and mitigation services provider” means a person that provides a service to prevent further damage or provide protection to property following a fire, smoke, water, or storm event.

SB45-SSA2-SA7,23,15 (c) “Severe thunderstorm” means a weather event in which any of the following occurs:

SB45-SSA2-SA7,23,16 1. Hail that is one inch or greater in diameter.

SB45-SSA2-SA7,23,17 2. Wind gusts in excess of 50 knots.

SB45-SSA2-SA7,23,18 3. A tornado.

SB45-SSA2-SA7,23,23 (2) Prohibition. Upon the occurrence of a severe thunderstorm, a residential building contractor, tree trimmer, or restoration and mitigation services provider operating within the geographic region impacted by the severe thunderstorm and repairing damage caused by the severe thunderstorm may not do any of the following:

SB45-SSA2-SA7,24,2 (a) Charge an unreasonably excessive price for labor in comparison to the market price charged for comparable services in the geographic region impacted by the severe thunderstorm.

SB45-SSA2-SA7,24,6 (b) Charge an insurance company a rate for a consumer good or service that exceeds what the residential building contractor, tree trimmer, or restoration and mitigation services provider would otherwise charge a member of the general public for the consumer good or service.

SB45-SSA2-SA7,24,9 (3) Rules. The department shall promulgate rules to establish formulas or other standards to be used in determining whether a price for labor is unreasonably excessive under sub. (2) (a).

SB45-SSA2-SA7,24,14 (4) Enforcement; penalty. If a person violates sub. (2), the department or, after consulting with the department, the department of justice may commence an action against a person in the name of the state to recover a civil forfeiture of not more than $1,000 per violation or to temporarily or permanently restrain or enjoin the person from violating sub. (2), or both.

SB45-SSA2-SA7,47 Section 47. 165.25 (4) (ar) of the statutes is amended to read:

SB45-SSA2-SA7,24,22 165.25 (4) (ar) The department of justice shall furnish all legal services required by the department of agriculture, trade and consumer protection relating to the enforcement of ss. 91.68, 93.73, 100.171, 100.173, 100.174, 100.175, 100.177, 100.18, 100.182, 100.195, 100.20, 100.205, 100.207, 100.209, 100.2091, 100.2092, 100.21, 100.28, 100.37, 100.42, 100.50, 100.51, 100.55, and 846.45 and chs. 126, 136, 344, 704, 707, and 779, together with any other services as are necessarily connected to the legal services.

SB45-SSA2-SA7,48 Section 48. 196.5048 of the statutes is created to read:

SB45-SSA2-SA7,25,2 196.5048 Internet service provider registration. No person may provide Internet service in this state unless the person registers with the commission.

SB45-SSA2-SA7,49 Section 49. 704.05 (2) of the statutes is amended to read:

SB45-SSA2-SA7,25,13 704.05 (2) Possession of tenant and access by landlord. Until the expiration date specified in the lease, or the termination of a periodic tenancy or tenancy at will, and so long as the tenant is not in default, the tenant has the right to exclusive possession of the premises, except as hereafter provided. The landlord may upon advance notice and at reasonable times inspect the premises, allow a city, village, town, or county inspector access for an inspection, make repairs, and show the premises to prospective tenants or purchasers; and if the tenant is absent from the premises and the landlord reasonably believes that entry is necessary to preserve or protect the premises, the landlord may enter without notice and with such force as appears necessary.

SB45-SSA2-SA7,50 Section 50. 704.07 (2) (bm) 1. of the statutes is repealed.

SB45-SSA2-SA7,51 Section 51. 704.07 (2) (bm) 3. of the statutes is amended to read:

SB45-SSA2-SA7,25,17 704.07 (2) (bm) 3. The violation presents a significant threat to the prospective tenant’s health or safety.

SB45-SSA2-SA7,52 Section 52. 704.07 (5) of the statutes is repealed.

SB45-SSA2-SA7,9102 Section 9102. Nonstatutory provisions; Agriculture, Trade and Consumer Protection.

SB45-SSA2-SA7,26,10 (1) Emergency rules for sandhill crane damage reimbursement program. The department of agriculture, trade and consumer protection may use the procedure under s. 227.24 to promulgate emergency rules under s. 93.67 (4) for the period before the date on which permanent rules under s. 93.67 (4) take effect. Notwithstanding s. 227.24 (1) (c) and (2), emergency rules promulgated under this subsection remain in effect until the first day of the 25th month beginning after the effective date of the emergency rules, the date on which the permanent rules take effect, or the effective date of the repeal of the emergency rules, whichever is earlier. Notwithstanding s. 227.24 (1) (a) and (3), the department of agriculture, trade and consumer protection is not required to provide evidence that promulgating a rule under this subsection as an emergency rule is necessary for the preservation of public peace, health, safety, or welfare and is not required to provide a finding of emergency for a rule promulgated under this subsection.

SB45-SSA2-SA7,26,14 (2) Meat inspection program staff. Notwithstanding s. 230.27 (1), the termination date of 2.0 meat inspection project positions provided to the department of agriculture, trade and consumer protection under 2021 Act 58 is extended by 2 years.

SB45-SSA2-SA7,26,17 (?) Position authorizations. The authorized positions for the department of agriculture, trade and consumer protection are increased as provided in 2025 Senate Bill 45.

SB45-SSA2-SA7,9302 Section 9302. Initial applicability; Agriculture, Trade and Consumer Protection.

SB45-SSA2-SA7,26,22 (1) Subscribers permitted to terminate broadband contracts. The treatment of s. 100.2092 (1) (L) first applies to a contract that is entered into, renewed, or modified on the effective date of this subsection.

SB45-SSA2-SA7,9436 Section 9436. Effective dates; Public Service Commission.

SB45-SSA2-SA7,27,2 (1) Internet service provider registration requirement. The treatment of s. 196.5048 takes effect on January 1, 2026.”.
