AB50-ASA2-AA4,23,76(b) The department shall collect and store in the Parkinson’s disease registry 7data reported under s. 255.18 (2) by health care providers and health care facilities. AB50-ASA2-AA4,23,98(c) The department shall prescribe the format for reporting information to the 9department under s. 255.18 (2). AB50-ASA2-AA4,23,1910(d) The department shall create, and regularly review and revise, a list of 11information that health care providers and health care facilities must report, 12subject to s. 255.18 (2) (d), to the department under s. 255.18 (2). The list shall 13include the incident of a patient’s Parkinson’s disease or parkinsonism; necessary 14triggering diagnostic conditions, consistent with the latest version of the 15International Statistical Classification of Diseases and Related Health Problems; 16resulting case data on issues including diagnosis, treatment, and survival; and 17patient demographic information, including age, gender, and race. The Board of 18Regents of the University of Wisconsin System may promulgate rules to implement 19and administer this paragraph. AB50-ASA2-AA4,23,2320(e) The University of Wisconsin-Madison may enter into agreements in order 21for the department to securely and confidentially receive information from data 22reporting entities and their associated electronic medical records vendors related to 23Parkinson’s disease testing, diagnosis, and treatment. AB50-ASA2-AA4,24,424(f) 1. The University of Wisconsin-Madison may enter into agreements in
1order for the department to disclose data collected in the Parkinson’s disease 2registry to another state’s Parkinson’s disease registry, a federal Parkinson’s 3disease control agency, a local health officer, or a researcher who proposes to 4conduct research on Parkinson’s disease. AB50-ASA2-AA4,24,952. Before disclosing data containing confidential information to an entity 6under subd. 1., the University of Wisconsin-Madison shall require the entity to 7specify the purpose for the requested disclosure, agree in writing to maintain the 8confidentiality of the information and, if the entity is a researcher, provide all of the 9following to the University of Wisconsin-Madison: AB50-ASA2-AA4,24,1010a. A written protocol to perform research. AB50-ASA2-AA4,24,1411b. Documentation of approval of the research protocol by an institutional 12review board of a domestic institution that has a federalwide assurance approved by 13the office for human research protections of the federal department of health and 14human services. AB50-ASA2-AA4,24,1715c. Documentation that demonstrates to the University of Wisconsin-16Madison’s satisfaction that the researcher has established procedures and has the 17capability to maintain the confidentiality of the information. AB50-ASA2-AA4,24,2218(4) Website. (a) By no later than the first day of the 19th month beginning 19after the effective date of this paragraph .... [LRB inserts date], the department 20shall establish and maintain a public website dedicated to the Parkinson’s disease 21registry under sub. (3). The department shall include on the website all of the 22following: AB50-ASA2-AA4,24,24231. Downloadable annual reports on the incidence and prevalence of 24Parkinson’s disease in this state. AB50-ASA2-AA4,25,76(b) By no later than January 1 of each year, the department shall update the 7information specified in par. (a) 1. on the website maintained under par. (a). AB50-ASA2-AA4,25,108(c) The department shall publish on its website notice of the reporting 9requirement under s. 255.18 no fewer than 90 days before the reporting 10requirement takes effect. AB50-ASA2-AA4,25,1311(5) Confidentiality. (a) Any information reported to the department under 12s. 255.18 (2) that could identify an individual who is the subject of the report or a 13health care provider submitting the report is confidential. AB50-ASA2-AA4,25,1614(b) To ensure privacy, the department shall use a coding system for the data 15stored in the Parkinson’s disease registry that removes any identifying information 16about an individual who is the subject of a report under s. 255.18. AB50-ASA2-AA4,25,2017(c) 1. If the University of Wisconsin-Madison or the department discloses 18confidential information as authorized under sub. (3) (f), the University of 19Wisconsin-Madison or department may include in the disclosure only the 20information necessary for the purpose specified under sub. (3) (f) 2. AB50-ASA2-AA4,25,24212. A person who obtains confidential information from the University of 22Wisconsin-Madison or the department under sub. (3) (f) may use the information 23only for the purpose specified under sub. 1(d) The department shall maintain an accurate record of all persons given 2access to confidential information under this section. The specific purpose for which the information is to be used. AB50-ASA2-AA4,26,98(e) The department shall make the records maintained under par. (d) 9available for public inspection during the department’s normal operating hours. AB50-ASA2-AA4,26,1410(f) Confidential information under this section is not available for subpoena 11and may not be disclosed, discoverable, or compelled to be produced in any civil, 12criminal, administrative, or other proceeding. Confidential information under this 13section is not admissible as evidence in any civil, criminal, administrative, or other 14tribunal or court for any reason. 1(b) “Health care provider” means a physician, surgeon, physician assistant, or 2nurse practitioner. AB50-ASA2-AA4,27,33(c) “Parkinsonism” has the meaning given in s. 36.47 (1) (c) AB50-ASA2-AA4,27,44(d) “Parkinson’s disease” has the meaning given in s. 36.47 (1) (d). AB50-ASA2-AA4,27,65(e) “Parkinson’s disease registry” means the Parkinson’s disease registry 6established and maintained by the Population Health Institute under s. 36.47 (3). AB50-ASA2-AA4,27,97(f) “Population Health Institute” means the Population Health Institute, or 8its successor, at the University of Wisconsin-Madison School of Medicine and Public 9Health. AB50-ASA2-AA4,27,1710(2) Reporting required. Beginning on the first day of the 25th month 11beginning after the effective date of this subsection .... [LRB inserts date], if a 12health care provider diagnoses a patient with Parkinson’s disease or a 13parkinsonism in this state or, for a health care provider who has primary 14responsibility for treating a patient’s Parkinson’s disease or parkinsonism, treats a 15patient’s Parkinson’s disease or parkinsonism in this state, that health care 16provider or the health care facility that employs or contracts with the health care 17provider shall do all of the following: AB50-ASA2-AA4,27,1818(a) Offer the patient the opportunity to do all of the following: AB50-ASA2-AA4,27,20191. Review any informational materials developed by the Population Health 20Institute about the Parkinson’s disease registry. AB50-ASA2-AA4,27,22212. Speak with and ask questions of their health care provider about the 22Parkinson’s disease registry. AB50-ASA2-AA4,27,24233. Affirmatively decline, in writing, to participate in the collection of data for 24purposes of the Parkinson’s disease registry. AB50-ASA2-AA4,28,3
1(b) Except as provided in par. (d), report the information specified in the list 2under s. 36.47 (3) (d) about the patient’s case to the Population Health Institute in 3the format prescribed by the Population Health Institute under s. 36.47 (3) (c). AB50-ASA2-AA4,28,54(c) Notify the patient orally and in writing about the reporting requirement 5under par. (b). AB50-ASA2-AA4,28,106(d) If the patient affirmatively declines in writing to participate in the 7collection of data for purposes of the Parkinson’s disease registry, report only the 8incident of the patient’s Parkinson’s disease or parkinsonism to the Population 9Health Institute in the format prescribed by the Population Health Institute under 10s. 36.47 (3) (c).
