ASSEMBLY AMENDMENT 1, TO ASSEMBLY SUBSTITUTE AMENDMENT 2, TO ASSEMBLY BILL 50

AB50-ASA2-AA1,1,2 At the locations indicated, amend the substitute amendment, as shown by senate substitute amendment 2, as follows:

AB50-ASA2-AA1,1,3 1. At the appropriate places, insert all of the following:

AB50-ASA2-AA1,1,4 “Section 1. 20.255 (2) (b) of the statutes is amended to read:

AB50-ASA2-AA1,1,9 20.255 (2) (b) Aids for special education and school age parents programs. The amounts in the schedule A sum sufficient for the payment of the full cost of special education for children in hospitals and convalescent homes under s. 115.88 (4) and for the payment of aids for special education and school age parents programs under ss. 115.88, 115.93 and 118.255 as provided under s. 115.882.

AB50-ASA2-AA1,2 Section 2. 115.882 of the statutes is amended to read:

AB50-ASA2-AA1,2,6 115.882 Payment of state aid; reimbursement rate. Funds appropriated under s. 20.255 (2) (b) shall be used first for the purpose of s. 115.88 (4). Costs In the 2025-26 school year and in each school year thereafter, costs eligible for reimbursement from the appropriation under s. 20.255 (2) (b) under ss. 115.88 (1m) to (3), (6), and (8), 115.93, and 118.255 (4) shall be reimbursed at a rate set to distribute the full amount appropriated for reimbursement for the costs, not to exceed 100 percent 60 percent of eligible costs.”.

AB50-ASA2-AA1,2,7 2. At the appropriate places, insert all of the following:

AB50-ASA2-AA1,2,8 “Section 3. 121.905 (1) of the statutes is repealed and recreated to read:

AB50-ASA2-AA1,2,12 121.905 (1) In this section, “revenue ceiling” means $10,000 in the 2021-22 and 2022-23 school years, $11,000 in the 2023-24 and 2024-25 school years, $12,000 in the 2025-26 school year, and $12,400 in the 2026‑27 school year and in any subsequent school year.

AB50-ASA2-AA1,9234 Section 9234. Fiscal changes; Public Instruction.

AB50-ASA2-AA1,2,17 (1) General school aids. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (ac), the dollar amount for fiscal year 2025-26 is increased by $493,800,000 and the dollar amount for fiscal year 2026-27 is increased by $699,900,000.

AB50-ASA2-AA1,2,21 (2) Sparsity aid. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (ae), the dollar amount for fiscal year 2025-26 is increased by $10,016,800 and the dollar amount for fiscal year 2026-27 is increased by $10,236,800.

AB50-ASA2-AA1,3,2 (3) Per pupil aid. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (aq), the dollar amount for fiscal year 2025-26 is increased by $88,581,900 and the dollar amount for fiscal year 2026-27 is increased by $123,431,900.

AB50-ASA2-AA1,3,7 (4) Aids for special education and school age parents programs. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (b), the dollar amount for fiscal year 2025-26 is increased by $542,949,100 and the dollar amount for fiscal year 2026-27 is increased by $587,658,200.

AB50-ASA2-AA1,3,11 (5) Additional special education aid. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (bd), the dollar amount for fiscal year 2025-26 is increased by $8,789,000 and the dollar amount for fiscal year 2026-27 is increased by $9,720,000.

AB50-ASA2-AA1,3,15 (6) Special education transition readiness grants. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (bg), the dollar amount for fiscal year 2025-26 is increased by $500,000 and the dollar amount for fiscal year 2026-27 is increased by $500,000.

AB50-ASA2-AA1,3,19 (7) Wisconsin school day milk program. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (cp), the dollar amount for fiscal year 2025-26 is increased by $211,100 and the dollar amount for fiscal year 2026-27 is increased by $247,800.

AB50-ASA2-AA1,3,23 (8) Robotics league participation grants. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (dr), the dollar amount for fiscal year 2025-26 is increased by $250,000 and the dollar amount for fiscal year 2026-27 is increased by $250,000.

AB50-ASA2-AA1,4,3 (9) Grant program for peer review and mentoring. In the schedule under s. 20.005 (3) for the appropriation to the department public instruction under s. 20.255 (2) (fk), the dollar amount for fiscal year 2025-26 is increased by $803,300 and the dollar amount for fiscal year 2026-27 is increased by $803,300.

AB50-ASA2-AA1,9334 Section 9334. Initial applicability; Public Instruction.

AB50-ASA2-AA1,4,6 (1) Revenue ceiling; referenda restrictions. The repeal and recreation of s. 121.905 (1) first applies to the revenue ceiling for the 2025-26 school year.”.

AB50-ASA2-AA1,4,7 3. At the appropriate places, insert all of the following:

AB50-ASA2-AA1,4,8 “Section 4. 115.341 (1) of the statutes is amended to read:

AB50-ASA2-AA1,4,17 115.341 (1) From the appropriation under s. 20.255 (2) (cm), the state superintendent shall reimburse each school board, each operator of a charter school under s. 118.40 (2r) or (2x), each operator of a residential care center for children and youth, as defined in s. 115.76 (14g), the director of the program under s. 115.52, and the director of the center under s. 115.525 15 cents for each breakfast served at a school, as defined in 7 CFR 220.2, that meets the requirements of 7 CFR 220.8 and shall reimburse each governing body of a private school or tribal school 15 cents for each breakfast served at the private school or tribal school that meets the requirements of 7 CFR 220.8.

AB50-ASA2-AA1,5 Section 5. 115.341 (2) of the statutes is amended to read:

AB50-ASA2-AA1,4,23 115.341 (2) If the appropriation under s. 20.255 (2) (cm) in any fiscal year is insufficient to pay the full amount of aid under this section, the state superintendent shall prorate state aid payments among the school boards, operators, directors, and governing bodies of private schools and tribal schools entitled to the aid under sub. (1).

AB50-ASA2-AA1,6 Section 6. 115.341 (3) of the statutes is created to read:

AB50-ASA2-AA1,5,8 115.341 (3) Notwithstanding sub. (1), the state superintendent may not reimburse the operator of a charter school under s. 118.40 (2r) or (2x), the operator of a residential care center for children and youth, as defined in s. 115.76 (14g), the director of the program under s. 115.52, the director of the center under s. 115.525, or the governing body of a private or tribal school for any breakfast served at a school, as defined in 7 CFR 220.2, during the prior school year if the school ceased operations during that prior school year.

AB50-ASA2-AA1,9234 Section 9234. Fiscal changes; Public Instruction.

AB50-ASA2-AA1,5,15 (1) School breakfast reimbursement. In the schedule under s. 20.005 (3) for the appropriation to the department of public instruction under s. 20.255 (2) (cm), the dollar amount for fiscal year 2025-26 is increased by $3,027,400. In the schedule under s. 20.005 (3) for the appropriation to the department of public instruction under s. 20.255 (2) (cm), the dollar amount for fiscal year 2026-27 is increased by $3,082,100.”.

AB50-ASA2-AA1,5,16 4. At the appropriate places, insert all of the following:

AB50-ASA2-AA1,5,17 “Section 7. 16.23 of the statutes is created to read:

AB50-ASA2-AA1,6,2 16.23 First class city school district audit response support. (1) Subject to sub. (2), the department shall provide payments to a 1st class city school district to implement recommendations from instructional and operational audits of the school district initiated by the governor. Moneys received under this subsection may be expended for items addressed in the audits, development and implementation of integrated financial reporting software, and facilitation of data compatibility with state and local finance systems.

AB50-ASA2-AA1,6,5 (2) No payment may be made under sub. (1) unless, at the time of payment, the secretary is satisfied that the school district is already making substantial progress on implementation of the audit recommendations.

AB50-ASA2-AA1,8 Section 8. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated:

AB50-ASA2-AA1,7,12 48.483 Grants for out-of-school time programs. (1) In this section, “out- of-school time program” means a structured program or activity that meets all of the following conditions:

AB50-ASA2-AA1,7,15 (a) To the extent practicable, the program or activity is led by adult mentors using evidence-based or evidence-informed practices and is provided to school-age children before school, after school, or during the summer.

AB50-ASA2-AA1,7,17 (b) The program or activity does not supplant instructional services provided by a school or result in academic credit for students.

AB50-ASA2-AA1,7,18 (c) The program or activity relates to one or more of the following topics:

AB50-ASA2-AA1,7,19 1. Improving social, emotional, academic, or career readiness competencies.

AB50-ASA2-AA1,7,22 2. Reducing negative behaviors, including violence and crime, tobacco use, alcohol and substance abuse, disengagement from school, school suspension, truancy, and health-compromising behaviors.

AB50-ASA2-AA1,7,23 3. Providing a safe out-of-school time environment.

AB50-ASA2-AA1,7,24 4. Engaging in career exploration or formal or informal work-based learning.
