SB60,,22An Act to amend 342.14 (3) and 342.14 (3m); and to create 342.01 (2) (aj) of the statutes; relating to: fees for certain motor vehicle certificate of title transfers. SB60,,33Analysis by the Legislative Reference Bureau Under current law, the Department of Transportation issues a certificate of title to a new owner of a vehicle after ownership of the vehicle is transferred. The new owner pays a $157 fee for a certificate of title after a transfer and a $7.50 supplemental title fee. Currently, these two fees are waived when a vehicle is transferred upon a person’s death to his or her spouse or domestic partner.
Under this bill, these two fees are also waived when a vehicle is transferred upon a person’s death to an immediate family member of the decedent. “Immediate family member” is defined under the bill as “a spouse, grandparent, parent, sibling, child, stepchild, stepparent, or grandchild, or the spouse of a grandparent, parent, sibling, child, stepchild, stepparent, or grandchild.”

SB60,,44The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SB60,15Section 1. 342.01 (2) (aj) of the statutes is created to read: SB60,,66342.01 (2) (aj) “Immediate family member” means a spouse, grandparent, parent, sibling, child, stepchild, stepparent, or grandchild, or the spouse of a grandparent, parent, sibling, child, stepchild, stepparent, or grandchild. SB60,27Section 2. 342.14 (3) of the statutes is amended to read: SB60,,88342.14 (3) For a certificate of title after a transfer, $157, by the owner of the vehicle, except that this fee shall be waived with respect to an application for transfer of a decedent’s interest in a vehicle to his or her surviving spouse or domestic partner under ch. 770 or an immediate family member. SB60,39Section 3. 342.14 (3m) of the statutes is amended to read: SB60,,1010342.14 (3m) Upon filing an application under sub. (1) or (3), a supplemental title fee of $7.50 by the owner of the vehicle, except that this fee shall be waived with respect to an application under sub. (3) for transfer of a decedent’s interest in a vehicle to his or her surviving spouse or domestic partner under ch. 770 or an immediate family member. The fee specified under this subsection is in addition to any other fee specified in this section. This subsection does not apply to an application for a certificate of title for a low-speed vehicle. SB60,,1212(1) This act first applies to an application for a certificate of title received by the department of transportation on the effective date of this subsection.
