SB485,,22An Act to amend 943.87 of the statutes; relating to: robbery of a financial institution and providing a penalty. SB485,,33Analysis by the Legislative Reference Bureau Under current law it is a Class C felony to, by use of force or threat to use imminent force, take property from an individual that is owned or under the custody or control of a financial institution. This bill provides that it is also a Class C felony to take such property by creating circumstances that would cause a reasonable person to believe use of force was imminent. A Class C felony is punishable by imprisonment for up to 40 years or a fine of up to $100,000, or both.
Because this bill creates a new crime or revises a penalty for an existing crime, the Joint Review Committee on Criminal Penalties may be requested to prepare a report.
SB485,,44The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SB485,15Section 1. 943.87 of the statutes is amended to read: SB485,,66943.87 Robbery of a financial institution. Whoever by use of force or threat to use imminent force, or by creating circumstances that would cause a reasonable person to believe use of force was imminent, takes from an individual or in the presence of an individual money or property that is owned by or under the custody or control of a financial institution is guilty of Class C felony.
