Current law requires an agency to suspend working on a permanent rule if it determines that the proposed rule may result in more than $10,000,000 in implementation and compliance costs over any two-year period. This bill creates an exemption from this requirement for any proposed Department of Natural Resources rule that relates to establishing groundwater protection standards for perfluoroalkyl or polyfluoroalkyl substances (PFAS).

AB1119,15Section 1. 227.139 (4) (am) of the statutes is created to read:
AB1119,,66227.139 (4) (am) This section does not apply to a proposed rule of the department of natural resources relating to establishment of groundwater protection standards for perfluoroalkyl or polyfluoroalkyl substances under s. 160.07 or 160.15.
AB1119,27Section 2. 227.139 (4) (b) of the statutes is amended to read:
AB1119,,88227.139 (4) (b) If the department of natural resources believes that par. (a) or (am) applies to a proposed rule, the department shall include a statement to that effect in any economic impact analysis prepared under s. 227.137 for the proposed rule.
