SB70-SSA2-SA1,908 Section 908. 448.9545 (1) (a) of the statutes is amended to read:

The examining board shall promulgate rules to establish the continuing education requirements under this section. The rules shall require completion of not less than 30 credit hours of continuing education per 2-year period.

(1) (a), a licensee may provide athletic training to an individual without a referral, except that a licensee may not provide athletic training as described under s. 448.95 (5) (d) or (e) in an outpatient rehabilitation setting unless the licensee has obtained a written referral for the individual from a practitioner licensed or certified under subch. II, III, IV, V, or VII of this chapter; under ch. 446; or under s. 441.16 (2) 441.09 or from a practitioner who holds a compact privilege under subch. XI or XII of ch. 448.

Renewal applications shall be submitted to the department on a form provided by the department and shall include the renewal fee determined by the department under s. 440.03 (9) (a) and a statement attesting compliance with the continuing education requirements established in rules promulgated under s. 448.965 (1) (b).

The rules promulgated under this paragraph shall require at least 30 hours of continuing education per 2-year period. The board may provide for an exemption from or a reduction of the requirement under this paragraph for new licensees, as the board determines is appropriate.

SB70-SSA2-SA1,420,23 449.06 (1) Persons practicing optometry shall, on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a), register with, submit a renewal application to the department, pay the applicable renewal fee determined by the department under s. 440.03 (9) (a), and provide evidence satisfactory to the examining board that he or she has complied with the rules promulgated under sub. (2m).

SB70-SSA2-SA1,921 Section 921. 449.06 (2m) of the statutes is amended to read:

SB70-SSA2-SA1,421,9 449.06 (2m) The examining board shall promulgate rules requiring a person who is issued a license to practice optometry to complete, during the 2-year period immediately preceding the renewal date specified in s. 440.08 (2) (a), satisfy continuing education requirements. The rules shall require the completion of not less than 30 hours of continuing education per 2-year period. The rules shall include requirements that apply only to optometrists who are allowed to use topical ocular diagnostic pharmaceutical agents under s. 449.17 or who are allowed to use therapeutic pharmaceutical agents or remove foreign bodies from an eye or from an appendage to the eye under s. 449.18.

Except as provided under sub. (2) (a), only a holder of an unexpired license or registration may engage in his or her licensed activity.

SB70-SSA2-SA1,926 Section 926. 450.08 (2) (a) of the statutes is amended to read:

SB70-SSA2-SA1,423,2 450.08 (2) (a) A pharmacist's license may be renewed by complying with continuing education requirements under s. 450.085 and paying the applicable fee determined by the department under s. 440.03 (9) (a) on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a). Notwithstanding s. 440.08 (3) (a), if a pharmacist fails to obtain renewal by that date, the board may suspend the pharmacist's license, and the board may require the pharmacist to pass an examination to the satisfaction of the board to restore that license.

SB70-SSA2-SA1,423,8 450.08 (2) (b) A pharmacy, pharmacy technician's, manufacturer's, distributor's, or home medical oxygen provider's license or registration may be renewed by paying the applicable fee determined by the department under s. 440.03 (9) (a) on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a).

SB70-SSA2-SA1,928 Section 928. 450.085 (1) of the statutes is amended to read:

SB70-SSA2-SA1,423,21 450.085 (1) An applicant for renewal of a license under s. 450.08 (2) (a) shall submit proof that he or she has completed, within the 2-year period immediately preceding the date of his or her application, satisfied the applicable continuing education requirements established by the board under this subsection. The board shall require the completion of 30 hours of continuing education per 2-year period in courses conducted by a provider that is approved by the Accreditation Council for Pharmacy Education or in courses approved by the board. Courses specified in s. 450.035 (1r) and (2) are courses in continuing education for purposes of this subsection. This subsection does not apply to an applicant for renewal of a license that expires on the first renewal date after the date on which the board initially granted the license The board shall, for up to a 2-year period, exempt new licensees from the requirements under this subsection.

SB70-SSA2-SA1,929 Section 929. 450.10 (3) (a) 4. of the statutes is amended to read:

SB70-SSA2-SA1,930 Section 930. 450.11 (1g) (b) of the statutes is amended to read:

SB70-SSA2-SA1,424,14 450.11 (1g) (b) A pharmacist may, upon the prescription order of a practitioner providing expedited partner therapy, as specified in s. 441.092, 448.035, or 448.9725, that complies with the requirements of sub. (1), dispense an antimicrobial drug as a course of therapy for treatment of chlamydial infections, gonorrhea, or trichomoniasis to the practitioner's patient or a person with whom the patient has had sexual contact for use by the person with whom the patient has had sexual contact. The pharmacist shall provide a consultation in accordance with rules promulgated by the board for the dispensing of a prescription to the person to whom the antimicrobial drug is dispensed. A pharmacist providing a consultation under this paragraph shall ask whether the person for whom the antimicrobial drug has been prescribed is allergic to the antimicrobial drug and advise that the person for whom the antimicrobial drug has been prescribed must discontinue use of the antimicrobial drug if the person is allergic to or develops signs of an allergic reaction to the antimicrobial drug.

SB70-SSA2-SA1,931 Section 931. 450.11 (1i) (a) 1. of the statutes is amended to read:

SB70-SSA2-SA1,425,2 450.11 (1i) (a) 1. A pharmacist may, upon and in accordance with the prescription order of an advanced practice registered nurse prescriber under s. 441.18 (2) (a) 1., of a physician under s. 448.037 (2) (a) 1., or of a physician assistant under s. 448.9727 (2) (a) 1. that complies with the requirements of sub. (1), deliver an opioid antagonist to a person specified in the prescription order and may, upon and in accordance with the standing order of an advanced practice registered nurse prescriber under s. 441.18 (2) (a) 2., of a physician under s. 448.037 (2) (a) 2., or of a physician assistant under s. 448.9727 (2) (a) 2. that complies with the requirements of sub. (1), deliver an opioid antagonist to an individual in accordance with the order. The pharmacist shall provide a consultation in accordance with rules promulgated by the board for the delivery of a prescription to the person to whom the opioid antagonist is delivered.

SB70-SSA2-SA1,932 Section 932. 450.11 (1i) (b) 2. b. of the statutes is amended to read:

SB70-SSA2-SA1,425,6 450.11 (1i) (b) 2. b. An advanced practice registered nurse prescriber may only deliver or dispense an opioid antagonist in accordance with s. 441.18 (2) or in accordance with his or her other legal authority to dispense prescription drugs.

SB70-SSA2-SA1,933 Section 933. 450.11 (7) (b) of the statutes is amended to read:

SB70-SSA2-SA1,425,11 450.11 (7) (b) Information communicated to a physician, physician assistant, or advanced practice registered nurse prescriber in an effort to procure unlawfully a prescription drug or the administration of a prescription drug is not a privileged communication.

SB70-SSA2-SA1,426,17 452.12 (5) (a) Renewal applications for all licenses shall be submitted with the applicable renewal fee determined by the department under s. 440.03 (9) (a) on or before the applicable renewal date specified determined by the department under s. 440.08 (2) (a). The department shall pay $10 of each renewal fee received under this paragraph to the Board of Regents of the University of Wisconsin System for research and educational, public outreach, and grant activities under s. 36.25 (34).

(2) to (6) unless the person certifies to the examining board that the person has reviewed the current digest under s. 454.125.

SB70-SSA2-SA1,947 Section 947. 455.06 (1) (b) of the statutes is amended to read:

SB70-SSA2-SA1,428,8 455.06 (1) (b) A license issued under s. 455.04 (2) is valid for 2 years or until the individual obtains a license under s. 455.04 (1) and may not be renewed, except that the examining board may promulgate rules specifying circumstances in which the examining board, in cases of hardship, may allow an individual to renew a license issued under s. 455.04 (2). Notwithstanding sub. (2), an individual holding a license issued under s. 455.04 (2) is not required to complete continuing education the examining board shall, for up to a 2-year period, exempt new licensees from the requirements under sub. (2).

SB70-SSA2-SA1,948 Section 948. 455.065 (7) of the statutes is amended to read:

SB70-SSA2-SA1,428,16 455.065 (7) Grant an exemption from the continuing education requirements under this section to a psychologist who certifies to the examining board that he or she has permanently retired from the practice of psychology. A psychologist who has been granted an exemption under this subsection may not return to active practice without submitting evidence satisfactory to the examining board of having completed the required continuing education credits within the 2-year period specified by the board prior to the return to the practice of psychology.

SB70-SSA2-SA1,951 Section 951. 456.07 (2) of the statutes is amended to read:

SB70-SSA2-SA1,429,8 456.07 (2) The application for a new certificate of registration The renewal date for a license issued under this subchapter shall be as determined by the department under s. 440.08 (2). A renewal application shall include the applicable renewal fee determined by the department under s. 440.03 (9) (a), a report of any facts requested by the examining board on forms provided for such purpose, and evidence satisfactory to the examining board that during the biennial period immediately preceding application for registration the applicant has attended a continuing education program or course of study. During the time between initial licensure and commencement of a full 2-year licensure period, new licensees shall not be required to meet continuing education requirements. All registration fees are payable on or before the applicable renewal date specified under s. 440.08 (2) (a) The examining board shall, for up to a 2-year period, exempt new licensees from the continuing education requirements under this subsection.
