SB70-AA1,425,2214 450.03 (1) (e) Any person lawfully practicing within the scope of a license,
15permit, registration, certificate, or certification granted to practice as a pharmacy
16technician under s. 450.068, to provide home medical oxygen under s. 450.076, to
17practice professional or, practical , or advanced practice registered nursing or
18nurse-midwifery
under ch. 441, to practice dentistry, dental therapy, or dental
19hygiene or as an expanded function dental auxiliary under ch. 447, to practice
20medicine and surgery under ch. 448, to practice optometry under ch. 449, to practice
21naturopathic medicine under ch. 466, or to practice veterinary medicine under ch.
2289, or as otherwise provided by statute.
SB70-AA1,938 23Section 938. 450.08 (1) of the statutes is amended to read:
SB70-AA1,426,224 450.08 (1) The renewal dates for all licenses and registrations granted by the
25board are specified determined by the department under s. 440.08 (2) (a). Except as

1provided under sub. (2) (a), only a holder of an unexpired license or registration may
2engage in his or her licensed activity.
SB70-AA1,939 3Section 939. 450.08 (2) (a) of the statutes is amended to read:
SB70-AA1,426,114 450.08 (2) (a) A pharmacist's license may be renewed by complying with
5continuing education requirements under s. 450.085 and paying the applicable fee

8Notwithstanding s. 440.08 (3) (a), if a pharmacist fails to obtain renewal by that date,
9the board may suspend the pharmacist's license, and the board may require the
10pharmacist to pass an examination to the satisfaction of the board to restore that
11license.

SB70-AA1,941 18Section 941. 450.085 (1) of the statutes is amended to read:
SB70-AA1,427,519 450.085 (1) An applicant for renewal of a license under s. 450.08 (2) (a) shall
20submit proof that he or she has completed, within the 2-year period immediately
21preceding the date of his or her application,
satisfied the applicable continuing
22education requirements established by the board under this subsection. The board
23shall require the completion of
30 hours of continuing education per 2-year period
24in courses conducted by a provider that is approved by the Accreditation Council for
25Pharmacy Education or in courses approved by the board. Courses specified in s.

1450.035 (1r) and (2) are courses in continuing education for purposes of this
2subsection. This subsection does not apply to an applicant for renewal of a license
3that expires on the first renewal date after the date on which the board initially
4granted the license
The board shall, for up to a 2-year period, exempt new licensees
5from the requirements under this subsection

SB70-AA1,943 8Section 943. 450.11 (1g) (b) of the statutes is amended to read:
SB70-AA1,427,229 450.11 (1g) (b) A pharmacist may, upon the prescription order of a practitioner
10providing expedited partner therapy, as specified in s. 441.092, 448.035, or 448.9725,
11that complies with the requirements of sub. (1), dispense an antimicrobial drug as
12a course of therapy for treatment of chlamydial infections, gonorrhea, or
13trichomoniasis to the practitioner's patient or a person with whom the patient has
14had sexual contact for use by the person with whom the patient has had sexual
15contact. The pharmacist shall provide a consultation in accordance with rules
16promulgated by the board for the dispensing of a prescription to the person to whom
17the antimicrobial drug is dispensed. A pharmacist providing a consultation under
18this paragraph shall ask whether the person for whom the antimicrobial drug has
19been prescribed is allergic to the antimicrobial drug and advise that the person for
20whom the antimicrobial drug has been prescribed must discontinue use of the
21antimicrobial drug if the person is allergic to or develops signs of an allergic reaction
22to the antimicrobial drug.
SB70-AA1,944 23Section 944. 450.11 (1i) (a) 1. of the statutes is amended to read:
SB70-AA1,428,1024 450.11 (1i) (a) 1. A pharmacist may, upon and in accordance with the
25prescription order of an advanced practice registered nurse prescriber under s.

1441.18 (2) (a) 1., of a physician under s. 448.037 (2) (a) 1., or of a physician assistant
2under s. 448.9727 (2) (a) 1. that complies with the requirements of sub. (1), deliver
3an opioid antagonist to a person specified in the prescription order and may, upon
4and in accordance with the standing order of an advanced practice registered nurse
5prescriber under s. 441.18 (2) (a) 2., of a physician under s. 448.037 (2) (a) 2., or of
6a physician assistant under s. 448.9727 (2) (a) 2. that complies with the requirements
7of sub. (1), deliver an opioid antagonist to an individual in accordance with the order.
8The pharmacist shall provide a consultation in accordance with rules promulgated
9by the board for the delivery of a prescription to the person to whom the opioid
10antagonist is delivered.
SB70-AA1,945 11Section 945. 450.11 (1i) (b) 2. b. of the statutes is amended to read:
SB70-AA1,428,1412 450.11 (1i) (b) 2. b. An advanced practice registered nurse prescriber may only
13deliver or dispense an opioid antagonist in accordance with s. 441.18 (2) or in
14accordance with his or her other legal authority to dispense prescription drugs.

SB70-AA1,961 19Section 961. 455.065 (7) of the statutes is amended to read:

21under this section to a psychologist who certifies to the examining board that he or
22she has permanently retired from the practice of psychology. A psychologist who has
23been granted an exemption under this subsection may not return to active practice
24without submitting evidence satisfactory to the examining board of having

1completed the required continuing education credits within the 2-year period
2specified by the board prior to the return to the practice of psychology.

24the title “Nursing Home Administrator", and the abbreviation “N.H.A." after the
25person's name. No other person may use or be designated by such title or such

1abbreviation or any other words, letters, sign, card or device tending to or intended
2to indicate that the person is a licensed and registered nursing home administrator.

12examining board may waive all or part of the requirements established in rules
13promulgated under this section if it determines that prolonged illness, disability, or
14other exceptional circumstances have prevented the individual from completing the
15requirements.

2determines is substantially equivalent to attendance at and completion of continuing

SB70-AA1,970 5Section 970. 458.11 of the statutes is amended to read:
SB70-AA1,434,24 6458.11 Expiration and renewal. Renewal applications shall be submitted
7to the department on a form provided by the department on or before the applicable
8renewal date specified determined by the department under s. 440.08 (2) (a) and
9shall include the applicable renewal fee determined by the department under s.
10440.03 (9) (a). Renewal of an appraiser certificate automatically renews the
11individual's appraiser license without payment of the renewal fee for the appraiser
12license or completion of any additional continuing education requirements that
13would otherwise be required for renewal of the appraiser license. Renewal
14applications shall be accompanied by proof of completion of the continuing education
15requirements in s. 458.13. Notwithstanding s. 458.06 (3) (b) 2. and (4) (b) 2., 1989
16stats., and s. 458.08 (3) (b) 2. and (c) 2., 1991 stats., the department may not renew
17a certificate that was granted under s. 458.06 (3) or (4) before May 29, 1993, unless
18the holder of the certificate submits evidence satisfactory to the department that he
19or she has successfully completed the applicable educational requirements specified
20in rules promulgated under s. 458.085 (1) and the department may not renew a
21certificate that was granted under s. 458.08 (3) before May 29, 1993, unless the
22holder of the certificate submits evidence satisfactory to the department that he or
23she has successfully completed the applicable education and experience
24requirements specified in rules promulgated under s. 458.085 (1) and (2).
SB70-AA1,971 25Section 971. 458.13 of the statutes is amended to read:

and for approval of the sponsors and cosponsors of continuing education

SB70-AA1,982 22Section 982. 462.04 of the statutes, as affected by 2021 Wisconsin Act 251, is

25limited X-ray machine operator permit under this chapter may not use diagnostic

1X-ray equipment on humans for diagnostic purposes unless authorized to do so by
2prescription or order of a physician licensed under s. 448.04 (1) (a), a naturopathic
3doctor licensed under s. 466.04 (1), a dentist licensed under s. 447.04 (1), a dental
4therapist licensed under s. 447.04 (1m),
a podiatrist licensed under s. 448.63, a
5chiropractor licensed under s. 446.02, an advanced practice nurse certified under s.
6441.16 (2), a physician assistant licensed under s. 448.974, or, subject to s. 448.56 (7)
7(a), a physical therapist who is licensed under s. 448.53 or who holds a compact
8privilege under subch. XI of ch. 448.
