(3) When approving, adopting, or selecting an assessment, screening, or
5examination under ss. 118.016 (2) and (3) (a), 118.30 (1), and 121.02 (1) (r), the
6department or state superintendent shall approve, adopt, or select at least one
7version of the assessment, screening, or examination that can be administered as a
8remote examination consistent with the remote proctoring requirements under sub.
9(2) (a) to (e).”.

13(1) The department of public instruction shall conduct a pilot program for at
14least 3 virtual charter schools to administer remote examinations during the
152024-25 school year.

(2) The governing body of any virtual charter school may apply to participate
17in the pilot program under sub. (1).

(3) The department of public instruction shall accept applicants under sub. (2)
19in the following manner:

20(a) If the governing body of the virtual charter school with the highest number
21of pupils enrolled in the virtual charter school in the 2024-25 school year applies for
22the pilot program, the department of public instruction shall accept that virtual
23charter school.

1(b) If the governing body of at least 2 virtual charter schools other than the
2charter school under par. (a) apply for the pilot program, the department of public
3instruction shall accept at least 2 of those virtual charter schools.

4(4) A virtual charter school that participates in the pilot program under sub.
5(1) shall do all of the following in the 2024-25 school year:

(a) Administer to each pupil in at least one grade level in the school the
7examination under s. 118.30 (1m) (a) 1., (am) 1., or (b), (1r) (a) 1., (am) 1., or (b), (1s)
8(a), (b), (c), or (d), or (1t) (a), (b), (c), or (d), or any other examination in reading,
9mathematics, or science administered to pupils in grades 3 to 8 and 10 to comply with
1020 USC 6311 (b) (2) as a remote examination, as defined in s. 118.303 (1). The school
11shall ensure the examination is administered in accordance with the remote
12proctoring requirements under s. 118.303 (2) (a) to (e).

(b) Allow pupils to opt out of the remote examination under par (a). The school
14shall provide an in-person administration of the examination under s. 118.30 (1m)
15(a) 1., (am) 1., or (b), (1r) (a) 1., (am) 1., or (b), (1s) (a), (b), (c), or (d), or (1t) (a), (b),
16(c), or (d), or any other examination in reading, mathematics, or science administered
17to pupils in grades 3 to 8 and 10 to comply with
20 USC 6311 (b) (2) to any pupil that
18opts out of the remote examination.”.

Section 5.
Effective dates. This act takes effect on September 1, 2025,
