SB854,1,3 1An Act to create 115.28 (66), 118.40 (2r) (b) 2. m., 118.40 (2x) (b) 2. m. and 121.02
2(1) (L) 9. of the statutes; relating to: model curriculum for pupils in grades 5
3to 12 on interacting with law enforcement and granting rule-making authority.

This bill requires the state superintendent of public instruction, in consultation
with organizations representing law enforcement, to promulgate rules to develop a
model curriculum for pupils in grades 5 to 12 to instruct pupils on how to interact
with law enforcement with mutual cooperation and respect.
The bill allows a school board or operator of an independent charter school to
include in each grade from 5 to 12 instruction in law enforcement interactions that
is consistent with the model curriculum. The bill specifies that a school board that
elects not to include such instruction must adopt a resolution making that election.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB854,1 4Section 1. 115.28 (66) of the statutes is created to read:
SB854,2,35 115.28 (66) Police interactions education. Promulgate rules to develop a
6model curriculum for pupils in grades 5 to 12 to instruct pupils on how to interact

1with law enforcement with mutual cooperation and respect. The state
2superintendent shall consult with organizations representing law enforcement and
3shall ensure that the model curriculum includes instruction on all of the following:

5public safety.
SB854,2,76 (b) The responsibilities of an individual to comply with directives from law
7enforcement officials.
SB854,2,98 (c) The legal rights of an individual in interactions with law enforcement
9officials.
SB854,2 10Section 2 . 118.40 (2r) (b) 2. m. of the statutes is created to read:
SB854,2,1411 118.40 (2r) (b) 2. m. If the contract is for the operation of a charter school that
12includes a grade from 5 to 12, a requirement that the charter school's curriculum
13include the instruction required under s. 121.02 (1) (L) 9., so far as applicable, unless
14the charter school governing board elects not to include the instruction.

SB854,2,2321 121.02 (1) (L) 9. a. Except as provided in subd. 9. b., include instruction on
22interacting with law enforcement that is consistent with the model curriculum
23developed under s. 115.28 (66) at least once in each grade from 5 to 12.
SB854,3,224 b. If the school board elects not to include instruction as provided under subd.
259. a., adopt a resolution making that election. Any election by a school board under

1this subd. 9. b. requires the affirmative vote of a majority of the full membership of
2the school board.
SB854,5 3Section 5 . Initial applicability.
SB854,3,54 (1) School boards. The treatment of s. 121.02 (1) (L) 9. first applies to
5curriculum for the 2023-24 school year.
SB854,3,86 (2) Independent charter schools. The treatment of s. 118.40 (2r) (b) 2. m. and
7(2x) (b) 2. m. first applies to a contract that is entered into, renewed, or modified on
8the effective date of this subsection.
