16under the influence of alcohol for purposes of this subsection if he or she has an
17alcohol concentration that is equal to or greater than the amount specified in s.
18885.235 (1g) (d).
AB68,1666 19Section 1666. 103.503 (2m) of the statutes is created to read:

21section shall register with the department in the manner prescribed by the
22department by rule.

24department shall, by rule, establish a tiered fee structure, and fees shall be set at a

10alcohol testing before commencing work on the project, except that testing of an
11employee before commencing work on a project is not required if the employee has
12been participating in a random testing program during the 90 days preceding the
13date on which the employee commenced work on the project.

4of the division administering this chapter shall forward that fee to the department,
