ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 74

AB74-AA1,1,1 At the locations indicated, amend the bill as follows:

AB74-AA1,1,3 1. Page 1, line 2: delete that line and substitute “a type of milk, granting rule-making authority, and providing a penalty.”.

AB74-AA1,1,4 2. Page 2, line 14: after that line insert:

AB74-AA1,1,7 “(3m) Penalty. (a) Any person who violates sub. (1) shall be fined not less than $100 and not more than $1,000, for the first offense; and for each subsequent offense, fined not less than $500 and not more than $5,000.

AB74-AA1,1,11 (b) Notwithstanding par. (a) and s. 97.72, a person who sells or offers for sale food products at retail is not subject to a penalty for violating sub. (1) if the person does not engage in food processing, as defined in s. 97.29 (1) (g), of a food product that is labeled in violation of sub. (1).”.
