ASSEMBLY AMENDMENT 1, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO ASSEMBLY BILL 396

AB396-ASA1-AA1,1,1 At the locations indicated, amend the substitute amendment as follows:

AB396-ASA1-AA1,1,2 1. Page 44, line 19: after that line insert:

AB396-ASA1-AA1,1,5 “5m. If the applicant wishes to practice advanced practice registered nursing outside the context of an employment relationship with an employer, the applicant provides to the board evidence required under sub. (3) (cm) 2. a., b., c., or d.”.

AB396-ASA1-AA1,1,12 2. Page 45, line 3: delete the material beginning with “The board" and ending with “par. (a)" on line 6 and substitute “Based on the applicant's qualifications under par. (a), the board shall also grant an applicant who is granted a license under this subd. 1. a. one or more specialty designations corresponding to the recognized roles for which the board determines that the applicant qualifies, along with any authorizations to practice under sub. (3) (cm) 3. for which the board determines that the applicant qualifies.”.

AB396-ASA1-AA1,2,16 “(cm) 1. Except as provided in subd. 3., an advanced practice registered nurse may practice advanced practice registered nursing only within the context of an employment relationship with an employer.

AB396-ASA1-AA1,2,21 2. An advanced practice registered nurse or an applicant for a license under this section may apply to the board for authorization to practice advanced practice registered nursing outside the context of an employment relationship with employer in one of the 4 recognized roles by providing to the board evidence that the advanced practice registered nurse or applicant satisfies one of the following:

AB396-ASA1-AA1,2,24 a. The person has at least one year of experience practicing in that recognized role after the person became licensed under this section as an advanced practice registered nurse.

AB396-ASA1-AA1,3,3 b. If the person held a license to practice nurse-midwifery under s. 441.15, 2021 stats., the person has at least one year of experience practicing nurse-midwifery after the person first became licensed as a nurse-midwife.

AB396-ASA1-AA1,3,6 c. If the person held a certificate to issue prescription orders under s. 441.16, 2021 stats., the person has at least one year of experience practicing in that recognized role after the person first became so certified.

AB396-ASA1-AA1,3,9 d. If the person practiced in the recognized role outside this state, the person has at least one year of experience practicing in that recognized role outside this state.

AB396-ASA1-AA1,3,16 3. If the board determined that an applicant or an advanced practice registered nurse has provided sufficient evidence of practice under subd 2. a., b., c., or d., the person may practice advanced practice registered nursing outside the context of an employment relationship with an employer in the recognized role corresponding to his or her experience. In that case, a notation to this effect shall appear on the person's advanced practice registered nurse license alongside the corresponding specialty designation under sub. (1) (b) 2.”.
